STANDARD TOUR OF DUTY. The Fire Chief shall establish the actual number of hours, which comprises the standard tour of duty for each position. Normally, the standard tour of duty will be comprised of twenty-four (24) hours, which equates to one (1) shift. The Fire Chief may modify or change the number of hours in the standard tour of duty for each position to meet the needs of the service. When the Fire Chief finds it necessary to make such modifications or changes, the Fire Chief shall notify the affected employee(s) indicating the proposed change prior to its implementation. When such modification or change would affect the standard tour of duty of such employee(s), and when the Union requests to meet and confer, the parties shall expeditiously meet and confer regarding the impact the modification or change could have on employee(s). For purposes of disciplinary action as defined in the Personnel Rules for Board- governed Special Districts, Rule XI, Section 2, the work day for shift personnel shall be defined as twelve (12) hours.

The employee shall be present at the assigned work location and ready to begin work at the start of the standard tour of duty. The current standard tours of duty are the 9/80, 4/10 or 5/40. For payroll purposes, a regularly scheduled tour of duty, which commences before midnight and ends the following day, shall be reported as time worked for the day in which the tour of duty began. The Appointing Authority shall establish the actual number of hours, which comprises the standard tour of duty for each position. The Appointing Authority may modify or change the number of hours in a standard day, tour of duty or shift for each position to meet the needs of the service.

When the Fire Chief, or designee, finds it necessary to make such modifications or changes they shall notify the affected employee(s) and CWA indicating the proposed change prior to its implementation. When CWA requests to meet and confer, the parties shall expeditiously meet and confer regarding the impact the modification or change would have on the employees.

(A) Any employee who does not report to work at the start of their work shift and does not provide advance notice of his/her absence may not be compensated until they report for duty or receive authorization for their absence.

(B) CVPF members utilize the 48/96-shift schedule, which equals two (2) consecutive twenty-four (24) hour work shifts, or tours of duty, as defined above, and four (4) consecutive scheduled, off-duty days. Shift change will occur regularly at 0800 hrs.
(C) An employee who does not report to work at the start of their work shift and does not provide advance notice of his/her absence may not be compensated until they report for duty or receive authorization for their absence.

The written notification shall be submitted to the employee(s) at least fourteen (14) days prior to implementation unless the employee(s) consents to a lesser notification period or in the event of work urgency or emergency, as determined by the Appointing Authority. If the change affects a significant number of employees, CWA shall be notified. When CWA requests to meet and confer, the parties shall expeditiously meet and confer regarding the impact the modification or change would have on the significant number of employees. For the purposes of this Article, “significant number of employees” shall mean more than half of the employees in the bargaining unit.

If the City needs require it, employees will be offered, on a voluntary basis, staggered work hours and/or days. If no employees volunteer for such staggered work hours and/or days, employees may be assigned work outside their Standard Tour of Duty by inverse order of seniority, not to exceed one (1) work shift. When a Department Director finds it necessary to make modifications or changes in the time a standard tour of duty begins or ends or the actual number of hours in a tour of duty, the Department Director shall notify the affected employee(s) and MPNSA indicating the proposed change with seven (7) calendar days’ prior notice to its implementation. If MPNSA requests to meet and confer, it shall do so in writing to the Human Resources Director. The parties shall then expeditiously meet and confer regarding the impact the modification or change would have on employees. An employee or MPNSA may request the Department Director to change the times a standard tour of duty begins and ends or the actual number of hours in a standard tour of duty to meet the needs of the service.
