HEALTH, SAFETY AND THE ENVIRONMENT. 18.1 Attention is drawn to the Company’s Health, Safety and Environmental Policy, as amended from time to time. The Company shall make available in the Company’s offices a copy of the policy current at the time of application for a berthing agreement. Any amendments shall be displayed on the Company’s public notice board or other prominent place the Company’s Premises and further copies available upon request. The Owner, his regular crew, members of his family and/or any person or company carrying out work on the Vessel, with the permission of the Company, must comply with the Company’s Health, Safety and Environmental Policy. 18.2 The Owner shall at all times be responsible for the proper upkeep and safe condition and maintenance of the Vessel, its gear and equipment (whether afloat or ashore) and shall maintain it in good, clean and seaworthy condition and ensure that the Vessel is able to navigate under its own power at all times. 18.3 The Owner, his crew, members of his family and any person carrying out work on the Vessel is responsible for reporting to the Company all accidents involving injury to any person or damage to any public or private property that occur in the Harbour or on the Premises as soon as possible after they occur and in any event no later than 48 hours after such accident or damage has occurred. 18.4 No noisy, noxious or objectionable engines, radio, or other apparatus or machinery shall be operated within the Harbour or Premises so as to cause nuisance or annoyance to other users of the Harbour or Premises or to any person residing in the vicinity and the Owner undertakes for himself, his guests and all using the Vessel that they shall not behave in such a way as to offend as aforesaid. Halyards and other rigging shall be secured so as not to cause such nuisance or annoyance. 18.5 No refuse shall be thrown overboard or left on the pontoons, or car parks or on any other part of the Premises, or disposed of in any way other than in the receptacles provided by the Company or by removal from the Company’s Harbour and Premises. The Company’s further directions regarding waste management shall be posted on the Company’s public notice board or other prominent place and copies will be available from the Company on request. 18.6 Bathing, diving and fishing within the Harbour or Premises is not permitted. 18.7 For the purpose of keeping the water clean and unpolluted, whilst moored in the Company’s Harbour, all Owners must refrain for using...

HEALTH, SAFETY AND THE ENVIRONMENT. (a) Within three (3) months of the Effective Date, the Contractor shall submit to the Designated Authority, for its approval, plans in regard to: (i) the health, safety and welfare of persons in or affected by Petroleum Operations; and (ii) the protection of the environment (including the marine environment and the atmosphere and the prevention of pollution), in order to reduce the risks to the personnel and the environment so they are as low as reasonably practicable. The plans shall be reviewed annually and amended from time to time as may be necessary to ensure its continuing compliance with Good Oil Field Practice. (b) Notwithstanding anything elsewhere contained in this Agreement, the Contractor shall clean up pollution resulting from Petroleum Operations to the satisfaction of the Designated Authority, and meet the costs of so doing to the extent done by anyone else (including the Designated Authority).
HEALTH, SAFETY AND THE ENVIRONMENT. (a) The Employer acknowledges its responsibility to make all reasonable and proper provisions to ensure the maintenance of high standards of the health, safety and wellbeing of their employees in the workplace. The Employer agrees to promptly take care of difficulties that arise from third party interference. (b) The Employer agrees to provide and maintain proper first-aid, firefighting and safety equipment on the premises. (c) An employee who considers that a practice being carried on within the day care premises is unsafe, or that equipment is faulty, will have the right to refuse to work with such equipment or under such conditions. If the Employer does not agree, it will be referred to the local health department.
HEALTH, SAFETY AND THE ENVIRONMENT. The SUPPLIER undertakes to comply with applicable regulatory requirements for safeguarding health, safety and the environment in accordance with the Internal Control Regulations. The SUPPLIER is obliged to provide goods and/or services to the RED CROSS of high environmental quality and with the least possible risk of dangerous or harmful situations.
HEALTH, SAFETY AND THE ENVIRONMENT. 25.01 The parties agree that they mutually desire to maintain standards of safety and health in the facility in order to prevent injury and illness. 25.02 A Joint Health and Safety Committee will be established with representation from various bargaining units and of employees who are not represented by Unions and who do not exercise managerial functions, and an equal number of Employer representatives. The Union will be entitled to two (2) representatives and, provided that the Union represents a majority of the employees at the work location, such additional representatives as are required to ensure the total number of Union representatives is greater than the total number of representatives from other unions, and employees who are not represented by unions. Employees who are not represented by unions do not include management representatives. 25.03 At no time shall the number of company members be allowed to outnumber the amount of union members. 25.04 Two (2) co-chairpersons shall be elected by and from the members of the committee. One co-chair shall be a union member, and the other shall be an Employer member. The non-management members of the committee will elect the Union co-chair. 25.05 The committee shall operate in accordance with the Occupational Health and Safety Act, as it may be amended from time to time. Meetings will be held quarterly or more frequently as the committee may determine. 25.06 Without limiting the generality of the foregoing, the committee shall: i) ensure that inspections have been carried out at least once a month by the co-chairs or designate of the workplace and equipment; ii) make recommendations for the improvement of the health and safety of workers;
HEALTH, SAFETY AND THE ENVIRONMENT. 16.1 The Parties acknowledge that they are familiar with the Product as specifically mentioned in the Schedule, in particular its separate and independent knowledge of the risks relating to the Product, such as the risks associated with handling, using, transporting, storing, and disposing of the Product, including, without limitation, those set forth in the Safety Data Sheets for the Product (“SDS”) as are generally known in the respective party’s industry. 16.2 The Parties shall comply with the Laws of the Republic of South Africa and other applicable international laws and requirements relating to the handling, packaging, labelling, carriage and transportation of the Product and shall maintain full compliance with all environmental, safety and health related governmental requirements and shall take all reasonable and practicable steps to inform, warn and familiarize its employees, agents, contractors and customers with all hazards associated with the Product, including handling, shipment, storage, use and disposal as well as protect any surrounding environment. The Parties shall be responsible for providing its employees with appropriate information and training to enable them to handle and use the Product Delivered hereunder in a manner which does not endanger their health or safety. The Parties shall not deliver or consign commercial or sample quantities of Product to any party whom the Parties reasonably believe will handle, ship, store, use or dispose of said Product in a dangerous manner or contrary to law. 16.3 To the extent permissible by law Seller shall not be liable in any respect whatsoever for any loss, damage or injury resulting from any risks relating to the Product after Delivery of same in terms of this Agreement, which risks Buyer acknowledges and warrants that it is familiar with and has separate and independent knowledge thereof as contemplated in clause 16.1 above.

You and your regular crew, members of your family and/or any person or company carrying out work on the Vessel must comply with our Health, Safety and Environmental policy, the terms of which shall be deemed to be incorporated into, and form part of, this Agreement. 17.2 You and your crew, members of your family and any person carrying out work on the Vessel are responsible for reporting to us all accidents involving injury to any person or damage to any public or private property that occur in the Harbour or on the Premises as soon as possible after they occur. 17.3 No noisy, noxious or objectionable engines, radios, generators, or other apparatus or machinery shall be operated within the Harbour or Premises so as to cause any nuisance or annoyance to any other users of the Harbour or Premises or to any person residing in the vicinity and you undertake on behalf of yourself, your guests and all using the Vessel that they shall not breach the terms of this Condition 17.
