Australian Defence Force Cadet obligations. An employee who is a Defence Reservist can take leave with pay for: up to 4 weeks (20 days) in each financial year (pro-rata for part-time employees); and an extra 2 weeks (10 days) in the first year of ADF Reserve service (pro-rata for part-time employees). Leave can be built up and taken over 2 consecutive years. This includes the extra 2 weeks in the first year of service. An employee who is an Australian Defence Force Cadet officer or instructor can get paid leave up to 3 weeks in each financial year to perform their duties. Australian Defence Force Cadets means: Australian Navy Cadets; Australian Army Cadets; and Australian Air Force Cadets. In addition to the entitlement at clause 303, paid leave may be granted to an employee to attend an interview or medical examination in connection with the enlistment of the employee in a Reserve Force of the Defence Force. Paid defence reservist leave counts for service. Unpaid defence reservist leave for 6 months or less counts as service for all purposes. This includes periods of CFTS. Unpaid leave taken over 6 months counts as service, except for annual leave. An employee will not need to pay their tax free ADF Reserve salary to the Department for any reason. Eligible employees may also apply for annual leave, long service leave, leave without pay or top-up pay, or they may use flextime or make up time, for the purpose of fulfilling ADF, CFTS or Cadet Force obligations. Defence service sick leave An employee is eligible for defence service sick leave credits when the Department of Veterans Affairs (DVA) has certified that an employee’s medical condition is as a result of either: warlike service; or non-warlike service. An eligible employee can get 2 types of credits: an initial credit of 9 weeks (45 days) defence service sick leave will apply as of the later below option: they start employment with the APS; or DVA certifies the condition; and an annual credit of 3 weeks (15 days) defence service sick leave. An employee can use their defence service sick leave when a recognised medical practitioner provides a certificate that says they were away due to their DVA certified medical condition. Unused annual credits can be built up to 9 weeks. An employee cannot use annual credits until the initial credit is exhausted.   • PROCUREMENT OBLIGATIONS Notwithstanding any other provisions of this Part B, where in this Part B the Customer accepts an obligation to procure that a Former Supplier does or does not do something, such obligation shall be limited so that it extends only to the extent that the Customer's contract with the Former Supplier contains a contractual right in that regard which the Customer may enforce, or otherwise so that it requires only that the Customer must use reasonable endeavours to procure that the Former Supplier does or does not act accordingly.

  • Client Obligations Client shall fulfill its obligations and responsibilities as set forth in this Agreement and the SOW so that Spirent can perform the Services efficiently and effectively. Client is responsible for the operation and security of its applications and the information technology environment in which the Services are to be performed. Client agrees that it shall have the sole responsibility for protecting and backing up its systems, networks, applications, content, and data used in connection with the Services. Client shall secure and provide to Spirent any rights and licenses necessary to allow Spirent to perform the Services. Client shall ensure the cooperation and performance of its employees and contractors as well as the accuracy and completeness of data and information provided to Spirent that are necessary to perform the Services. Client shall make and be responsible for all decisions and actions based or related to advice and recommendations provided by Spirent in connection with the performance of the Services hereunder. Client shall be liable for all Spirent owned equipment while in Client’s possession or control and, if lost or. damaged or not returned to Spirent upon expiration of the engagement, Client agrees to pay for such equipment upon receipt of an invoice referencing this Agreement. Equipment received by Spirent from Client more than five (5) calendar days after the end of engagement shall be subject to a fifteen (15%) per month late fee based on the list price of the equipment.

  • City Obligations 26.1 City shall provide full information in a timely manner regarding requirements for and limitations on projects and work tasks.
