Fiscal Emergency. The District may reopen the Agreement to address a “fiscal emergency” in accordance with the requirements of NRS 288.150(4).
Fiscal Emergency. In the event that a Fiscal Planning and Supervisory Commission determines there is a need to implement a Reduction-In-Force (RIF) due to fiscal emergency as defined in Ohio Revised Code (ORC) 3316.07, the Board shall comply with the provisions of 3316.07. At least sixty (60) calendar days prior to proceeding with an anticipated reduction in bargaining unit positions, the BEA President shall be notified by the Superintendent of the Board’s intent to consider a staff reduction. A meeting shall be held between representatives of the BEA and the Superintendent to review appropriate data indicating a need for a reduction in staff. The parties shall discuss why the reduction is deemed necessary, what teaching fields are to be affected, the extent of the anticipated reduction, and possible effects of said reduction. Also, at this meeting the BEA will be provided with a seniority list of all bargaining unit members. The number of bargaining unit members affected by a Reduction-in-Force will be minimized by not employing replacements for those bargaining unit members who retire, resign, or whose limited contracts are non-renewed due to unsatisfactory performance. Bargaining unit seniority shall be lost when a bargaining unit member retires or resigns, is employed in a full-time non- bargaining unit position, or is non-renewed or terminated. Administrators and bargaining unit members who leave the bargaining unit and take a full time administrative position shall lose all bargaining unit seniority and shall have no right to displace a bargaining unit member if he/she loses the administrative position for any reason. Reduction-in-Force during fiscal emergency shall follow the procedures outlined elsewhere in Article XV of the Master Agreement between the Xxxxxx Xxxxxx Local Board of Education and the Badger Education Association.
Fiscal Emergency. In the event the CITY declares a state of general fiscal emergency by formal Resolution, EMPLOYEES and CITY agree to reopen this section for further consideration in light of the declared fiscal emergency.
Fiscal Emergency. In the event of a fiscal/organizational emergency, the District 36 shall negotiate with the Association prior to the declaration of a state of emergency on 37 matters within the scope of representation as defined in section 3543.2 of the Educational 38 Employment Relations Act (EERA). Fiscal Emergency. 37.1 In addition to any other provisions of this MOU in the event the Board of Directors of District declares a "fiscal emergency" due to economic factors the terms of this MOU shall be subject to negotiations between the parties to meet the "fiscal emergency".
Fiscal Emergency. Section 1: Upon notification by the District to the Union that a fiscal emergency exists in accordance with NRS 288.150(4), the parties shall meet within 10 working days to commence negotiations. The District shall include with its notification all financial data and other information which shows a fiscal emergency does exist.
Section 2: A fiscal emergency exists for local government under the criteria set forth in NRS 288.150(4).
Section 3: Non-monetary articles cannot be opened by the parties as a part of this process.
Section 4: If the parties are unable to reach an agreement within twenty (20) working days from the first day of negotiation, the District may take additional action including reduction in force to address the fiscal emergency.
Section 5: The District cannot use the fiscal emergency process as a tool to impede or frustrate the normal collective bargaining process or as an alternative to the normal collective bargaining process. The Union may request and the District will provide documentation of the fiscal emergency.
Fiscal Emergency. If the District determines during the term of this Agreement that there is a fiscal emergency, pursuant to SB98 (2011), limited to reductions in property tax or the District’s Distributive School Allocation (DSA) as provided by the State Department of Taxation or State Department of Education this agreement will be automatically opened to address such fiscal emergency with written notification from the District to the Association President. The District and Association will meet during the term of this agreement to review and make recommendations regarding updated Teacher Evaluation policy and form. These recommendations shall be implemented in the 2013-2014 school year (in compliance with AB’s 222, 225 and 229). The District and Association will meet in the Joint Advisory Committee (Article 3.4) during the term of this agreement to review and make nonbinding recommendations to the Superintendent regarding “delayed start” vs. “on time start” for District inclement weather days.
Fiscal Emergency. During times the Omak School District is in a fiscal emergency:
1. The coach to participant ratio may be adjusted.
2. Payment for Coaching Clinics may be suspended.
3. The number of programs offered may be adjusted.
Fiscal Emergency. Subject to the appropriation of and allocation to the University by the State of adequate funding for the specific purposes identified for the full period covered by this Agreement, the following economic provisions shall apply: APPLICATION OF THE SUBJECT TO LANGUAGE IN THE PREFACE TO THIS ARTICLE In the event the University intends to withhold any of the economic provisions of this Article by invoking the “subject to” language in the prefatory paragraph of this Article, it is agreed that the invocation of the “subject to” language will be based on a determination by the University that there exists a fiscal emergency.1 If the University invokes the prefatory “subject to” language following the determination of a fiscal emergency, the University agrees as follows:
