Critical Illness or Injury Leave. An employee who is entitled to critical illness benefits under the Employment Insurance Act is entitled to a leave of absence without pay of: (a) up to 36 weeks of unpaid leave to provide care or support to a family member who is under 19 years of age at the start of the leave; (b) up to 16 weeks of unpaid leave to provide care or support to a family member who is 19 years of age or older. There will be no interruption in the accrual of seniority for regular employees as per Article 11.03 or eligibility for benefits provided for under Article 27. In the event that present or future legislation enacts provisions with a greater entitlement to maximum weeks of leave in relation to critical illness, that legislative provision shall prevail.
