Leave of Absence for Political Office. (a) In this Article “Candidate” means a person who has been officially nominated as a candidate, or is declared to be a candidate by that person, or by others, with that person’s consent, in a Federal or Provincial or election.

Leave of Absence for Political Office. (a) Xxxxx to seeking nomination for any elective political office, a staff member will meet with the President of the BCGEU for a comprehensive discussion of the implications of seeking the nomination. The President will advise the staff member of the likely effect, including possible reassignment, that the member's plans would have on their present assignment. (b) A staff member who is nominated as a candidate for Member of the Legislative Assembly or Member of Parliament will be granted leave of absence without pay from the date of nomination until the day following the election or a shorter period requested by the staff member. (c) If a staff member is elected to political office, leave without pay shall be granted for a full legislative term, up to a maximum of five years. They shall return to the first available position for which they are qualified. (d) If the staff member is unsuccessful and is not elected, they will return to active employment subject to relocation or reassignment of duties at the discretion of the BCGEU. (e) The staff member will suffer no financial loss if not placed in their original position and will be subject to red-circling upon return.

Leave of Absence for Political Office a) The Board shall grant a leave of absence without pay, benefits or other entitlements, save and except seniority which shall continue to accrue, to a teacher for the purpose of campaigning for or serving as an elected member of the Municipality, Legislative Assembly of Ontario or the Federal House of Commons. b) A teacher who is an unsuccessful candidate for election, or re-election, shall return to the teacher’s school or workplace to a position for which they are qualified, subject to Article 23 Annual Staffing Process.

During such leave, an employee will retain all previously accrued bargaining unit seniority and shall continue to accrue bargaining unit seniority for the first thirty (30) days. However, there will be no accrual of benefits or participation in benefit programs except where otherwise stipulated by law. Such leave may not be renewed upon its expiration for the purpose of re- election or reappointment. (See Article 18, Leaves of Absence, Section 1.C., General Provisions).

If the staff member is unsuccessful and is not elected, they will return to active employment subject to relocation or reassignment of duties at the discretion of the BCGEU. v. The staff member will suffer no financial loss if not placed in their original position and will be subject to red-circling upon return. vi. If a staff member is elected to a political office requiring only part-time duties, they will be granted leave of absence without pay to attend to the essential duties of that role on an as-needed basis. BCGEU will require advance notice of ten (10) business days for such leave. If insufficient notice is provided, BCGEU may approve or deny the leave on the basis of operational requirements.

Leave of Absence for Political Office. An employee's leave of absence to be a Candidate shall terminate on the day the successful Candidate in the election is declared elected unless, on or before the day immediately after ordinary polling day, the employee notifies the Employer that the employee wishes his/hertheir leave of absence to be extended for such number of days, not exceeding ninety (90), as the employee states in the notice and in such case the leave of absence shall terminate as stated in the notice.

Leave of Absence for Political Office. In the event a faculty member decides to become a candidate for public office, it is professional courtesy that the faculty member informs the department chair or director of this intention. In the case of a candidacy for any office, the faculty member shall either continue to perform all duties, or take a leave of absence without pay. The faculty member shall inform the department chair or director and appropriate department committee in the event of his/her election to a full-time public office, and the faculty member shall request a leave of absence without pay. No such leave of absence shall be extended beyond two (2) years. In the case of a part-time office, such as membership on city councils, school boards, boards of supervisors, etc., a leave of absence may not be required.
