SICKNESS BENEFIT. 11.1 In the event of the Executive being absent from work due to sickness or injury, the Company will continue to pay his normal salary (inclusive of any Statutory Sick Pay to which he may be entitled) for a period of up to 12 weeks during any rolling period of 12 months (“Company Sick Pay”). Thereafter, the payment of any further sick pay will be at the discretion of the Company and subject to the Company’s Sick Pay Policy from time to time. Company Sick Pay will be based on the Executive’s normal salary less any State benefits claimable by the Executive on account of his sickness or injury, less normal deductions. The Executive’s entitlement to Company Sick Pay is subject to his compliance with the sickness notification requirements set out in the Company’s HR Policies and Procedures on Interact.
11.2 Irrespective of Clause 11.1 above, the Executive will receive Statutory Sick Pay (“SSP”) when the Executive qualifies for it, although where Company Sick Pay and Statutory Sick Pay are payable for the same day of sickness absence, the Executive will receive the higher of the two sums. Further details on Statutory Sick Pay are set out in the Company’s HR Policies and Procedures on Interact.
11.3 The Company reserves the right to require the Executive to undergo a medical examination by a doctor or consultant nominated by it, in which event the Company will bear the cost thereof. The Executive shall authorise the doctor to disclose to and discuss with the Board (and, in the first instance, the Chairman) the results of the examination. The Executive acknowledges that the Company will process his personal data and special categories of personal data disclosed by the doctor in accordance with the Company’s UK Employee Privacy Notice.
11.4 The Executive’s entitlement to Company Sick Pay is subject to the Company’s right to terminate the Employment in accordance with this Agreement.
11.5 If the illness, accident or other incapacity shall be, or appear to be, caused by actionable negligence of a third party in respect of which damages are or may be recoverable, the Executive shall immediately notify the Board of that fact and of any claim, compromise, settlement or judgment made or awarded in connection with it. SICKNESS BENEFIT. 11.1. The Employee has the right to receive sickness and temporary disability benefits in accordance with the Employee’s Employment Contract. The basis for the payment of sickness and temporary disability benefits shall be the sheets of temporary disability issued and executed in the manner determined by the authorized body of the Republic of Kazakhstan on health care.
11.2. Sickness and temporary disability benefits are paid to employees from the first day of disability until the day of vocational rehabilitation or until disability is established in accordance with the legislation of the Republic of Kazakhstan for the working days when the Employee is absent from the workplace.
11.3. Sickness and temporary disability benefits shall not be paid:
1) to an employee whose temporary disability has occurred as a result of workplace injuries, sustained in the commitment of a criminal offense, in the event of the determination of guilt by a court decision that has entered into legal force;
2) during the compulsory medical treatment of an employee on the basis of a court determination (except for the mentally disabled);
3) during the time the employee is under arrest and during the forensic medical investigation in the event that his guilt has been determined by a court verdict or decision that has entered into legal force;
4) in case of temporary disability of the employee from diseases or workplace injuries resulting from the use of alcohol, narcotic drugs, psychotropic substances, their analogues and precursors;
5) for days of disease and temporary disability which fall on paid annual leave;
6) for days of temporary disability which fall on leave without pay;
11.4. The amounts of sickness and temporary disability benefits shall be determined by the Government of the Republic of Kazakhstan, the procedure for the appointment and payment - by the authorized state body on labour.
11.5. If the Employee is on sick leave continuously for more than 60 days during any 12-month period, the Company has the right to immediately terminate the Employment Contract with the Employee by notifying the Employee in writing.
SICKNESS BENEFIT. (1) Where a person has, since his last arrival in the territory of one Party, completed a contribution period under the legislation of that Party, then for the purpose of any claim to sickness benefit made under the legislation of that Party, any insurance period completed under the legislation of the other Party shall be treated in accordance with Article 11 as if it were an insurance period completed under the legislation of the former Party.
(2) Where a person is employed in the territory of one Party and the legislation of the other Party applies to him in accordance with any of the provisions of Articles 5 to 10, he shall be treated under that legislation for the purpose of any claim to sickness benefit as if he were in the territory of the latter Party.
(3) Subject to paragraphs (5) and (6) and Article 32, where a person would be entitled to receive sickness benefit under the legislation of the United Kingdom if he were in the territory of that Party, he shall be entitled to receive that sickness benefit while he is in Malta if:
(a) his condition necessitates immediate treatment during a stay in Malta and, within six days of commencement of incapacity for work or such longer period as the competent authority may allow, he submits to the competent authority of the United Kingdom a claim to benefit and documentary evidence of incapacity for work issued by the doctor treating him; or
(b) having claimed and become entitled to sickness benefit under the legislation of the United Kingdom, he is authorised by the competent authority of that Party to return to Malta where he resides, or to transfer his residence to Malta; or
(c) having claimed and become entitled to sickness benefit under the legislation of the United Kingdom, he is authorised by the competent authority of that Party to go to Malta to receive there treatment for his condition. The authorisation required in accordance with sub-paragraph (b) may be refused only if it is established that movement of the person concerned would be prejudicial to his state of health or the receipt of medical treatment.
(4) Subject to paragraph (5) and Article 32, where a person would, if he were in Great Britain or Northern Ireland, be entitled to statutory sick pay under the legislation of Great Britain or Northern Ireland, he shall, provided that he satisfies all the conditions for entitlement to, and payment of, sickness benefit under the legislation of Great Britain or Northern Ireland, with the exception of a...
