The SICKNESS & ACCIDENT clause defines the rights and obligations of parties when an individual covered by the agreement is unable to perform their duties due to illness or injury. SICKNESS & ACCIDENT. 9.1 Payment will be based on twelve straight time hours per normal shift missed to a maximum of thirty seven and one-half (37.5) hours per week (the week beginning Sunday at 5:30 a.m.). If an employee is absent for a complete pay period (fourteen (14) consecutive days beginning and ending at 5:30 a.m. Sunday), the employee will receive thirty seven and one-half (37.5) hours per week at straight time. The payment schedule is outlined in Article 12.3 of the Collective Agreement.
SICKNESS & ACCIDENT. 9.1 Without prejudice to the following provisions of this Clause 9 or of Clause 2.1 if the Executive becomes incapable of carrying out his duties hereunder because of illness or other incapacity he shall on the production of a medical certificate or other evidence satisfactory to the Board (the Board reserving the right to require the Executive to be examined by a doctor nominated by the Board) be entitled to receive:
9.1.1 the Executive's salary at the rate determined pursuant to Clause 4 (inclusive of any sickness benefit statutory sick pay or allowance or other injury or disablement benefit to which the Executive may be entitled whether or not claimed) during a continuous period or an aggregate of three months in any period of 12 months;
SICKNESS & ACCIDENT. To current EI Benefit level for a period of six (6) months after third (3rd) day of sickness.
SICKNESS & ACCIDENT. Any employee will be granted a sick or accident leave by the Company upon the basis of the facts and (1) the presentation of a statement from the treating physician certifying that the employee is unable to work on the specific days at issue, or (2) the presentation of a certificate from a doctor designated by the Company satisfactorily stating adequate medical reason necessitating the employee’s absence from work. Any grievance filed under this Section may be filed directly at STEP THREE.
SICKNESS & ACCIDENT. 5.1 If the Employee is prevented from work due to sickness or accident, he shall inform the Employer without delay and at the Employer's request submit within three days a medical certificate.
5.2 In case the Employee is prevented from work for a longer period of time than stated in the medical certificate, he shall so inform the Employer and at the Employer's request submit another medical certificate. The Employer shall be entitled to demand a physical exam by a medical referee.
SICKNESS & ACCIDENT. The Company will provide a sickness and accident plan. This plan is described in the summary plan description entitled “Sickness and Accident Plan.” Eligibility for Plan membership is contained in the Plan provisions outlined in the applicable SPD. The current weekly benefit amount is equal to 50% of the permanent rate times 40 hours; based on 7-day work week with a minimum benefit amount of $260 for illnesses and injuries. Effective July 1, 2024, the current weekly benefit amount is equal to 60% of the permanent rate times 40 hours; based on 7-day work week with a minimum benefit amount of $425 for illnesses and injuries.
SICKNESS & ACCIDENT. In the event that an employee is unable to work due to or accident (excepting accidents occurring during perf of regular duties for which Workers' coverage is provided) he shall be reinstated at such time as he is able to resume hie normal duties. The Company shall, however, at any time be entitled have an employee absent because of illness or accident examined at ita own expense. The Company doctor shall endeavour to consult with the employee's personal doctor as to whether or not the employee is able Except in cases where an appointment was scheduled and the employee failed to report, no employee who has completed his probationary period shall be requested to take a physical examination by the Company on his day off or after regular working hours. This, however, employee will be paid percent of his regular wages at store level for time during which he is absent from work due to his illness renders him unable to work. Such payment is limited to a maximum of three days for one absence. SICKNESS & ACCIDENT. In the event that the employee is unable to ------------------- perform the full-time duties of his employment by reason of accident or sickness, and has used all of his accumulated sick days and personal days, the Company shall continue to pay the Employee his full compensation herein during such period of his disability, not to exceed, however, one hundred eighty (180) days from the commencement of such disability. Successive periods of disability of the Employee's failure to perform his full-time duties on account of accident or sickness shall be considered separate periods. Notwithstanding anything in this paragraph to the contrary, the Company shall deduct from the amount otherwise payable hereunder that amount which becomes payable to the Employee pursuant to any disability income insurance contract, the premiums for which have been paid by the Company.
