TEMPORARY SERVICE OUT OF RANK a. Any employee serving out of rank shall receive the pay of the employee for whom he or she is filling in, regardless of the number of pay increment applicable to that posi- tion, provided such service is for a period of one (1) full working day or longer. Service for part of a workday shall constitute service for the full working day so long as the vacancy existed at the beginning of the working day.
b. In any case where an employee who is serving temporarily out of rank is required to serve out of rank in a higher position, he or she shall be entitled to receive as pay the next highest departmental pay rate over his or her temporary pay rate after he or she has served in such higher position for a period of sixteen (16) working days.
c. For the purpose of this section, service out of rank shall not be deemed to have been broken by the employee who is temporarily serving out of rank having his or her regular days off.
d. In any case where an employee serving out of rank contracts an illness or suffers an injury in the performance of his or her duty he or she will continue to receive pay at the rate he or she is receiving while serving out of rank until such time as he or she is able to return to his or her normal duty. In the event an employee so disabled is subsequently placed on pension, his or her pension shall be based on the pay he or she was receiving while serving out of rank.
e. If any employee is killed in the line of duty while performing services out of rank, any benefit payments which may be due to his or her widow/widower, his or her estate or his or her next of kin shall be based upon the rate of pay of the rank in which said employee was performing services at the time of his or her death.
f. On all vehicles in the Rescue Division and the Fire Line, if a vacancy occurs above the rank of Lieutenant and the promotional list for the platoon is exhausted and the platoon is not below minimum staffing, the most senior person on the platoon shall fill the vacancy and be paid the compensation for the rank on which the vacancy oc- curred.
g. On vehicles in the Rescue Division, if a vacancy occurs in the rank of Lieutenant and the promotional list for the platoon is exhausted and the platoon is not below mini- mum staffing, the vacancy shall be filled by Either a private 1st class or Rescue Driver, either of whom must have at least two years in grade and must possess a minimum of an EMT-C license. TEMPORARY SERVICE OUT OF RANK. Employees of the bargaining unit who are ordered by the Chief of Police to serve temporarily in a higher rank for a period of two or more consecutive working days shall be compensated for the work at a minimum rate established for the higher rank. For the purposes of this paragraph, working days shall mean an eight (8) hour day or night tour of duty.
TEMPORARY SERVICE OUT OF RANK. A permanent full-time police officer who is assigned to temporary service in a higher rank shall, commencing with the fourth consecutive tour of duty in such higher rank, be paid for such service as if promoted to such higher rank.
TEMPORARY SERVICE OUT OF RANK. Members of the East Providence Police Department covered by this agreement up to and including the rank of Captain who are ordered to assume the responsibilities of a higher rank shall be compensated for this service at the same grade as the officer replaced.
TEMPORARY SERVICE OUT OF RANK. 1. At times, due to vacancies and leaves, and in a mutual effort to fulfill the obligation set forth under sections 61 and 63 the Local and the Town agree to allow firefighters that have successfully passed and placed on the Lieutenants promotional eligibility list, to act in place of a Lieutenant. During that time, the firefighter will be considered as “acting out of rank” and will be compensated at the rate of a Lieutenant. The mechanics of this shall be mutually worked out with the Chief and the Local through the fill-in procedures.
2. It is further agreed upon, that at any time, when a Lieutenant acts out of rank to fill a Captain position he/she will be considered as “acting out of rank” and will be compensated at the rate of pay for the position that he/she is said to be acting for. A vacancy that is less than four hours shall not create an “out-of-rank” differential.
3. When the need arises for a Captain to work out-of-rank as a Chief Officer, the parties agree that the mechanics of any such temporary assignment and compensation shall be mutually worked out with the Chief/Town Manager and the Local.
4. It is further understood, that with the mutual agreement of both parties, the Town may create one or more temporary daytime positions to facilitate trainings and instruction to new hires through a Training Academy or to instruct department trainings such as EMS refresher class. When the need arises for such a position(s), it is agreed upon that the Town will maintain the minimum staffing levels as set forth herein and the employee that has agreed to the voluntary assignment will be considered as “acting out of rank” and shall be compensated at the rate of pay that is one grade higher than that of what he/she is currently being compensated. The parties agree that there shall be no additional increase of pay to an employee’s rate of pay for this instance if an employee holds the rank of Captain or above. Upon the completion of the training academy or assignment, the employee will revert back to his/her normal rate of pay.
5. Any person acting out of rank shall only be compensated as out of rank for the specific shift that they are said to be acting for. If an employee works any shift other than that specific shift, they will be compensated at his/her regular rate of pay.
TEMPORARY SERVICE OUT OF RANK. Employees assigned and who perform in a higher classification than their own shall be compensated at the next highest step in pay in the classification to which they are assigned, from the start of the third shift.
TEMPORARY SERVICE OUT OF RANK. Members of the Police Department who are designated to assume the duties and responsibilities of a higher rank shall be compensated for this service at the same rate of pay as the person for whom they are filling in. Such higher rate shall apply for all the time spent in this position providing that a vacancy exists in that rank.
TEMPORARY SERVICE OUT OF RANK. Permanent Police Officers of the Jamestown Police Department who are required to assume the responsibilities of a higher rank shall be compensated for this service at the same rate of pay as the officer for whom they are filling in, providing such service is for a period of more than five
TEMPORARY SERVICE OUT OF RANK. Section A: Any employee covered by this agreement who is temporarily designated to assume the duties and responsibilities of a higher rank, shall receive pay of such order, until they are relieved of such responsibilities. Such rank will be designated by the Town Manager.
TEMPORARY SERVICE OUT OF RANK. Any member serving in an acting officers capacity, such as Fire Captain, Rescue Captain, Rescue Seat (person in charge), Fire Lieutenants, and Battalion Chiefs, shall receive the pay equal to the actual hourly rate of the position he/she is replacing and for the actual hours worked. A private who assumes command of a platoon in the absence of an officer shall be compensated at the rate paid a Lieutenant commencing with the first day. Seniority in each group shall govern selection of members temporarily assuming the duties of a higher rank at the discretion of the Chief.
