Court Witness Leave. A regularly scheduled full or part-time nurse required by 29 the Hospital or subpoenaed to serve as a witness as related to Hospital 30 employment will be excused with pay from any regularly scheduled duty whose 31 hours conflict with the hours he or she must actually spend in connection with the 32 witness service, provided the nurse deposits any witness fees received with 1 Human Resources. Relief nurses may receive such compensation only when 2 scheduled to work in advance, in writing. The nurse must report to work if the 3 witness service ends prior to the conclusion of the nurse’s scheduled shift. This 4 provision shall not apply to Association-originated subpoenas, Association- 5 related cases, arbitrations, or similar proceedings. When a nurse is called as a 6 witness in a private case unrelated to Hospital employment, he or she is not paid 7 for hours excused from scheduled duty and may retain all witness fees received.

Court Witness Leave. Approved use of Personal Necessity Leave for required appearances in court during normal work hours under official order as litigant or witness (Education Code §44036) or the employee is a victim of a crime (Labor Code §230.2). When the appearance is due to an employee’s actions as a “Good Samaritan” (Civil Code §1714.2 or Health and Safety Code §1799.102), the time off shall not be charged to sick leave.

Court Witness Leave. Employees who are called to serve as jurors or are subpoenaed as witnesses in criminal or civil courts, shall be granted leave of absence for such purpose without loss of any privileges. Normal pay will continue to be issued on the usual pay dates. At the conclusion of duty, the employee shall obtain a certificate from the Court showing the period of jury or witness service and the amount of the compensation received, and shall deposit this certificate together with the full amount of the compensation but not including allowances, with the City. Employees shall make every reasonable effort to request leave prior to such leave occurring.

Court Witness Leave. An employee who is subpoenaed or receives a court order, to appear in court or other similar administrative body, shall be deemed to be on a leave of absence. If the subpoena or court order relates to their City employment, the leave of absence will be with pay and the employee will not be required to use leave accruals. The employee shall remit to the City all fees received except mileage. If unrelated to their City employment, if the employee is subpoenaed or ordered to appear in court or other quasi-judicial proceeding, the employee is entitled to take the time off for this purpose. While the City will not provide paid time off, the employee may use vacation, compensatory time off or floating holiday leave hours for the time off. Leave shall not be granted for time spent on cases in which the employee is a party to the action and the matter is unrelated to their job, unless the employee is subpoenaed or ordered to court per the above paragraph. In these circumstances, employees would need to use other accrued leaves provided by this MOU.
