Licensing & Qualifications. All employees are required to maintain the appropriate licenses, certificates, and/or accreditations for the performance of their job responsibilities The Employer agrees to post or otherwise notify employees of the expiration dates the Employer has on file for required licenses, certificates, and/or accreditations not less than every six (6) months. Failure to maintain such licenses, certificates and/or accreditations may result in corrective action, up to and including discharge. It is the responsibility of each individual employee to ensure that all licenses, certificates, and/or accreditations are maintained. Employees who perform work duties without the required license, certificate, and/or accreditation may be subject to discharge. Employees who notify the Employer prior to the expiration or loss of a required license, certificate, and/or accreditation shall be given Employees whose required license, certificate, and/or accreditation expires shall be placed on unpaid administrative leave and receive a final written warning. Failure to obtain the required license, certificate, and/or accreditation within thirty (30) days shall be cause for separation from employment. Employees whose state or local license is temporarily suspended by a state or local agency (other than suspensions covered by Article 25 of this Agreement) shall be placed on unpaid administrative leave for a maximum of ninety (90) days. Employees may utilize accrued PTO solely at their option during any portion of the suspension. Employees shall be required to have all licenses, certifications, and/or accreditations up to date at the conclusion of the suspension. Failure to maintain such licenses, certifications, and/or accreditations shall be cause for separation from employment. Employees on approved leaves of absence shall be required to have all licenses, certifications, and/or accreditations up to date prior to returning from leave except as otherwise provided in Article 13.2 of this Agreement. Failure to maintain such licenses, certifications, and/or accreditations shall be cause for separation from employment.

It is the sole responsibility of each individual employee to ensure that all licenses, certificates, and/or accreditations are maintained and in the employee’s possession at all times while on duty. Failure to maintain a valid license, certificate and accreditation will result in disciplinary action, up to, and including termination. C. The Employer shall provide continuing education units for all mandatory job related training.

If at any time, for any reason, an employee of the Employer is without benefit of state and local licensure or certification required by state law and/or local regulations, for performance of the duties of that employee, he/she shall be immediately suspended, without pay for up to fourteen (14) calendar days in order to give the opportunity to submit a valid license or certification. Upon receipt of the valid license or certification the employee will be placed back on their regular schedule and issued a written warning with suspension equivalent to the time served. Employees who can show (within the 14 day period) authenticated proof of enrollment in a particular class necessary to obtain a valid license or certification will be extended the time on suspension to acquire the valid license or certification. Submission of proof in obtaining a license or certification (i.e., temporary ADL, CDL) will suffice as evidence of submission of such license or certification. On the second occasion during the course of their employment, should an employee have their license or certificate expire or be suspended or is found to be without their license or certification, such employee may be subject to discipline up to and including discharge.
