Eligibility to Receive Donated Leave. In order to be eligible to receive donated leave, an employee must meet the following criteria as defined by and provided for in state law and School Board policy: A. Suffer from an illness, injury or condition that is of an extraordinary or severe nature that has caused, or is likely to cause, the employee to go on leave without pay or to terminate employment with the District; B. Have justified the absence and use of such a program, i.e. physicians’ verification; C. Have depleted or anticipate shortly depleting his or her annual and sick leave reserves; D. Have abided by District rules regarding sick leave use; and E. Have been found ineligible for benefits under Chapter 51.32 RCW (worker’s compensation). No employee may receive more than the equivalent of one of his/her work years in transferred leave.

Upon verification and 4 approval by the Associate Vice President-Human Resources, eligible leave credits may be donated to a part- 5 time faculty member for a catastrophic illness or injury if all of the following requirements are met: 6 • Part-time faculty who are provided a written offer to teach by the District in either a Fall or Spring 7 semester, or who have initiated their contractual agreement, and due to catastrophic illness or 8 injury prior to the commencement of the semester may apply donated leave credits upon 9 exhaustion of all accrued paid leave credits.

The maximum number of hours an eligible employee may receive from the Leave Bank in any 12 month period will be determined each year by the Contract Administration Meeting based on the hours available after the enrollment period. Other restrictions may apply. For example, if an employee receives paid hours from the Leave Bank and he/she is later reimbursed for the same hours by an insurance company, workers' compensation or other source, program benefits must be repaid.   • Sick Leave Credit-Based Retirement Gratuities 1) A Teacher is not eligible to receive a sick leave credit gratuity after August 31, 2012, except a sick leave credit gratuity that the Teacher had accumulated and was eligible to receive as of that day. 2) If the Teacher is eligible to receive a sick leave credit gratuity, upon the Teacher’s retirement, the gratuity shall be paid out at the lesser of, a) the rate of pay specified by the board’s system of sick leave credit gratuities that applied to the Teacher on August 31, 2012; and b) the Teacher’s salary as of August 31, 2012. 3) If a sick leave credit gratuity is payable upon the death of a Teacher, the gratuity shall be paid out in accordance with subsection (2). 4) For greater clarity, all eligibility requirements must have been met as of August 31, 2012 to be eligible for the aforementioned payment upon retirement, and the Employer and Union agree that any and all wind-up payments to which Teachers without the necessary years of service were entitled to under Ontario Regulation 01/13: Sick Leave Credits and Sick Leave Credit Gratuities, have been paid. 5) For the purposes of the following boards, despite anything in the board’s system of sick leave credit gratuities, it is a condition of eligibility to receive a sick leave credit gratuity that the Teacher have ten (10) years of service with the board: i.   • Overtime Meals When employees are required to work more than two (2) hours beyond their regular work days, the Employer will provide hot meals at no cost to the employees, up to a maximum of sixteen dollars ($16.00) (receipts to be submitted) plus paid meal periods of one-half (1/2) hour at the prevailing rate and thereafter at four (4) hour intervals. Any early morning start before regular starting time is entitled to a paid meal. The breakfast limit is thirteen dollars ($13.00) (receipts to be submitted).   • Your Ability to Withdraw Funds This policy applies to the availability of funds in transaction accounts. DATCU reserves the right to delay the availability of funds deposited to accounts that are not transaction accounts for periods longer than those disclosed in this policy. Our policy is to make funds from your deposits available to you on the business day we receive your deposit. At that time, you can withdraw the funds in cash and we will use the funds to pay checks that you have written.   • Failure to Return from Leave Any employee who has been granted a leave and who, for any reason, fails to return to work at the expiration of said leave shall be considered as having resigned his/her position with the County, and the position shall thereupon be declared vacated, unless the employee is on leave status protected under state/federal laws or he/she has furnished evidence that he/she was unable to return to work by reason of sickness, physical disability, or other legitimate reason beyond his/her control.
