Portability of Leave. 34.1 Where an ongoing APS employee moves (including on promotion or for an agreed period) from another agency, the employee’s unused accrued annual leave and personal/carer’s leave (however described) will be transferred, provided there is no break in continuity of service. 34.2 Where an employee is engaged as either an ongoing or non-ongoing APS employee immediately following a period of ongoing employment under the Parliamentary Service Act 1999 or the ACT Government Service, the employee’s unused accrued annual leave and personal/carer’s leave (however described) will be recognised unless the employee received payment in lieu of those entitlements on termination of employment. 34.3 Where a person is engaged as an ongoing employee, and immediately prior to the engagement the person was employed as a non-ongoing APS employee, the CEO, at the employee’s request, may recognise any unused accrued annual leave and personal/carer’s leave (however described), provided there is no break in continuity of service. Any recognised annual leave excludes any accrued leave paid out on separation.

Portability of Leave. Where an employee moves into the Commission from another APS agency where they were an ongoing employee, the employee’s unused accrued annual leave and personal/carer’s leave will be transferred, provided there is no break in continuity of service. Where an employee is engaged as an ongoing employee in the Commission, and immediately prior to the engagement the person was employed by a Commonwealth Government entity (other than in the Parliamentary Services which are covered in clause 6.3), the Commissioner will recognise any unused accrued personal/carer’s leave at the employee’s request. The Commissioner will advise the employee of their ability to make this request. Where an employee is engaged as an ongoing employee in the Commission, and immediately prior to the engagement the person was employed by a State or Territory Government, the Commissioner may recognise any unused accrued personal/carer’s leave, provided there is not a break in continuity of service. For the purposes of clauses 6.2 to 6.7, an employee with a break in service of less than 2 months is considered to have continuity of service.

Any recognised recreation leave excludes any accrued leave paid out on separation.
Portability of Leave. 52.1 Employees, other than casual employees, who are: (a) employed by a non-corporate Commonwealth entity as defined in section 11 of the Public Governance, Performance and Accountability Act 2013; and (b) granted leave without pay from that employer (the former employer) to undertake MOP(S) Act employment, will have all their accrued leave credits recognised. 52.2 An employee’s entitlement to the accrued leave credits specified in clause 52.1 and to any future leave entitlements will be in accordance with this Agreement. 52.3 On an employee’s return to the former employer at the cessation of MOP(S) Act employment, the employee’s accrued leave entitlements will be transferred to the former employer and will not be paid in lieu. 52.4 Further information can be found in the Guideline ‘Recognition of prior service’.

Where a person is engaged as an ongoing employee, and immediately prior to the engagement the person was employed as a non-ongoing APS employee, the Secretary may, at the employee’s request, recognise any accrued annual leave and personal/carers leave (however described), provided there is no break in continuity of service. Any recognised annual leave excludes any accrued leave paid out on separation. UNAUTHORISED ABSENCE Where an employee is absent for any period without approval, the absence will be unpaid and will not count as service for any purpose.
Portability of Leave. 46.1 Where an employee is engaged as either a continuing or temporary employee immediately following a period of ongoing or non-ongoing employment in: (a) a statutory agency under the Public Service Act 1999 employing under their enabling Act; or (b) the Parliamentary Service under the Parliamentary Services Act 1999; or (c) the ACT Government Service; or (d) any Commonwealth agency under the Public Governance Performance and Accountability Act 2013 the Chief Executive Officer may recognise the employee’s unused accrued Annual Leave or part thereof or, Personal/Carer’s Leave (however described). If it is agreed that Annual Leave can be recognised, this will be on the basis that funds are transferred by the previous employer. 46.2 Where an employee is engaged as either a continuing or temporary employee following a period of ongoing or non-ongoing employment: (a) in any of the categories described in Clause 46.1; and (b) there has been a break in the employee’s continuity of service of not more than two calendar months, then, the Chief Executive Officer may recognise the employee’s unused Personal/Xxxxx’s leave (however described). 46.3 IBA will recognise an employee’s prior service for Long Service Leave purposes in accordance with the Long Service Leave (Commonwealth Employees) Act 1976.
