Jury Duty or Court Appearance. If a Teacher is absent because of jury duty or any other appearance in court, provided such appearance is connected with or arises out of his/her position as a Teacher in this District, the Teacher shall lose neither salary nor leave time. Any compensation received for such appearance, however, shall be given to the Board or the Teacher will suffer loss of salary for all time absent from his/her teaching duties. The Board reserves the right to ask proper judicial authority to excuse a Teacher from jury duty when that Teacher’s absence may cause a hardship to the District.

An employee who is called to jury duty shall be paid his or her regular wages by the Town for the first three days, or part thereof, of Massachusetts jury service, if such jury service occurs during his or her regularly scheduled workday. An employee who is subpoenaed as a witness in a case pertaining to Town business is performing a duty of his/her employment and will be paid, portal to portal, for such appearance plus mileage from Police Headquarters to the location of the employee’s court appearance if the employee is using his/her own vehicle. a.) If such appearance occurs during the employee’s regularly scheduled workday he/she shall be paid his/her regular salary less the statutory appearance fee (which will be accomplished by the employee signing over his/her statutory appearance fee).‌ b.) If such appearance occurs during the employee’s off duty hours he/she shall be paid a four (4) hour minimum at one and one half times his/her regular pay less the statutory appearance fee, provided, however, if the time in court extends into the employee’s regular shift, he/she shall receive time and one-half only for the hours outside his/her shift. Section 5. No employee will be compensated or reimbursed for “court appearance” when appearing as a witness other than for Town business.‌
