Declaration of Availability. 11.4.1 Unless otherwise notified by the Supplier, the declared Availability shall, be deemed to be 100% (one hundred per cent) thereof at all times.
11.4.2 In the event that any shortfall in supply of electricity to the Aggregator occurs on account of any deficiency in transmission access, the Availability shall be deemed to be reduced to the extent of reduction in transmission of electricity, and the reduction referred to hereinabove shall be deemed as Non-Availability on account of deficiency in transmission. For the avoidance of doubt and by way of illustration, the Parties agree that if such deficiency in transmission is equal to 20% (twenty per cent) of the Contracted Capacity, the Availability shall be deemed to be 80% (eighty per cent) and the Non-Availability hereunder shall be notified by the Supplier to the Aggregator forthwith.
11.4.3 The Supplier shall notify, no later than 15 (fifteen) days prior to the commencement of a month, its maintenance schedule for that month and any reduction in Availability arising as a result thereof. The Supplier shall, as soon as may be, notify any modifications of its maintenance schedule and shall confirm, with or without modifications, the reduction in Availability no later than 48 (forty eight) hours prior to its occurrence.
11.4.4 In the event that the Availability at any time is determined to be lower than 100% (one hundred per cent) of the Contracted Capacity or the reduced Availability notified hereunder, an event of mis-declaration of Availability (the “Mis- declaration”) shall be deemed to have occurred. In such an event, the Availability for the relevant month shall, for the purposes of payment of Fixed Charge, be deemed to be reduced by the same proportion that Availability bears to Mis-declaration, as if the Mis-declaration had occurred for a period of one month. For the avoidance of doubt, the Parties agree that deductions on account of Mis-declaration shall be made from the subsequent payments due to the Supplier under this Agreement.
11.4.5 Notwithstanding the provisions of Clause 11.4.4, any reduction in Availability arising out of de-commissioning due to Emergency or a Force Majeure Event shall not be deemed to be Mis-declaration if the Supplier shall have notified the Aggregator in accordance with the provisions of Clauses 16.5.

Declaration of Availability. Employees who wish to work twenty-four (24) or fewer hours per week shall have the option of submitting a written Declaration of Availability to the Employer (a “Declaration”). The Declaration will not be effective until the next un-posted work schedule is posted (i.e. approximately three (3) weeks following receipt of the Declaration by the Employer). In the Declaration, the employee will indicate when he or she is available to work each week. The employee must be available for at least sixteen (16) hours per week. The employee must also be available for at least one evening shift (other than on a Sunday) AND have open availability on Sunday for any shift. The employee, the Employer and the Shop Xxxxxxx must sign a copy of the Declaration, and the Employer must provide a copy of the Declaration to the Union. If an employee wishes to continue the Declaration from the previous year into the coming calendar year, the employee must still fully complete a new Declaration for the coming calendar year. Unless so renewed, all Declarations will terminate at the end of their respective calendar years. The employee may modify an active Declaration once during the Calendar year, to change the scope of the Declaration. The employee may terminate a Declaration during a calendar year, and then issue a second Declaration at a later time within the same calendar year. No more than two Declarations will be permitted within a calendar year for any one employee. If an employee wishes to terminate his or her Declaration, the employee must indicate so in writing on the Declaration form. A modification or termination of a Declaration will not take effect until the next un- posted schedule is posted (i.e. approximately three (3) weeks later). The employee will be required to work within their Declaration and may lose hours as a result of the Declaration. This means if a shift falls outside of the employee’s availability it shall not be subject to a claim. An employee who has an active Declaration may be asked to work additional shifts, however it is understood that all other employees who do not have a Declaration shall be asked to work those shifts first. An employee who has an active Declaration has the right to decline additional shifts outside their Declaration. Schedules shall reflect all Declarations in effect. The Employer requires all part-time employees to complete a Declaration of Availability form to be filled out on a four (4) week basis for the following four (4) weeks and handed in to the Department manager two (2) weeks prior to the schedule being posted. All part-time staff must be totally available to work at least two (2) Saturdays per month and two (2) regularly scheduled shifts until the close of their department, per week at the time the employee fills out their Declaration of Availability. The Employer will grant requested days off except in instances where shifts remain unfilled.

Employees must be available for at least sixteen (16) hours per week. These employees must be available for one late shift per week AND also have open availability on either Saturday or Sunday. This does not limit the number of weekend and/or late shifts an employee can be available for. In bargaining 2018, the parties reached the following understanding regarding changes to the Declaration of Availability under Section 9.10. Employees who restrict their hours to less than 16 hours per week must be available to work Saturday and Sunday. Employees shall be required to work within their Declaration of Availability and may lose hours as a result. This means if a shift falls outside of an employee’s availability it shall not be subject to claim. Employees cannot utilize Leaves provisions (e.g. T.A.B.) or R.T.O. to circumvent the intent of this language. All students are required to submit a schedule of classes and shall remain available to work when not attending class. All changes shall be effective the next posted schedule. Employees shall make their restriction(s) selection(s) and Declaration of Availability on a form provided by the Employer. The form shall be signed by Store Management and the Shop Xxxxxxx and a copy shall be provided to the Union.

Declaration of Availability. (a) The parties agree that part-time employees shall declare their availability three (3) times in the calendar year;
(i) January 1st
(ii) May 1st
(iii) September 1st Secondary students shall have the option of declaring their availability on the third Sunday in June instead of May 1st. Part-time employees shall be required to work schedules according to the above Declaration of Availability. No changes to the availability shall be permitted except as indicated above, or under circumstances beyond the control of the employee including the circumstance where an unrestricted employee is required to change their availability due to a conflict arising under Article 17.18 (c).
(b) The Company shall provide Declaration of Availability forms to any employee wishing to change his availability in accordance with the dates, prior to said dates. Such forms shall be completed by the employee and returned to their Supervisor. Failure to provide the Supervisor with a Declaration of Availability on the specified dates, shall result in the continuance of the previous Declaration of Availability. New employees shall be required to complete Declaration of Availability forms at the time of completion of their application for employment. Copies of all Declaration of Availability forms shall be forwarded to the Union Office.
(c) Unrestricted employees are employees who are fully available five (5) days per week. However, no more than twenty (20%) percent of all unrestricted part-time employees in any one department shall have the same day restricted. Seniority by department shall govern where more than twenty (20%) percent of the unrestricted employees in a department desire the same day off. All new employees hired after August 24, 1992 must be available to work Saturday.
