Time Off in Lieu of Payment of Overtime. 17.8.1 Notwithstanding the provisions of subclause 17.1 an employee may elect, with the consent of the Company, to take time off in lieu of payment for overtime at a time or times agreed with the Company.
17.8.2 Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked.
17.8.3 The company shall if requested by an employee, provide payment at the rate provided for the payment of overtime in the Agreement, for any overtime worked under paragraph 17.8.1 of this subclause where such time has not been taken within four (4) weeks of accrual.
Time Off in Lieu of Payment of Overtime. Employees who work overtime may opt to bank, at the equivalent premium time rate, hours worked up to a maximum of the equivalent of one week, plus a day or 6 working days in one year, i.e., 48 hours for Category 1, 2 and 3 Workers, and 43.5 for Category 4 Workers.
11.9.1 Banked lieu time may be used on an hour-by-hour basis. Utilization of lieu time must be requested in advance and is subject to approval of the employee’s immediate supervisor, based on business requirements. Such requests will not be unreasonably denied.
11.9.2 Employees who work on the following recognized holidays; the one-half day on the last working day before Christmas Day or the one-half day on the last working day before New Year’s Day, may bank and carry-over those hour(s) into the next calendar year. These banked hour(s) must be used by March 31st of that year otherwise they will be paid out as of that date.
11.9.3 Shift Workers working rotational shifts who work on a recognized holiday may have that specific time banked as lieu time, in addition to the above- mentioned six-day limit.
11.9.3.1 Shift workers who bank the time in lieu on the following recognized holidays; one-half day on the last working day before Christmas Day, Christmas Day, Boxing Day, one-half day on the last working day before New Year’s Day, will carry these days into the next calendar year. These banked days must be used by March 31st of that year otherwise they will be paid out as of that date.
Time Off in Lieu of Payment of Overtime. Where an Employee has performed duty on overtime, an Employee may elect, with the consent of the Employer, to take time off in lieu of overtime payment at a time or times agreed with the Employer, provided that:
(a) Overtime taken as time off during the ordinary hours of work prescribed by Xxxxxx 13, shall be taken at the ordinary time rate, that is, an hour for each hour worked.
(b) Any amount of overtime that has been worked by an Employee in a particular pay period and that is to be taken as time off instead of the Employee being paid for it must be the subject of a separate agreement under this subclause 14.3. The agreement should state:
(i) the number of overtime hours to which it applies and when those hours were worked;
(ii) that the Employer and Employee agree that the Employee may take time off instead of being paid for the overtime;
(iii) that, if the Employee requests at any time, the Employer must pay the Employee, for overtime covered by the agreement but not taken as time off, at the overtime rate applicable to the overtime when worked;
(iv) that any payment mentioned in subparagraph 14.3(b)(iii) must be made in the next pay period following the request. Note: An agreement under paragraph 14.3(b) can also be made by an exchange of emails between the Employee and Employer, or by other electronic means. (c) Usually an Employee may not accumulate more than 20 hours to be taken as leave in lieu of overtime payment and overtime shall be taken within one school term, where practicable, and in all cases within six (6) months of the accrual. If not taken it shall be paid at the appropriate overtime rate.
Time Off in Lieu of Payment of Overtime. 19.9.1 An employee may elect, with the consent of the Company, to take time off in lieu of payment for overtime at a time or times agreed with the Company.
19.9.2 Overtime taken as time off during ordinary time hours shall be taken at the ordinary time rate, that is an hour for each hour worked.
19.9.3 The company shall if requested by an employee, provide payment at the rate provided for the payment of overtime in the Agreement, for any overtime worked under paragraph 19.9.1 of this sub-clause where such time has not been taken within 12 weeks of accrual.
Time Off in Lieu of Payment of Overtime. 15.3.1 At the request of the employee, and where agreed between the Company and employee concerned, the employee may take time off in lieu of payment for overtime at a time or times agreed with the Company.
15.3.2 Overtime taken as time off during ordinary time hours must be taken at the ordinary time rate that is an hour for each hour worked.
15.3.3 The Company will, if requested by an employee, make payment at the rate provided for overtime in this Agreement, for any overtime worked under this clause where such time has not been taken within four (4) weeks of accrual.
15.3.4 Professional A & B employees may be granted for time worked in excess of normal hours special additional remuneration or have this factored into account when fixing annual remuneration.
Time Off in Lieu of Payment of Overtime. 19.3.1 At the request of the employee, the employee will be able to have time off in lieu of payment for overtime. The time off will be taken at a time or times agreed by the Employee with the Company.
19.3.2 Time off in lieu of payment for overtime will be taken during an employee’s rostered shift at the ordinary time rate: that is an hour for each hour worked.
19.3.3 The Company will, if requested by an employee, make payment at the employee’s ordinary wage rate, for any accrued TOIL under this clause where such time has not been taken within four (4) weeks of accrual.
19.3.4 Professional A and B employees may be granted for time worked in excess of normal hours special additional remuneration or have this factored into account when fixing annual remuneration.
Time Off in Lieu of Payment of Overtime. (TOIL)
a. By mutual agreement an Employee may elect to take time off at the appropriate penalty rate in lieu of payment at a time mutually agreed between the Employer and the Employee, in which case the time off shall be granted within 28 days of working the overtime, or by mutual agreement, an Employee may elect in lieu of payment of overtime to take time off equivalent to the time worked at ordinary time in conjunction with their annual leave. If the Employee’s employment ends, any outstanding hours will be paid at the appropriate penalty rate.
b. The Employer cannot direct an Employee to take time in lieu and if circumstances arise so that the Employee cannot take the mutually agreed time in lieu within the 28 day period then payment of the overtime will be made in the next pay period.
c. Leave loading does not apply to this arrangement.
d. The provisions of this clause shall not apply to a Scientist - Director or Deputy Director.

(b) Authorised overtime taken as time off in lieu shall be taken at the overtime rate.
(c) If, having elected to take time as leave in accordance with paragraph (a) above, the leave is not taken for whatever reason, payment for time accrued at overtime rates will be made at the expiry of the twelve (12) month period or on termination.
(d) Where no election is made in accordance with paragraph (a), the employee shall be paid overtime rates in accordance with the agreement.
