Maintenance — General. With regard to those facilities, improvements and equipment of any kind, including pipelines, pipe racks and conduits, owned by a Party on its Parcel which are necessary to carry out the purposes of one or more Service Agreements or the Easements granted herein, Fertilizer Company and Refinery Company each agrees to maintain in good order and condition (with the term ‘maintain’, as used in this paragraph, hereby deemed inclusive of repairs and replacements, as necessary) at its sole cost and expense, those facilities, improvements and equipment located on its Parcel and owned by it. Each Party shall also maintain its facilities, equipment and other improvements up to the Interconnect Points therefor which are located from time to time on the other Party’s Parcel. Notwithstanding the foregoing, neither Party has the obligation at any time to maintain facilities owned by the other Party, whether such facilities, equipment and other improvements are located on the other Party’s Parcel or on a Party’s own Parcel.

Maintenance — General. The current (May 1999) Maintenance General employee will be red circled at the P6 wage rate in consideration of long experience in the job. This shall not apply to future incumbents. However, for bumping purposes the P4 classification will be used. Xxxxxx Wydymus Xxxxxx Wydymus Leader Factory Operations LETTER OF UNDERSTANDING #14 RE: ALTERNATE SHIFT AGREEMENT Alternate shift as in the Chocolate facility may be extended to other departments by mutual agreement. The Union has agreed to facilitate the implementation in other departments as required by mutual agreement. It is agreed that negotiations over this issue will be restricted only to issues directly arising out of the extension of the alternate shift and shall not include “trade-off” for other unrelated issues in the plant or changes to the March 7, 1997 Alternate Shift Agreement except as follows: page 1, paragraph 5 - delete “which expires on April 30, 1999” page 2, Article 18 - replace second sentence with the following “Any employee currently working in the area does not post to, or is unsuccessful on a posting to this new shift pattern, shall have their rate of pay maintained for six (6) months while working as long as they do not post into another job at a higher rate”. page 5, paragraph 2 - change date to April 30, 2005. Maintenance — General. (a) It shall be the Operator's responsibility to maintain equipment, buildings, and other facilities associated with the Project in accordance with good utility practice, manufacturer's recommendations, and applicable State and Federal regulations.

In this regard, CONTRACTOR shall provide all labor, repairs, parts, supplies, maintenance tools and equipment, lubricants, solvents, service facilities and such other components, and service which may be required to fulfill its maintenance responsibilities, at CONTRACTOR's sole cost and expense.

In this regard, CONTRACTOR shall provide all labor, lubricants, solvents, repairs, parts, supplies, maintenance and repair tools and equipment, service facilities and such other components, facilities and services which may be required to fulfill its maintenance and repair responsibilities, at CONTRACTOR’S sole cost and expense.
