NIGHT DIFFERENTIAL PAY Clause Samples
The Night Differential Pay clause establishes additional compensation for employees who work during designated nighttime hours. Typically, this clause specifies the exact hours considered as "night"—for example, work performed between 10:00 p.m. and 6:00 a.m.—and outlines the percentage or amount of extra pay employees are entitled to receive for such shifts. Its core function is to incentivize employees to work less desirable hours and to fairly compensate them for the inconvenience or increased difficulty associated with nighttime work.
NIGHT DIFFERENTIAL PAY. A 5% night differential will be paid to those unit members whose regular assignment requires working four or more hours between 6pm and 6am.
NIGHT DIFFERENTIAL PAY. Unit members starting their workday after 11 a.m. shall be additionally compensated at a calculation based on column "F" Step 33 multiplied by .030.
NIGHT DIFFERENTIAL PAY. Night Differential pay will be applied to hours worked between 5:00 p.m. and 6:00 a.m.
NIGHT DIFFERENTIAL PAY. The City shall pay $1.00 per hour additional wages for each hour worked in a shift that begins at or after 2:00 p.m. Shifts beginning at or after 5:00 a.m. shall be considered day shifts and will not be subject to the differential.
NIGHT DIFFERENTIAL PAY. Shifts: Work designated by the Police Chief as either “swing” (starting at 2:00 p.m.) or “graveyard” (starting at 8:00 p.m. or 10:00 p.m.) shall be considered night work and eligible for night differential pay. Any work designated as “day” shift even though it may overlap on “swing” or “graveyard,” shall not be considered for night differential pay. Any overtime which falls into “swing” or “graveyard” shall be eligible for night differential pay.
NIGHT DIFFERENTIAL PAY a. Employees regularly assigned to night or shift work shall be paid forty (40) cents per hour above their established pay rates for each hour worked on a shift which commences between the hours of 2:00 p.m. and 5:00 a.m. This provision shall not apply to employees whose emergency assignments start or carry into the above-named periods. When applicable, night differential shall be paid at the appropriate overtime rate.
b. An employee not regularly assigned to the night shift, but who works overtime hours into the night shift, shall receive the night differential for all overtime hours worked into the night shift in excess of ten (10) hours in a given bi-weekly payroll period. Said differential shall be paid at the rate of forty (40) cents an hour at time and one-half (1 ½ ).
c. An employee who works overtime extending into the night shift shall be paid the night differential of forty (40) cents at time and one-half (1 ½ ) of that rate if he works the entire night shift regardless of the total number of hours of overtime worked within the given payroll period.
NIGHT DIFFERENTIAL PAY. Night Differential Pay of $60 per month will be paid to unit members whose regular workday includes at least 50% of the workday after 5:00 pm.
NIGHT DIFFERENTIAL PAY. Effective July 1, 2010 employees whose regular assignment requires them to work at least one-half of their regular shift between the hours of 4:30 p.m. and midnight shall receive night differential pay of 2.5% above their regular hourly rate of pay for each hour worked. Employees whose regular assignment requires them to work at least one-half of their regular shift between the hours of midnight to 7:00 a.m. shall receive night differential pay of 3.0% above their regular hourly rate of pay for each hour worked.

1. Stand-by Duty Definition: A period of time during which the assigned Employee is to be responsible for responding to any emergency or other necessary duty call without delay during non-duty hours.
NIGHT DIFFERENTIAL PAY. Employees are compensated differential pay for regularly scheduled non-overtime work performed at night in accordance with governing laws, rules, and regulations.
SECTION 1. NIGHT PAY (GENERAL SCHEDULE (GS) EMPLOYEES). Employees on a General Schedule receive differential pay for regularly scheduled work scheduled between 6 pm and 6 am amounting to 10 percent of the employee’s basic pay.
1.1. For General Schedule Employees on a Flexible Work Schedule the following will apply for night differential pay: - If a flexible work schedule includes 8 or more hours available for work between 6 a.m. and 6 p.m., the employee is not entitled to night pay for voluntarily working flexible hours between 6 pm and 6 am including while earning credit hours. - An employee is entitled to night pay for those hours that must be worked between 6 pm and 6 am to complete an 8-hour daily tour of duty. - An employee is entitled to night pay for any non-overtime work performed between 6 pm and 6 am during designated core hours.
