Tenure and Promotion. PROVISIONS FOR FULL-TIME FACULTY Preamble 21.01 Unless otherwise provided for in this Collective Agreement, this Article applies only to full-time faculty members of the University with probationary or tenured appointments. 21.02 Tenure refers to appointment without term. Such an appointment may be terminated only through resignation or retirement, dismissal for cause (Article 9 - Dismissal) or under the financial exigency procedures (Article 29 - Financial Exigency). Tenure is the basic mechanism for the protection of academic freedom. Tenure is a privilege and carries a significant measure of responsibility, but it is a privilege to which all probationary faculty members may aspire. 21.03 The traditional right and responsibility of a faculty member, tenured or not, to academic freedom (Article 11- Academic Freedom) is recognized by the Parties.

Tenure and Promotion. 25.01 (1) Promotion for a Faculty Member shall be an advancement in rank from Lecturer to Assistant Professor, from Assistant Professor to Associate Professor and from Associate Professor to Professor.
Tenure and Promotion. 14.01 The parties agree that promotion of probationary and tenured employees from one rank to another, the award of tenure to employees, the renewal or non-renewal of the appointments of employees in the pre-candidacy phase of a probationary appointment, and their advancement to the candidacy phase shall be by action of the Board of Governors, only upon recommendation of the President. The President shall, in making his/her recommendations, act in conformity with existing practices with respect to criteria and procedures for promotion and tenure, in so far as they relate to terms and conditions of employment. It is agreed that the existing practices are those as set out in the Tenure and Promotion Policy, Criteria and Procedures document as of 1 September 2012. Amendments to these criteria and procedures shall require the approval of both parties. The documents referenced above are printed under separate cover and form part of this Collective Agreement. 14.02 The recommendation of the President to the Board of Governors or his/her decision not to make a recommen- dation to the Board of Governors in respect of clause 14.01 above shall be subject to the grievance and arbitration procedures set out in Articles 9 and 10 of this collective agreement. Such grievances shall be limited to: (a) allegations of irregularity or defect, of a nature suffi- ciently serious to justify quashing the decision, in the application of the procedures established in clause 14.01; (b) allegations of violation of academic freedom (as defined in Article 11) or of discrimination (as defined in Article 5). An arbitrator shall be limited in his/her jurisdiction to the matters set out in (a) and (b) of this clause, and shall be without power to reverse the President’s decision or recommendation or to award tenure or promotion, but may quash the President’s decision or recommendation on the grounds set out in (a) or (b). In such cases, time limits established by existing practices for the processing or recommendations shall be appropriately amended. 14.03 Any alteration of procedures in a particular case neces- sitated by an arbitrator’s decision to quash a decision on grounds of discrimination or violation of academic freedom shall be subject to approval by the parties.

In that meeting or meetings, student members and limited term and non-full-time faculty, if any, shall be given the opportunity to express their views and then be excused from the meeting. Tenure and Promotion. Faculty Committees (TPFs) (a) Each Faculty will have a Tenure and Promotion – Faculty Committee (TPF). Each Committee will be composed of six members: the Associate Xxxx of the Faculty or a Xxxx or Associate Xxxx from another Faculty, who will be Chair, and five tenured or tenure-track Members, a majority of whom must be tenured. Aside from the Chair, the TPF members will be elected by the tenured and tenure-track Members from within the same Faculty. (b) Membership on a TPF is limited to tenured Members and tenure-track Members with at least three years’ service at Nipissing on the July 1 in which their term on the Committee begins. A majority of TPF members must have tenure. On a TPF, the role of the Chair is to ensure that the Standards and the procedures in this Article are followed. All Members have voting rights, but the Chair will vote only in case of a tie. (c) For the Faculty of Arts and Science’s TPF, no more than two Members may be from any department/school. For the Faculty of Education’s TPF, the Members will be elected from the entire Faculty. (d) For the Faculty of Applied and Professional Studies, every effort will be made to have Members elected from across the schools/departments within the Faculty of Applied and Professional Studies. However, if this is not possible, then Members may be appointed by the Xxxxxxx, with the agreement of the President of the Association. (e) If any new Faculties are created, each new Faculty will have its own TPF where practicable. If this is not practicable, the Xxxxxxx will, in consultation with the Association, determine an appropriate site for review within an existing TPF. (f) A TPF will have two alternates, usually those who finish sixth and seventh in the election for a TPF. If a vacancy occurs, the alternate who finished sixth usually will be appointed to the TPF first. (g) A non-voting NUFA Observer will be appointed by the President of the Association to sit on each TPF. The Observer may not participate in any manner in the deliberations of the Committee but will have the right to communicate his/her observations to the Chair between meetings or, if deemed necessary, to request a recess in the proceedings of a given meeting for the purpose of communicating with the Chair of the Committee. (h) Quorum for a TPF is five members, a majority of whom must be tenured. The Chair of the Committee must be in attendance; he/she is counted towards the quorum. Tenure and Promotion. 10.1 Pre-Tenure Review Process: Probationary faculty shall undergo a formal pre-tenure review in the fall of their third probationary year. If the faculty member is on an accelerated probationary track, the year in which pre-tenure review will take place shall be identified in consultation with the Department Chair or Director and the college Xxxx and communicated in their letter of initial appointment.
Tenure and Promotion. ‌ 10.1 Tenure and Promotion for Faculty Employees‌ (a) Appointments without Tenure (i) An appointment without tenure shall be made as a term appointment, or a preliminary (tenure-track) appointment at the rank of Lecturer, Assistant Professor, Associate Professor or Full Professor. (ii) A faculty term appointment is one made without expectation of renewal (subject to Article 36). A term appointment may, however, be renewed and a faculty member employed under successive term appointments must in the fifth year of such employment be considered for tenure. In any case successive term appointments must not exceed a period of six years. (iii) A preliminary (tenure-track) appointment at the rank of Lecturer is one made where there is a specific requirement to complete the doctoral degree or the terminal degree for the discipline. Such requirements will be clearly stated in the letter of appointment. The length of a preliminary appointment as a lecturer shall normally be for three (3) years. If the requirement is successfully met, the appointment will be converted to the rank of Assistant Professor, and the appointee may choose to start the time to tenure from their initial appointment or their date of conversion to the new rank. (iv) Members being offered employment within disciplines where professional accreditation is necessary for the viability of the program may be required to, within five (5) years of the commencement of employment, obtain the required credentials and shall maintain these credentials during their employment. When a member is required to achieve and maintain this credential, this requirement shall be outlined in the letter of appointment and any subsequent renewal. (v) The Employer shall refund the employees in programs where professional accreditation is necessary for the fees incurred to initially obtain these credentials. (vi) A preliminary (tenure-track) appointment at the rank of Assistant Professor is one made with the expectation that, subject to successful pre-tenure annual reviews as per Article 10.1(c), it will be renewed and at some point succeeded by an appointment with tenure. The purpose of a preliminary (tenure-track) appointment is to allow sufficient time to successfully transition to a tenured appointment. Normally, an initial preliminary (tenure-track) appointment shall be for three (3) years and renewal of a preliminary (tenure-track) appointment shall be for three
