Section 10.9.3. An employee laid off who rejects an offer of reemployment forfeits seniority; provided, that 3 such employee is offered a position substantially equal in wages, hours and benefits to that held 4 prior to layoff.
Section 10.9.3. An employee shall forfeit rights to reemployment as provided in Section 10.9.1 if the employee 17 does not comply with the requirements of Section 10.9.2, or if the employee does not respond to 18 the offer of reemployment within fifteen (15) workdays.
Section 10.9.3. 45 All accrued benefits to which an employee was entitled at the time of layoff, including unused 46 accumulated sick leave, seniority, and longevity, will be restored to the employee upon return 47 to employment within one (1) year from the date of layoff. Section 10.9.3. 43 When an employee receives a subpoena for civic duty, e.g., uninvolved witness of an accident 44 or crime, the employee shall notify Food Service Management. For civic duty/subpoena leave, 45 the employee shall receive full pay.
Section 10.9.3. An employee shall forfeit rights to reemployment as provided in Section 10.8, if the employee 29 does not accept the offer of reemployment within five (5) workdays and/or report for work 30 within eleven (11) workdays from date of offer.

Section 10.9.3. 22 When a position is posted in the District, out of classification personnel may apply at the same 23 time as in classification personnel. In-District applications will be forwarded on to the site 24 hiring team and granted an interview. In-District employees will be considered for open or new 25 positions prior to hiring an out of District employee.
Section 10.9.3. 23 Employees on layoff status shall file their addresses in writing with the personnel office of the 24 District and shall thereafter promptly advise the District in writing of any change of address.
Section 10.9.3. 36 The District shall offer additional duty time that becomes available to employees within the 37 building in the same general job classification on a seniority basis, if the time fits into the 38 employee’s current schedule.
Section 10.9.3. 6 When offering positions to employees who have been notified their position is being eliminated 7 or being bumped by another employee, the order of offers shall be as follows:
9 Step 1 Comparable open position(s) for which the employee is qualified;
11 Step 2 When no comparable open position exists, employees shall be placed in a comparable 12 position held by a lesser senior employee in the same or lower level according to 13 procedures jointly agreed to by the Association and the District;
14 Step 3 If no comparable position is identified in Step 2 above, then the employee shall have the 15 option of being placed into a position that is closest in comparability to the one 16 previously held according to procedures jointly agreed to by the Association and the 17 District. 18 19 Affected employees shall not be allowed to move into a higher pay grade. 21 • Comparable positions shall mean positions which represent a gain or loss of no more 22 than five hundred dollars ($500) in annual compensation, wage related benefits or 24 duties and responsibilities.
