EMPLOYEE CONCERNS PROGRAM. (a) DOE has established an Employee Concerns Program (ECP) in DOE Order 442.1A available at xxxx://xxx.xxxxxxxxxx.xxx.xxx/pdfs/doe/doetext/neword/442/o4421a.html. The ECP applies to any person working for DOE or a contractor or subcontractor on a DOE project. The ECP provides a means for employees to raise good-faith concerns that a policy or practice of DOE or one of its contractors or subcontractors should be improved, modified, or terminated. Concerns can address health, safety, the environment, management practices, fraud, waste, or reprisal for raising a concern. (b) In addition, the Company has an ECP. Subcontractor employees may raise concerns about actions of the Company or its employees directly with the Company. (c) The Seller must notify its employees that: (1) DOE and the Company have ECPs; (2) Employees are encouraged to first seek resolution with first-line supervisors or through existing complaint or dispute resolution systems, but that they have the right to report concerns through the DOE ECP; (3) If a concern is not resolved by supervisors, or if the employee elects not to raise the concern with supervisory personnel, the concern may be reported to the DOE Oak Ridge Operations Office (ORO) by calling the ORO Telephone Hotline, (000) 000-0000. Concerns related to actions by Company employees may be reported to the Company by calling (000) 000-0000; and (4) DOE and the Company will not tolerate reprisals against or intimidation of employees who have reported concerns. (d) Notices containing the information in (c)(1) through (c)(4), which are posted in areas where the DOE-related work is performed, will satisfy the notification requirement in subparagraph (c). (e) Upon request, the Seller must assist DOE and the Company in resolution of employee concerns. (f) The Seller shall include this clause in subcontracts hereunder.

EMPLOYEE CONCERNS PROGRAM. An Employee Concern is defined as a good faith expression by a concerned individual that (1) an activity, policy, or practice including but not limited to, the environment, safety, health, security, quality, and management of DOE facilities and/or operations, should be improved, modified, or terminated or (2) an employee has been subjected to harassment, intimidation, retaliation/reprisal, or discrimination for raising an Employee Concern. An Employee Concern should not be a minor grievance or suggestion that can be informally addressed, but rather should be interpreted as a formal concern submitted, orally or in writing, when in the employee’s judgement, attempts at resolution through the employee/management dialogue process have been or would be unsuccessful. The Supplier is required to maintain an Employee Concerns Program (ECP) in compliance with the following and to flow down these requirements to subcontractors at all tiers to the extent necessary to ensure compliance.

Employee concerns may also be submitted in writing to the BSA Employee Concerns Office, Building 400, or in person to the Xxxxx Xxxxxx, Employee Concerns Program Office, Building 400, 344-2888, during normal business hours, Monday through Friday 7:30 a.m. to 4:30 p.m. (2) For the purpose of this document, allegations, concerns, and complaints are handled in a like manner and are referred to collectively as “employee concerns.” A concern can consist of a declaration, statement, or assertion of impropriety or inadequacy on the part of one’s employer or others at a DOE Site that has affected (or threatens to affect) aspects of operations, such as the environment, health, safety, quality, or security, and may include fraud, mismanagement, waste, or abuse of authority. (3) No retaliation or retribution shall be taken toward any individual as a result of filing an employee concern compliant with 10 CFR 708.

(c) The Subcontractor must notify its employees that: (1) ORAU has an ECP; (2) Employees are encouraged to first seek resolution with first-line supervisors or through existing complaint or dispute resolution systems, but that they have the right to report concerns through the ECP; (3) If a concern is not resolved by supervisors, or if the employee elects not to raise the concern with supervisory personnel, the concern may be reported to ORAU by calling: (000) 000-0000; and (4) ORAU will not tolerate reprisals against or intimidation of a who have reported concerns. EMPLOYEE CONCERNS PROGRAM. Contractor shall implement an employee concerns program in connection with its performance of the Work as part of the Project Policies and Procedures pursuant to Section 3.12 (the “Employee Concerns Program”). The Employee Concerns Program provides a means for personnel working at Owner’s nuclear plants and support areas to report nuclear safety and quality concerns. Contractor shall provide Owner with reasonable access during normal working hours to written information regarding such concerns resulting from the Employee Concerns Program. Contractor’s employees shall comply with the provisions and requirements of this Program as follows: (a) The Employee Concerns Program applies to all personnel, including Contractor’s employees and those of its Subcontractors, who perform Work or provide Services or components to the Facility. Contractor’s employees may report safety and other work place issues in confidence or anonymously to the Employee Concerns Program. Contractor is required to inform its employees and those of its Subcontractors of the availability of the Employee Concerns Program. (b) Contractor also shall inform its employees and cause its Subcontractors to inform to its employees that they may notify Owner’s Project Director or Contractor’s Employee Concerns Program Representative, of any nuclear or radiological safety issue that arises in the course of Work performed at the Facility, and that they are free at any time, to contact the NRC with regard to any such issue. In turn, the Contractor and its Subcontractors are required to promptly advise the Owner’s Project Director of any nuclear or radiological safety issue brought to the Contractor’s attention, whether the issue is brought directly to Contractor or filed with a governmental agency or court. (c) Contractor shall designate an individual to serve as the contact for Employee Concerns Program matters. The designee, in addition to other duties, shall be responsible for: (i) Establishing contact with the Owner’s Employee Concerns Program representative as soon as practical after initially arriving on Site and Nearby Work Areas and providing the representative with names and work locations of each employee of Contractor performing the Work at the Site on a weekly basis thereafter. (ii) Furnishing the Owner’s Employee Concerns Program representative with information on impending terminations so the representative can be available to conduct exit interviews. An “employee concern” is a good- faith expression by an employee that a policy or practice by DOE, the Company, or a Company subcontractor should be improved, modified, or terminated. Concerns can address health, safety, the environment, management practices, fraud, waste, or reprisal for raising a concern. (2) ECP is designed to inform the Company and subcontractor employees of the proper forum for consideration of their concerns, ensure that employees can raise issues without fearing reprisal, and address concerns in a timely and objective manner. (3) While employees are encouraged first to seek resolution with first-line supervisors or through their employers’ existing complaint- or dispute-resolution systems, they have the right to report concerns through the Y-12 Employee Concerns Program. Concerns may be reported by using UCN-21222, Y-12 Employee Concerns Submittal (Word) or calling 0-000-000-0000. (4) Reprisals against employees in response to, or in revenge for, having raised good-faith reasonable concerns about DOE-related operations are prohibited by 10 CFR 708. (b) The Seller shall include this clause in subcontracts involving work on site at Y-12.
