DOWNTOWN DEVELOPMENT AUTHORITY. Commissioner Talen: Highlights from yesterday’s DDA meeting include changing some definitions for one of the DDA’s programs that will now allow the installation of “parklets.” Businesses that qualify may add seating in a parking space or multiple parking spaces on the street. Also, the DDA gave its consent for a 14-story building with housing and commercial space at 20 E. Fulton. MISCELLANEOUS ADA Celebration Commissioner Bulkowski: Invited all to the Disability Advocates’ celebration of the 23rd anniversary of the signing of the Americans with Disabilities Act (ADA) on Tuesday, July 23rd, 12:00 (noon), at Rosa Parks. SPECIAL ORDER OF BUSINESS Kent District Library Annual Report Chuck Myers, Chair of the Board of Trustees, reported that the KDL 2005 budget was greater than 2014’s anticipated revenues of $14,396,000. This proves that KDL is operating leaner and smarter with a continued focus on customer service and remaining an award winning library. Lance Werner, Director of the Kent District Library – Reviewed the 2012 Annual Kent District Library (KDL) Report (copy of which is on file in the County Clerk’s Office). Numbers are down in some areas (circulation) and up in others (Wi-Fi access and patron numbers). The KDL received, for the third year in a row, the Star Library Award and was recognized for achieving the Cusack Excellence Level Award. The KDL was the only library in the state to win both awards. DOWNTOWN DEVELOPMENT AUTHORITY. Commissioner Xxxxx: The Grand Rapids DDA has begun construction at Veterans Memorial Park. Authorized the CEO to enter into a contract for the Calder Plaza design work. The St. Xxxxxxx Music Center is renovating to improve accessibility. Downtown Grand Rapids Inc. (DGRI) and the DDA have adopted performance measures. DGRI and the DDA are actively working at the state level on proposed changes to TIF legislation. Administrator Xxxxxxxx reported that he has met with Xxxxx Xxxxxx to discuss the commonalities that exist between the County and DGRI. This evening, they meet with legislators to discuss those items. Lakeshore Regional Partners (LRP) Commissioner Stek: The Lakeshore Regional Partners Executive Committee met on Tuesday. On Wednesday, they received the Governor’s budget which has created some anxiety and conversation. MISCELLANEOUS Agribusiness Commissioner Xxxxx: Apologized for missing the Agribusiness Work Session. Agribusiness is very important. The recent EPIC report on the Top Ten U.S. Cities with regard to quality of life revealed that nine out of those ten have active agricultural preservation programs. Agribusiness is a component of quality of life. NACo Legislative Conference & Grand Rapids Student Advancement Foundation Commissioner Xxxxxxxx: Will attend NACo’S legislative conference in Washington, D.C. in late February. He is on NACo’s Energy, Environment and Land Use Subcommittee and members will meet the director and staff of the Department of Energy. Also, in February, he and Commissioner Xxxxxx will host two fundraising events for the Grand Rapids Student Advancement Foundation. The funds will benefit music programs in the Grand Rapids Public Schools. Walk for Warmth & Letter Supporting Large-Scale Commercial Dog Breeder Act Commissioner Xxxxxxxx: Invited Commissioners to join her and participate in the annual Walk for Warmth Saturday, February 13, at 8:30 a.m., at the West Side Complex. The money raised provides heating assistance to low-income households in Kent County. Also, there is a letter available for Commissioners’ to sign showing support of a bill regarding large-scale commercial dog breeders. This legislation would require breeders to register with the Michigan Department of Agriculture and Rural Development and follow existing standards of care. DOWNTOWN DEVELOPMENT AUTHORITY. It is further agreed that the agency responsible for making original and replacement installations and performing maintenance shall be the RCOC. The CITY OF LATHRUP VILLAGE DOWNTOWN DEVELOPMENT AUTHORITY is the agency responsible for the costs related to installation. The CITY OF LATHRUP VILLAGE DOWNTOWN DEVELOPMENT AUTHORITY is the agency responsible for participating in maintenance costs, and the RCOC will invoice the CITY OF LATHRUP VILLAGE DOWNTOWN DEVELOPMENT AUTHORITY for the maintenance costs pursuant to the division of costs stated above. CITY OF LATHRUP VILLAGE DOWNTOWN DEVELOPMENT AUTHORITY shall pay all RCOC invoices within 30 days of the date of the invoice. Each party to this agreement will remain responsible for any and all claims arising out of its own acts and/or omissions during the performance of the agreement, as provided by this agreement or by law. In addition, this is not intended to increase or decrease either party’s liability for or immunity from tort claims. This agreement is also not intended to nor will it be interpreted as giving either party a right of indemnification, either by contract or by law, for claims arising out of the performance of this agreement. In the event the traffic control device referred to in this agreement is located on a road or street that is under the jurisdiction of the RCOC and by virtue of this agreement will be maintained by an agency other than the RCOC, then and in that event the said agency hereby acknowledges that it is undertaking the RCOC’s duty to maintain the said traffic control device, further agrees to provide insurance coverage protecting the RCOC, and further agrees to provide a Certificate of Insurance acceptable to the RCOC upon the agency’s execution of this agreement. This agreement is terminable on thirty days written notice by any party. The CITY OF LATHRUP VILLAGE DOWNTOWN DEVELOPMENT AUTHORITY shall pay any outstanding invoices upon written notice of the termination, and the final invoice shall be paid immediately upon receipt.
