Broadband Service. (a) If we consider that your bandwidth usage profile is abnormal or out of the ordinary (including without limitation extremely high levels of bandwidth use in a given period), we have the right to take such action as we deem appropriate which may include, without limitation, restricting or suspending your use of the broadband service, or increasing the charges you pay for the broadband service in accordance with paragraph 19.2.
(b) We will make reasonable endeavours to inform you in advance if we impose any restrictions on your use of the broadband service.
(c) Your use of the broadband service is entirely at your own risk. We will not be liable for any loss or damage arising from any virus, Trojan horse, spam or other malicious content that you may receive while using the broadband service notwithstanding that there may be a firewall contained in equipment supplied in connection with the broadband service.
(d) To ensure the quality of our broadband service we have a traffic prioritisation process to prioritise business critical applications in the event of exceptional demand, and normally only during business hours 08.00 to 18.00

Broadband Service. The Supplier shall provide a range of Broadband Service options, including as a minimum (but not necessarily limited to): xDSL variants “Superfast Broadband” based on Fibre to the Cabinet (FTTC) or Fibre to the Premises (FTTP) The Broadband Service may also include options based on cable or wireless technologies. The Broadband Service options shall conform to the relevant standards. The Broadband Service options shall include a range of appropriate bandwidths from 8Mbits/sec to 100Mbits/sec or higher. The Supplier shall provide any structural or civil engineering works necessary for its provision of the Broadband Service.
Broadband Service. (a) If we, in our reasonable opinion, consider that your bandwidth usage profile is abnormal or out of the ordinary (including without limitation high levels of bandwidth use in a given period based on our experience we have the right to take such action as we deem appropriate (including but not limited to in accordance with our other obligations under our agreements with our broadband suppliers) which may include without limitation, restricting or suspending your use of the Broadband Service on a temporary or permanent basis, and/or increasing the charges you pay for the Broadband Service in accordance with paragraph 2.12(d).
(b) We will inform you in writing if we impose any restrictions on your use of the Broadband Service.
(c) Your use of the Broadband Service is entirely at your own risk. We will not be liable for any loss or damage arising from any virus, Trojan horse, spam or other malicious contract that you may receive while using the Broadband Service notwithstanding that there may be a firewall contained in Equipment supplied in connection with the Broadband Service.
(d) In the event that your use of the Broadband Service exceeds reasonable levels, we shall be entitled to make such additional charges as may be necessary to cover our costs of providing such excess. This applies even in the event of usage arising from fraudulent or illegal activity whether by your employees, contractors, agents or third parties. It is your responsibility to prevent such usage and to deal with the consequences. Talk Straight will use its reasonable endeavours to mitigate your charges in such circumstances but cannot guarantee to do so.
Broadband Service a. Our Broadband service is only available on lines which are connected directly to a local BT exchange.
b. Broadband service is subject to availability and varies by geographic location.
c. We do not accept any responsibility for the quality of the Broadband Service where you are not using a router we have supplied.
d. Our Premium Router is supplied as standard and provides excellent WiFi coverage within small and medium sized homes; our Super Router is designed to provide even better WiFi coverage within larger properties. Router specifications and rental prices are detailed on our website.
e. Routers provided by us remain our property at all times.
f. All routers supplied by us come with a lifetime warranty for as long as you take our Broadband service. If a router we have supplied develops a fault, then we will provide a free replacement for as long as you are taking our Broadband service. We will not provide a free replacement where the fault is caused by loss, theft or physical damage. You must return the faulty router to us at your own expense within 30 days of informing us of the fault, using recorded delivery. If you fail to return the faulty router to us within 30 days of informing us of the fault, you will be charged our retail price for the router (as shown on our website) on your next bill.
g. You may upgrade to a better router at any time, subject to you paying the postage and packing costs of us sending the new router to you (this charge will be added to your next monthly Bill) and you arranging the return of the old router at your expense. Any rental charges in respect of the new router will apply from the date the upgraded router is provided to you. If you fail to return the old router to us within 30 days of receiving the upgraded router, you will be charged our retail price for the old router on your next bill.
h. Our Internet Services are designed for normal household usage. We reserve the right to restrict capacity, reduce speed or withdraw service from you where we have reasonable cause to believe the Broadband service is not being used for normal household usage, or in any other way which may adversely affect the performance of the Broadband service for other users, at our sole discretion.
i. You agree not to publish using our Broadband service any information, software or other content which violates or infringes upon the rights of any others or which we consider to be offensive, abusive, indecent, defamatory, obscene or otherwise u...
