OFF DUTY COURT ATTENDANCE. (a) Where a member is required to attend at Court during off-duty hours, the member is to be paid a minimum of four (4) hours at time and one- half (1½) hours at the member’s normal salary rate, and time and one- half (1½) hours at the member’s normal salary rate for all additional hours.
(b) Where a member is required to attend Court immediately after working any regular shift that finishes after midnight, the member is to be paid a minimum of four (4) hours at time and one-half (1½) hours at the member’s normal salary rate, and at time and one-half (1½) hours at the member’s normal salary rate for all additional hours, plus one (1) hour.
(c) Where a member is required to travel out of the City of Xxxxxxxx to attend Court while off duty, the member is to receive a credit of one and a half (1½) minutes for each driving mile traveled as calculated from the City of Xxxxxxxx City Xxxx, in addition to the Court time allowance for that attendance.
(d) Where a member is required to attend any Court, and
(i) Is expected to attend before 12 noon and
(ii) isn’t released until 2 p.m. or later and
(iii) is then required to complete a night shift, the member is entitled to seven (7) hours rest, without loss of pay, between the completion/release of Court and the time the member was scheduled to report for duty without moving the start time to a later time.
(e) Where a member is notified to be on stand-by with respect to a Court appearance or attendance at any other hearing the member shall be paid stand-by pay in accordance with the provisions of Article 3.9.
(f) Where a retired or terminated member is required to attend Court or any other hearing as a result of police duties, the member shall be entitled to the same benefits under this Article as the member would have been entitled to receive on the date the member retired or terminated.
7.2 A member is required to file, in the month of December in each year, an election with the Chief of Police as to whether the member will accept time off or cash in payment of the member's accumulated hourly credits for the succeeding year for Court attendance.
7.3 Where a member elects to accept
(a) cash pursuant to Article 7.2 the cash credits, if any, as accumulated are to be paid quarterly in the subsequent month.
(b) time off pursuant to Article 7.2, such time off is to be allowed at the discretion of the member.
OFF DUTY COURT ATTENDANCE. SECTION 1. In the event that Court attendance may be required while off duty, employees shall be compensated for a minimum of three (3) hours for the first court appearance in any given calendar day, subject to the provisions set forth in Section 3 below. All hours of compensation for court appearances will count toward the build up of hours worked for overtime purposes, as defined in Article 16, Section 3. The City shall provide a vehicle when available.
SECTION 2. All personnel shall be required to personally report their court time, as determined by the Chief of Police, detailing their start time and ending time. This information is to be reported at the beginning of the first tour of duty following the court appearance.
OFF DUTY COURT ATTENDANCE. (a) It shall be the duty of the member to notify the Court Clerk of his vacation period not less than seven (7) days prior to the beginning of such vacation period, unless in cases of extreme emergency.
(b) No member shall change his regularly scheduled shift or leave days, nor shall any member assume the duties of another in order to take advantage of premium pay for any court duties.
(c) No member reporting for court for an off-duty court appearance shall be required to perform any duties after he has testified to fulfill the six (6) hours paid, except in the event the defendant is remanded to custody, the member when necessary shall be required to register (book) the prisoner.
(d) Officers required to attend local District Courts when off duty or after regular working hours may attend court in a uniform or suit coat and tie (provided this is approved by the presiding judge).
(e) For any off-duty court appearance, each member shall receive time and one half (1-l/2) pay for all time required to be spent, with a minimum of four (4) hours pay at the base rate, except as provided in Section 2, hereof.
(f) If a member has out of city court which causes a shift shortage of command, overtime will be offered to fill the shortage. If the shortage is not filled, the junior most eligible member of the off going shift shall be ordered to work for no more than four hours. In the event, a mid-night command officer has court, which prevents them from ascertaining eight

(1) In this Article, "Court" or "Courts" shall mean ALL courts of Law and shall include a Criminal Injury Compensation Board Hearing, Public Inquiries Act Hearing, Coroner's Inquest, a Police Act Trial and any other Tribunals or Public Board Hearings constituted under law of Canada or Ontario, or any by-law of the Woodstock Police Service jurisdiction. This is in relation to a Member's duty as a Police Officer. Court time in this Article shall mean any time spent by a Member of the Police Service as a witness in court as herein defined.

(1) In this Article, "Court" or "Courts" shall mean ALL courts of Law and shall include a Workplace Safety and Insurance Board Hearing, a Criminal Injury Compensation Board Hearing, Public Inquiries Act Hearing, Coroner's Inquest, a Police Act Trial and any other Tribunals or Public Board Hearings constituted under law of Canada or Ontario, or any by-law of the Woodstock Police Service jurisdiction. This is in relation to a Member's duty as a Police Officer. Court time in this Article shall mean any time spent by a Member of the Police Service as a witness in court as herein defined.
OFF DUTY COURT ATTENDANCE. A. Court attendance is an integral part of police work, and the parties agree that employees required to attend court in the performance of their duties should be fairly compensated.
B. An employee required to attend court or a court related hearing, such as a deposition, for purposes directly related to the performance of his duties as an employee during scheduled off-duty hours shall be compensated two hours of pay for all appearances commending during the two hourtwo-hour period, provided that the start of the two- hour period is more than sixty minutes prior to his regularly scheduled check-on time or more than sixty minutes after his regularly scheduled check-off time.
1. Multiple appearances commencing during the two-hour period shall be paid on the basis of a single, two-hour guarantee.
2. The employee will be compensated from the time the first appearance begins until two hours later or when released by property judicial authority if the release extends past the two-hour period.
3. An employee required to attend any court appearance starting within the two- hour period and extending beyond this period shall be paid for the two hours plus all time spend beyond the two hours until released.
4. An employee attending court or a judicial hearing sixty minutes or less prior to his regularly scheduled check-on time will be considered “on duty” for purposes of this section. Likewise, and employee attending court or a judicial hearing within sixty minutes after his regularly scheduled check-off time willbe considered “on duty” until released by the proper judicial authority.
5. All hours indicated in this section shall be counted toward the computation of overtime.
C. In the event that an employee is required to be on off-duty court standby, he shall be paid two hours of base, straight-time pay for each day of off-duty court standby. It shall be the responsibility of the employee to check in with the court liaison officer, leaving a number where he may be reached.
OFF DUTY COURT ATTENDANCE. All off-duty court appearances shall be compensated at a minimum of three (3) hours at the member's regular rate of pay in accordance with the provisions of Article 17, except for overtime equalization which shall not apply to this section.
OFF DUTY COURT ATTENDANCE. Where a Member is required to attend at Court during off-duty hours, the Member
(a) (i) is to be paid one and one-half (l-1/2) times the Member’s normal salary rate with a minimum payment, for an attendance of less than four (4) hours, equal to four (4) hours at the Member’s normal salary rate, and effective 1 January 1992 is to be paid a minimum of 4.5 hours or time and one-half (l-1/2) whichever is the greatest, and effective l January 1993 shall receive a minimum of 5 hours or time and one-half (l-1/2) whichever is the greatest, and Where a Member is required to attend Court immediately after working any regular shift that finishes after midnight is to receive a minimum of four (4) hours or time and one-half (l-1/2), whichever is the greatest, plus two (2) hours, and effective 1 January 1992 is to be paid a minimum of 4.5 hours or time and one-half (l-1/2) whichever is the greatest, plus two (2) hours, and effective 1 January 1993 shall receive a minimum of 5 hours or time and one-half (l-l/2) whichever is the greatest, plus two hours, and
