Substitution of public holidays by agreement. 50.4.1 The Employer and the Employees may agree to substitute another day for any prescribed in this clause. For this purpose, the consent of the majority of affected Employees shall constitute agreement.
50.4.2 An agreement pursuant to clause 50.4.1 shall be recorded in writing and be available to every affected Employee.
50.4.3 Employees rostered to work on public holidays and who fail to do so shall not be entitled to holiday pay for the said holiday.

32.3.2 The Employer and Employee may agree to substitute another part-day for a part-day that would otherwise be a part-day public holiday under the NES.
Substitution of public holidays by agreement. (a) By agreement between the MFBFRV and the majority of employees in the relevant workplace or section of the workplace, an alternative day may be taken as the public holiday in lieu of any of the prescribed days.
(b) The MFBFRV and individual employees may agree to the employee taking another day as the public holiday in lieu of the day which is being observed as the public holiday in the enterprise or relevant section of the enterprise.

50.4.4 If an Employee works on any of such holidays or such holiday occurs on his or her rostered day off he or she shall be paid at the ordinary time rate of pay for the time so worked, in addition to which he or she shall be entitled to receive:
a. within four weeks following the date on which such holiday occurred;
i. one and a half extra day's pay;
ii. one and a half days off in lieu thereof of which at least seven days' notice shall be given;
iii. one and a half days shall be added to his or her annual leave;
b. in the case of an Employee not qualifying for annual leave and where neither of the provisions of paragraph (a) above have been applied the one and a half days' pay shall be added to the payment in lieu of annual leave; and
c. one and a half times the ordinary time rate of pay for any work done in excess of eight hours.
50.4.5 In respect of Easter Saturday, an Employee who ordinarily works Monday to Friday only and who does not work on Easter Saturday, shall be entitled to one day's pay in respect of Easter Saturday or where there is mutual consent, within four weeks following the date on which such holiday occurred the Employee may take one day off in lieu or have one day added to their annual leave.
50.4.6 Notwithstanding the earlier provisions of this clause a Weekend Worker (as defined in clause 43.9) who works on any of the holidays set out in clause 50.1, shall be entitled (in lieu of any entitlement under clause 50.2) to one and a half extra days' pay on the first pay day following the end of the pay period during which the holiday falls.
50.4.7 If, at the end of the yearly period in respect of which his or her annual leave accrues such Weekend Worker does not become entitled to additional leave under
clause 43.10.1 he or she shall, at the option of the Employer, be entitled to one and a half extra days' pay or one and a half extra days' annual leave for each such holiday on which he or she was rostered off.

Substitution of public holidays by agreement. (a) EACH and an Employee may agree to substitute another day for a day that would otherwise be a public holiday under the NES or this Agreement.
(b) EACH and an Employee may agree to substitute another part-day for a part-day that would otherwise be a part-day public holiday under the NES or this Agreement.
(c) Where an agreement under sub-clause 75.10(a) or (b) is reached, it will be recorded in writing and a copy given to the Employee.
(d) If an Employee is then rostered or required by EACH to work on the day that has been substituted for the public holiday in accordance with sub-clause 75.10(a) or 75.10(b), the Employee will be paid for work on the substitute day in accordance with sub-clause 75.5(b).
Substitution of public holidays by agreement. (a) An alternative day may be taken by the employees in a work group as leave in lieu of a public holiday, where there is agreement between the majority of employees in that work group and their manager to take such an alternative day as leave in lieu.
(b) By agreement between an employee and an employee’s manager an alternative day may be taken by the employee as leave in lieu of a public holiday.

(c) Where in a State or Territory or locality within a State or Territory an additional public holiday is proclaimed or gazetted by the authority of the Commonwealth Government or of a State or Territory Government and such proclaimed or gazetted holiday is to be observed generally by persons throughout that State or Territory or locality thereof, other than persons covered by Federal awards, or where such a proclaimed or gazetted day is, by any required judicial or administrative order, to be so observed, then such day shall be deemed to be holiday for the purposes of this award for employees covered by this award who are employed in the State, Territory or locality in respect of which the holiday has been proclaimed or ordered as required.