Broadband Service. You may request to change from an Off-Net (ADSL1 or ADSL2+) Broadband Service that we supply to you to the Naked DSL Service.
Broadband Service. 3.1.1 This paragraph 3 applies only if You purchase Our Broadband Service or Our Fibre Broadband Service from Us as selected on Your Application Form. Availability
3.1.2 Availability and activation of the Service is subject to survey. We will send confirmation or otherwise in writing prior to activation. If confirmed, the activation will proceed automatically. There is a possibility that activation of the Service may result in You experiencing a temporary loss of Call Service on Your line.
3.1.3 We cannot continue to provide the Service to You if You choose to terminate Your telephone Line Rental, or You change the Services on the telephone line so that Broadband cannot be enabled. If this happens, You agree that You remain liable for the Charges for the Broadband Service or Fibre Broadband Service for the remainder of the Minimum Period (if You are within Your Minimum Period) and We reserve the right to charge You such Charges and any Charges incurred by You for any Services You receive from Us until You have terminated Your Agreement in accordance with these terms.
Broadband Service. 3.2.1 Following completion of the Site Survey and the installation of the Equipment we shall carry out Standard Tests, or ask a third party to carry out the Standard Tests on our behalf to ensure the Service is ready for use. If having carried out the Standard Tests the Service is not ready for use, we will or in our discretion either repair or replace the Equipment and then repeat the Standard Tests. The Service will become active once the Standard Tests have been completed.
3.2.2 For Internet access you agree that your PC will meet the Minimum Specifications as detailed on the W3Z Wireless Broadband Service Document.
3.2.3 In the case of Internet access, you will be liable for any charges from other organisations while using these Service, as well as those billed by us as set out in our price guides.
3.2.4 You confirm and warrant that you are the owner of, and that you have obtained all necessary consents to use, the domain name, mailbox name or any other name selected by you in connection with the Internet access.
3.2.5 During installation we will configure the free email address and your existing email address. You acknowledge that we cannot guarantee you will be able to have and use any name you request and we may require you to select a replacement name if we believe that your current choice of name is, or is likely to be, in breach of our Fair Use Policy.
3.2.6 We reserve the right to monitor and control data volume and/or types of traffic transmitted via Internet access. In the event that you exceed any usage allowance applicable to your Service or your use does not comply with our Fair Use Policy which you can read on our website, we reserve the right (at our sole discretion) to reduce, suspend or terminate your Service. During any time of reduction or suspension, you will remain liable for the payment of your original Tariff.
Broadband Service. 15.1 The Service gives you the ability using a computer of appropriate specification and the Equipment (or other independently purchased modem or router of the appropriate specification), to access the Internet at the Transmission Speed and to use the Service(s) to access the Member Service(s) and download and/or upload data up to any monthly Usage Allowance (if applicable). Such use is also subject to our Fair Use Policy.
15.2 In the event that you either;
15.2.1 breach our Fair Use Policy and/or
15.2.2 you exceed any applicable monthly Usage Allowance; we reserve the right (at our sole discretion) to suspend the Service(s) that you have subscribed to until the start of your next monthly period without advance notice or to reduce the Transmission Speed of the Service for a reasonable period of time whilst we continue to monitor your usage.
15.3 If in our reasonable opinion your usage continues to be very high for 30 days or more or it exceeds any applicable Usage Allowance we also reserve the right to:
15.3.1 make a reasonable charge for additional usage above that Usage Allowance;
15.3.2 give you 30 days' written notice that we shall upgrade you to the next appropriate Service package at a different charge;
15.3.3 terminate the Service(s) on 30 days notice even if you are within your Minimum Period; or
15.3.4 continue to reduce the Transmission Speed of the Service(s) indefinitely until we are satisfied that the Usage Allowance will not be exceeded or we upgrade or terminate your Service in accordance with this Clause (whichever occurs first). We will give you reasonable notice of our intention to exercise our rights to suspend or terminate the Service. A reduction in Transmission Speed however may be imposed without advance notice.
Broadband Service. Prior to the Expiration Date the Grantee shall:
(a) offer broadband service at the Broadband Grant Speed to all residential and business customers within the Approved Project Service Area;
(b) offer free broadband service at the Broadband Grant Speed to all Essential Community Facilities within the Approved Project Service Area for at least 2 years starting from the time service becomes available to each Essential Community Facility.
