Operating Days and Hours. It is in the interests of both Tenant and Landlord to have regulated hours of business for all of the Shopping Center. Commencing with the opening for business by Tenant in the Premises and for the remainder of the Lease Term, Tenant shall be open for business daily and shall continuously remain open for business with its window displays, exterior signs, and exterior advertising displays adequately illuminated during all hours on all days on which Landlord, in its sole and absolute discretion, determines to open the Shopping Center for business to the public and which hours may, in Landlord's sole and absolute discretion, be unique and extended to provide for optimum sales generation. If the Shopping Center contains Common Area which is enclosed for the purpose of providing climatic control, Landlord shall not be obligated to open the enclosed area so that Tenant may conduct business except on those days and hours when tenants in the Shopping Center occupying at least fifty percent (50%) of the Floor Area thereof shall have given reasonable advance notice to Landlord that they desire to be open for business during such time. Notwithstanding anything to the contrary contained in this Lease, in no event shall Tenant be required to open for business on any day earlier than 10:00 a.m. or later than Midnight, or on Christmas Day or Thanksgiving Day, unless at least fifty percent (50%) of the other Shopping Center Tenants are open during such period(s). Tenant shall be permitted to be closed two (2) days per calendar year (on a non-cumulative basis) for the purpose of taking inventory. Tenant shall provide written notice to the Shopping Center General Manager at least ten (10) days prior to the date of closing and shall display appropriate signage advising its customers of such closure. In no event shall Tenant be permitted to close for inventory during the period in any calendar year commencing November 1st and ending December 31st.

Operating Days and Hours. Subject to the limitations set forth in Section 11.1 above, recognizing that it is in the interests of both Tenant and Landlord to have regulated hours of business for all of the Project, Tenant shall, commencing with the opening for business by Tenant in the Premises and for the remainder of the Lease Term, be open for business continuously with its window displays, exterior signs and exterior advertising displays adequately illuminated during all hours on all days on which Landlord, in its sole discretion, determines to open the Project for business to the public. In that connection, Tenant acknowledges and agrees that Project hours may change seasonally, and that due to regulatory requirements, hours may vary for patrons depending on patron age. If Tenant shall open late, close early or fails to be open at any time in violation of this Lease without the express written consent of Landlord, which consent Landlord may grant or withhold in its sole discretion, Landlord may assess Tenant, and Tenant shall pay the amount so assessed as Additional Rent, at the rate of Two Hundred Dollars ($200.00) per full or partial hour of Tenant's unauthorized closure; provided, however, Tenant shall not be required to pay the amount assessed to Tenant if Tenant's failure to open or to stay open resulted from a Force Majeure event. It is agreed, however, that the foregoing provisions shall be subject to the hours of operation prescribed by any governmental regulations or labor union contracts which may govern the operation or business of Landlord or Tenant.
Operating Days and Hours. Xxxxxx agrees to be open for business and to operate all of the Premises continuously throughout the Term, and Xxxxxx further agrees to fully utilize the Premises for its business at this location and to keep and maintain upon the Premises competent personnel and an adequate stock of merchandise and trade fixtures to service and supply the usual and ordinary demands and requirements of its customers. Tenant acknowledges and agrees that, in addition to other reasons Landlord is requiring Tenant to agree to the provisions of this Article: (a) that Tenant being open for business in turn helps increase the amount of business being done by other tenants in the Project and (b) that a closed store has a detrimental effect on the Project and the business of other tenants in the Project. Accordingly, should Tenant fail to operate its business as required by this Article, the Base Rent shall be increased by an amount equal to fifteen percent (15%) of the Base Rent otherwise payable hereunder during the time period that the Tenant shall fail to conduct its business as herein provided. In the event Tenant fails to open for business later than the expiration of the Fixturization Period after Landlord tenders possession of the Premises to Tenant and this Lease grants Tenant any rights of abatement or reduction of Base Rent during the initial months of the Lease Term, Tenant shall pay Base Rent of one hundred fifteen percent (115%) of the Base Rent payable after the expiration of the abatement or reduction commencing upon the Commencement Date through the date Tenant opens for business fully stocked and staffed. Operating Days and Hours. Except as may otherwise be mutually agreed in writing by the parties hereto and absent any technical difficulties on the part of UNISTAR, the games will be conducted at the Reservation Operation Center; twenty-four (24) hours per day, seven (7) days per week, three hundred and sixty five (365) days per year. In addition, lottery drawings shall be conducted at a time mutually agreed upon by CDA and UNISTAR.
