RETURN TO PREVIOUS POSITION. A promoted employee who is dismissed during his probationary period, except if the cause warrants action to dismiss him from the District service, shall return to the position in which he held permanent status, if vacant, or any other vacant position in his former classification unless all positions in that classification are filled. The employee so dismissed may write a letter for inclusion in his permanent personnel file. Upon a return to his former position in the same agency or department, the employee shall not serve a new probationary period. In the absence of such vacancy in the agency or department in which he held permanent status, the dismissed probationary employee may either:

An employee promoted within the Sheriff’s Department to Sr. Deputy Sheriff (01057), Sheriff's Sergeant (01785), or Sheriff's Captain (01698) or an employee promoted within the District Attorney's Office to the position of D. Investigator (01600) who is dismissed from the classification into which the employee was promoted during the employee’s probationary period, except if the cause warrants action to dismiss the employee from the County Service, shall return to a position in the employee’s former classification. RETURN TO PREVIOUS POSITION. This language applies only to bids awarded as a transfer or voluntary demotions. If the employee who was awarded the bid for the vacant position changes his/her mind and desires to return to their original position, they have up to seven (7) work days from the effective date of the job change to notify the Director of the Shawnee County Health Department in writing. Upon notification, the Director of the Health Department will return the employee to their original position without loss of seniority, and award the bid to the next senior person bidding from the current list. During this seven (7) work day trial period the employer may also return the employee to their original position without loss of seniority, with the approval of the Director of Human Resources. If the employer is returning the employee to his/her original position, the employee will notify the Union the reason for the return. After seven (7) days the new position is permanent. An employee may request a return to a previous position only once during a payroll year.

A teacher transferred involuntarily to a position within the two-year period (24 months) before the posting of the same position held just prior to the involuntary transfer will return to the same position (i.e. assignment, grade level) they held prior to the involuntary transfer if they elect to do so.

An employee promoted from a Probation Unit classification to another, higher-level Probation Unit classification who is dismissed from the higher-level classification during his/her probationary period shall, except if the cause warrants action to dismiss him from the County Service, return to a position in the lower- level, probation unit classification in which s/he held permanent (non-probationary) status. Upon return to his/her former classification the employee shall not serve a new probationary period. The employee so dismissed may write a letter for inclusion in his/her permanent personnel file.
RETURN TO PREVIOUS POSITION. An employee who has posted into a new position, may return to his or her previous position during the probationary period provided that the previous position has not been filled. A position is considered filled when a job offer has been accepted.
