The Prohibition Against Strikes clause serves to explicitly forbid employees from engaging in strikes, work stoppages, or other forms of collective work disruption during the term of the agreement. Typically, this clause applies to all employees covered by the contract and may also extend to actions such as slowdowns or sympathy strikes. Its core practical function is to ensure uninterrupted business operations and labor peace by preventing disruptions that could arise from organized work actions.
PROHIBITION AGAINST STRIKES. No firefighter employee, employee union, association or organization shall strike, slow down, sick out, or engage in such concerted activity against the District: Disputes unresolved by negotiation shall be resolved by the impasse dispute resolution procedures set forth herein. Any such employee who fails to report for work without good cause during negotiations or who aids, abets, or encourages strikes, slow downs or sick outs against the District during such time shall be subject to disciplinary action, including, but not limited to, termination from employment with the District, subject to the provisions of this impasse dispute resolution procedure, the District’s Personnel Rules and Regulations, and any other applicable lawful procedures.
PROHIBITION AGAINST STRIKES. Neither the Union nor the employees it represents shall engage in any strikes against the County, nor shall the Union cause, instigate, encourage or condone such a strike. Resolution of all disputes arising from the employer-employee relationship between the County and the Union shall be resolved in accordance with the provisions of this Agreement and the ▇▇▇▇▇▇ Law of the State of New York.
PROHIBITION AGAINST STRIKES. There shall not be any strike action or other concerted withholding of services of any type engaged in by the Union or any of the employees in this bargaining unit against the District, nor shall any such action be encouraged by the Union. There shall be no lockout by the District against the Union. The Union will take all affirmative steps necessary to constitute a good faith effort to discourage, prevent, and terminate any strike action or other concerted withholding or services of any type against the District by any of its members.
PROHIBITION AGAINST STRIKES. A. The parties recognize that strikes (as defined by P.A. 336 of 1947, as amended, of Michigan Public Employees Relations Act) are contrary to law and public policy. The employer and the employees subscribe to the principle that differences should be resolved by good faith bargaining in keeping with the highest standards of municipal government without interruption of essential governmental services. Accordingly, the Union agrees that during the term of this Agreement, it shall not direct, instigate, participate in, encourage, or support any such strike or any interference with the operation of the School District.
B. In the event of any action and/or violation of this paragraph, the Union shall take such action which it deems reasonable and appropriate to bring about compliance with the terms of this Article.
C. No lockout of employees shall be instituted by the Board during the term of this Agreement.
PROHIBITION AGAINST STRIKES. There shall not be any strike action of any type engaged in, or encouraged, by the Union against the District. The Union will take affirmative steps to discourage and prevent strike action against the District by its members.
PROHIBITION AGAINST STRIKES. Section 1 A strike shall be defined as: the concerted failure to report for duty, the concerted stoppage of work, the concerted submissions of resignations, the concerted abstinence in whole or in part by any group of employees from the full and faithful performance of their duties of employment with the City or participation in a deliberate and concerted course of conduct which adversely affects the service of the City.
Section 2 Neither the Union, nor any of its officers or agents, or members covered by this Agreement, nor any other employees covered by this Agreement, will instigate, promote, sponsor, or engage in any strike, sympathy strike, slowdown, concerted stoppage of work or any other activity which prohibits an Employee from reporting for duty.
Section 3 The Union agrees not to picket over any matter subject to the grievance procedure provided herein. This does not restrict the Union's right to picket for other purposes so long as the same does not lead to a cessation of work by any bargaining unit members.
Section 4 Should the Union or a majority of the Union employees covered hereunder with the City's Fire Rescue Department breach this Article, the Employer may then proceed against the Union as provided in State Statutes.
PROHIBITION AGAINST STRIKES. There shall be no strikes or concerted activity in violation of the Municipal Code and Ordinances set forth by present Brick Township Authorities.
PROHIBITION AGAINST STRIKES. 3.01 Employees under this contract shall comply with the conditions set forth in Chapter 150E, Section 9A of the General Laws of the Commonwealth. ARTICLE IV NONDISCRIMINATION CLAUSE
4.01 In accordance with applicable federal and state laws, the Employer and the Northampton Association of School Employees, Unit H, agree not to discriminate against any Employee covered by this Agreement on the basis of age, gender, race, religion, color, creed, handicap, sexual orientation, national origin, gender identity, place of birth, residence, or marital status.
4.02 The Sexual Harassment Policy and Grievance procedure applicable to employees covered by this Agreement is on file in Human Resources.
4.03 The Association agrees it will not discriminate against persons covered by this Agreement on account of non-membership in the Association.
PROHIBITION AGAINST STRIKES. The Union and the Board recognize that strikes and all other forms of work stoppages by the employees covered by this Agreement are contrary to law and public policy. The Union and the Board subscribe to the principle that differences shall be resolved by peaceful, appropriate means without interruption of the school program. The Union on behalf of itself and its members therefore agree that there shall be no strikes, work stoppage, or any other refusal to perform work by employees covered by this Agreement, nor shall the Union in any way encourage, instigate or condone the same.
PROHIBITION AGAINST STRIKES. The Union affirms that it does not assert the right to strike against the Employer and agrees that it will not assist or participate in any such strikes or impose upon any of its members or others, an obligation to conduct, assist or participate in such a strike.
