Payment in Lieu of Annual Leave. An employee may request payment in lieu of their annual leave credit subject to the following:
Payment in Lieu of Annual Leave. (a) In each 12 months of your employment, you may elect to forgo up to 2 weeks of your entitlement to annual leave in exchange for a payment in lieu of the annual leave equal to the amount you would have received had you taken the annual leave. (b) All requests for payment in lieu of annual leave must be made in writing to your manager and are subject to authorisation by the Employer. (c) Such payments in lieu of annual leave can only be made in accordance with the provisions set out in the Workplace Relations Act 1996.

This account will be referred to as a “pay-in-lieu bucket” (“PIL Bucket”) and will be kept separate from the employee’s annual leave accrual account or “annual leave bucket” (“AL Bucket”). The employee’s election must designate the amount of their his or her annual leave being earned each pay period which they he or she wishes to have credited to the PIL Bucket; this designation may be stated as an even percentage (e.g., 10%, 20%, 30%, 40%, etc.) of the leave earned during each pay period up to 100%.
