Labor Xxxxxxx. On all construction jobs where eight (8) or more Employees are employed, there shall be a Laborer Xxxxxxx who shall receive wages as set forth herein. The following job titles are for rate classification purposes and do not constitute an exhaustive list of work performed by Laborers. Any question relative to the classification of a worker will be settled by the Employer and the Union. Wage rate classification in the contract establishes only a rate for Employees hired by Management and in no way relates to xxxxxxx projects. Construction Craft Laborer Xxxxxxxxx Tender - Including but not limited to loading, unloading, stockpiling, staging, removal and disposal of materials and equipment (excluding unwrapped or unpackaged custom fabrications), and clean-up related to tending carpenters. Labor Xxxxxxx. Section 1. When there are six (6) laborers employed on a project or job, one (1) laborer shall be a working xxxxxxx. For every six (6) additional laborers employed on a project or job, one (1) shall be a working xxxxxxx. The contractor may advance a working xxxxxxx to a non-working labor xxxxxxx if he so desires. Section 2. Employers shall appoint such foremen if any shall be needed. All such foremen shall be members of one of the Local Unions signatory to this Agreement as provided in Article 11 hereof. Said xxxxxxx shall have been employed as a laborer in the area covered by this Agreement for a period of not less than one year and shall be paid at least fifty-five cents ($0.55) per hour more than the rate of pay of the highest paid laborer under his supervision.

When there are seven (7) Laborers or more employed on a project or job, one xxxxxxx shall be supervision. The Contractor may advance a Working Xxxxxxx to supervision if he so desires. Section 3. At no time shall a Labor Xxxxxxx have more than twelve (12) men under his supervision. Section 4. Employers shall appoint such foremen if any shall be needed. All foremen shall be members of one of the Local Unions signatory to this Agreement. Said xxxxxxx shall be a member of such Local Union for a period of not less than one (1) year and shall be paid at least seventy-five ($.75) cents per hour more than the rate of pay of the highest paid Laborer under his supervision. Section 5. General Labor Xxxxxxx shall receive fifty ($.50) cents per hour more than the highest paid Labor Xxxxxxx under his supervision.

Section 3. General Labor Xxxxxxx shall receive one dollar and twenty-five cents ($1.25) per hour more than the highest paid man under his supervision.
Labor Xxxxxxx. Xx of the Closing Date (a) no strikes or other material labor disputes against any Credit Party are pending or, to any Credit Party's knowledge, threatened; (b) hours worked by and payment made to employees of each Credit Party comply with the Fair Labor Standards Act and each other federal, state, local or foreign law applicable to such matter; (c) all payments due from any Credit Party for employee health and welfare insurance have been paid or accrued as a liability on the books of such Credit Party; (d) except as set forth in Disclosure Schedule (3.7), no Credit Party is a party to or bound by any collective bargaining agreement, management agreement, consulting agreement or any employment agreement (and true and complete copies of any agreements described on Disclosure Schedule (3.7) have been delivered to Agent); (e) there is no organizing activity involving any Credit Party pending or, to any Credit Party's knowledge, threatened by any labor union or group of employees; (f) there are no representation proceedings pending or, to any Credit Party's knowledge, threatened with the National Labor Relations Board, and no labor organization or group of employees of any Credit Party has made a pending demand for recognition; and (g) except as set forth in Disclosure Schedule (3.7), there are no complaints or charges against any Credit Party pending or, to the knowledge of any Credit Party, threatened to be filed with any Governmental Authority or arbitrator based on, arising out of, in connection with, or otherwise relating to the employment or termination of employment by any Credit Party of any individual.

  • SHOP XXXXXXX The Shop Xxxxxxx shall be a County employee as selected by the Union. A list of shop stewards will be kept current and sent by the Union to each department head and to Human Resources. Duties required by the Union of its stewards, except attendance at meetings with the County, supervisory personnel and aggrieved employees arising out of a grievance already initiated by an employee under Article 14 hereof, shall not interfere with their or other employees, regular work assignments as employees of the County. The shop xxxxxxx, or their designee, involved with a particular grievance must be identified at Step 1 of the grievance procedure and will be designated as the only bargaining unit employee who will be able to gather information pertaining to that particular grievance. The Union will make reasonable efforts to control the amount of investigative time spent between the shop xxxxxxx and the aggrieved employee. Meetings scheduled with management and other proper investigative procedures, and attendance at meetings specified in Steps 1 and 2 of the grievance procedure shall be considered hours worked for compensation purposes to the extent such meetings occur during the normal hours of work, and not otherwise. In order to use union leave for this purpose, Shop Stewards must notify the supervisor/department head of meetings and other commitments at the time these are scheduled. Attendance at meetings specified in Step 3 of the grievance procedure shall be considered hours worked during regularly scheduled business hours of the County for the xxxxxxx involved, witnesses and the grievant. The County shall not be liable for any overtime as a result of the meeting. Witnesses and the shop xxxxxxx involved shall be granted leave with pay to the extent their presence at the proceedings is required. If it is a discharge case the grievant shall not be paid except as provided in a remedy awarded.