SICKNESS BENEFIT. 11.1 The Employee has the right to receive sickness and temporary disability benefits in accordance with the Employee’s Employment Contract. SICKNESS BENEFIT. 10.1 The Company shall continue to pay the Employee's salary during any period of absence on medical grounds up to a maximum of 26 weeks in any rolling period of 12 months, provided that the Employee shall from time to time if required:
(a) supply the Company with medical certificates covering any period of sickness or incapacity exceeding seven days (including weekends); and
(b) undergo at the Company's expense a medical examination by a doctor appointed by the Company.
10.2 Payment of the Employee's salary pursuant to clause 10.1 shall be inclusive of any Statutory Sick Pay to which the Employee may be entitled under the legislation and regulations in force from time to time.
10.3 If the Employee's absence shall be occasioned by the actionable negligence of a third party in respect of which damages are recoverable, then all sums paid by the Company shall constitute loans to the Employee, who shall:
(a) forthwith notify the Company of the relevant circumstances and of any claim, compromise, settlement or judgment made or awarded in connection therewith;
(b) give to the Company such information concerning the above matters as the Company may reasonably require; and
(c) if the Company so requires, refund to the Company such sum (not exceeding the lesser of:
(i) the amount of damages recovered by him under such compromise, settlement or judgment; and
(ii) the sums advanced to him in respect of the period of incapacity) as the Company may determine.
SICKNESS BENEFIT. In the event of absence due to illness, the Company will pay sick pay to the Employee in accordance with the Swedish Sick Pay Act (Sw. lagen (1991:1047) om sjuklön) and in addition the following will apply: Additional Sick Pay: Income Bracket: 0-8 PBA ≥ 8 PBA Sick days 15 to 90: 10% 90% PBA: Price Base Amount (2022: 48,300 SEK) On successful completion of a medical examination the Employee’s Long Term Disability benefits will be 50% of his base salary that includes relief paid from your social security. SICKNESS BENEFIT. 10.1 The Executive shall be entitled to such sickness benefits as are provided from time to time under the Company’s sick pay procedure.
10.2 When calculating the Executive’s normal salary, deductions will be made for any State sickness or other benefits due to the Executive, as well as normal deductions for tax and National Insurance.
10.3 The Executive will be paid Statutory Sick Pay (“SSP”) when he is eligible to receive it under the legislation and regulations from time to time in force. Where Company sick pay and SSP fall to be paid for the same day(s) of absence, the Executive will receive the higher of the two sums. Further details about SSP can be obtained from the HR Department.
10.4 The Company reserves the right to require the Executive to undergo a medical examination by a doctor or consultant nominated by it, in which event the Company will bear the cost thereof.
10.5 Whilst, during the Employment, the Executive is absent from work on grounds of sickness or other medical incapacity:
10.5.1 he will continue to be covered by the relevant life assurance, private medical insurance and permanent health insurance scheme(s);
10.5.2 his entitlement to the use of the Company Car, the payment of the Company’s pension contributions, participation in any incentive or bonus scheme, and accrual of holiday entitlement shall cease on the expiry of the relevant period of Company sick pay entitlement referred to in Clause 10.1 above.
10.6 Any outstanding or prospective entitlement to any sickness benefit, including but not limited to Company sick pay, private medical insurance or long-term disability benefits, shall not prevent the Company from exercising its right to terminate the Employment in accordance with Clauses 2 or 18 hereof.
SICKNESS BENEFIT. 8.1 There is no contractual right to payment in respect of periods of absence due to sickness or incapacity, but such payments are at the discretion of the Company.
8.2 Any payment to the Executive pursuant to Clause 8.1 shall be deemed to include any Statutory Sick Pay and any Social Security Sickness Benefit or other benefits to which the Executive may be entitled.
8.3 If so required, the Executive agrees to supply the Company with medical certificates covering any period of sickness or incapacity exceeding seven days (including weekends) and to undergo, at the Company’s expense, a medical examination by a doctor appointed by the Company (and the Executive agrees that copies of any medical reports prepared by such doctor shall be sent directly to the Company).
SICKNESS BENEFIT. 8.1 In the event that you are prevented by illness, accident or other injury from properly performing your duties, subject to your compliance with this clause 8 and the Company’s approval, you shall be entitled to receive sickness benefits in accordance with the Company's Sickness & Absence Policy. This policy may be amended from time to time at the Company’s discretion. Any payments made under this clause will include any Statutory Sick Pay payable and when it is exhausted will be reduced by Social Security Sickness Benefit or other benefits recoverable by you (whether or not recovered). For the avoidance of doubt your right to receive Company sickness payments will not prejudice or in any way limit the Company’s right to terminate your employment pursuant to this Agreement.
8.2 You will notify the Company as soon as possible and at least by 10.00 am on the first day of your absence the fact of your absence and the reason and on each day thereafter. If the incapacity continues for a period of seven days or more, you will produce to the Company medical certificates for the duration of your absence.
8.3 Whether or not you are absent by reason of sickness, injury or other incapacity you will, at the request of the Company agree to have a medical examination by a doctor appointed and paid for by the Company and you authorise the Company to have unconditional access to any report or reports (including copies) produced as a result of any examination from time to time by the Company.
8.4 If you are incapable of performing your duties by reason of circumstances where you have a claim for compensation against a third party and you recover compensation for loss of earnings whether from a third party or otherwise, you shall repay a sum equal to the amount recovered, or if less, any amounts paid to you by the Company during your absence.
