USES AND PRIVILEGES. 1.1. The purpose of this Agreement is to ensure that the Airport’s commercial ground transportation operations provide a high level of customer transport and services that are representative of a world class airport and to make effective and efficient use of the Airport’s Commercial Ground Transportation Lot and its roadways. 1.2. Subject to the terms of this Agreement, Augusta hereby grants a revocable, non- exclusive Permit to TNC as a Commercial Ground Transportation TNC in the classification of a Transportation Network Company. 1.3. During the term of this Agreement, TNC shall have a non-exclusive, revocable Permit solely to (i) operate subject to the Airport’s Grounds Transportation Rules (as defined herein), at the Airport utilizing smart phone mobile application technology to connect passengers with pre-arranged transportation services for hire; and (ii) permit TNC Drivers to transport such passengers and/or their personal baggage to and/or from the Airport in TNC Drivers' vehicles; and

USES AND PRIVILEGES. Subject to the terms and conditions hereinafter contained, ADVERTISING PROVIDER has the right, privilege and obligation to design, install, sell and maintain throughout the stated term, Advertising Structures, and to place advertisements on the City Structures as provided herein, subject to the provisions of this Agreement within the Designated Areas (“Permitted Use”). ADVERTISING PROVIDER shall use the Designated Areas for no purpose other than the Permitted Use without the prior written consent of CITY. Advertising Structures shall comply with the CUP and the placement by ADVERTISING PROVIDER of advertisements on the Advertising Structures and the City Structures shall comply with Section 18.14.130 of the Anaheim Municipal Code and the ARTIC Coordinated Sign Program. USES AND PRIVILEGES. 6.1 The Concessionaire has the non-exclusive right, privilege, and obligation to continuously and uninterruptedly occupy, operate and manage the Assigned Premises in accordance with the provisions of this Agreement for the following purposes and as more specifically outlined in Space LOD # : As specifically outlined in Exhibit C, the operation of a Concessionaire shall also have the specific right, privilege and obligation to sell such permitted merchandise and menu items from its Assigned Premises as are defined and described in Exhibit C, attached hereto and incorporated herein by reference, and for no other purpose whatsoever. 6.2 Concessionaire’s business in the Assigned Premises shall be conducted under the trade names and logos of: Assigned Premises Trade Names LOD # Concessionaire shall not use or permit the Assigned Premises to be used under any other trade name without the Board’s written consent, such consent not to be unreasonably withheld. Concessionaire acknowledges and xxxxxx agrees that the identity, skill, experience and reputation of the Concessionaire, the specific character of the Concessionaire’s business, the anticipated use of the Assigned Premises, potential for payment of Percentage Rent and the relationship between such use and other uses within the Facilities were all relied upon by the Board and served as significant and material inducements contributing to the Board’s decision to enter into this Agreement with the Concessionaire. Any change in the character of Concessionaire’s business, trade name or use, without the Board's written consent shall constitute a material default under this Agreement. 6.3 In the event the Chief Executive Officer, in his/her sole opinion, determines that any conduct of the Concessionaire or any item or service displayed, offered for sale or sold by the Concessionaire is objectionable, Concessionaire shall, upon written notice from the Chief Executive Officer, immediately cease such activity or remove such item or service from display and from its inventory and Concessionaire agrees that it shall not thereafter display, offer for sale, or sell such item or service. 6.4 The sale of items or services other than those identified in Exhibit C or discontinuance of the sale of items or provision of services identified in Exhibit C by Concessionaire shall not be permitted without prior written approval of the Chief Executive Officer, who may withhold approval for any reason whatsoever or for no reason. USES AND PRIVILEGES. SECTION 4.01 USE OF THE AIRPORT AIRLINE, its employees, passengers, guests, patrons, and invitees shall have the right to the use (in common with other duly authorized users) of the Airport and appurtenances, together with all facilities improvements, equipment, and services which have been or may hereafter be provided for common use at or in connection with the Airport, subject to the Joint Use Agreement and the Rules, Regulations and Ordinances of AUTHORITY, which documents AUTHORITY shall make available to AIRLINE. SECTION 4.02 SCOPE OF PRIVILEGES AIRLINE shall have the right, in addition to all rights elsewhere granted in this Agreement, to use the Airport for the following purposes: A. The operation of a public transportation system by air for the carriage of persons, property, mail, and/or cargo, including all activities reasonably necessary to such operation. B. The landing, taking off, flying over, taxiing, towing, loading, unloading, servicing, repairing, de-icing and parking of aircraft or other equipment of or operated by AIRLINE, or other Air Transportation Companies with which there is an applicable agreement between AIRLINE and such other Air Transportation Companies, including the right to provide or handle all or part of the operations or services of such other companies subject to Section 4.03 and such Rules, Regulations and Ordinances as the AUTHORITY may establish. C. The sale of tickets, documentation of shipments, handling of reservations, operation of a customer service lounge, provision of skycap services, and the loading and unloading of persons, property, cargo and mail at Airport by such motor vehicles or other means of conveyance as AIRLINE may desire to use in the operation of its air transportation system; provided, however, that any ground transportation commercial carrier (including AIRLINE, if applicable, except for such ground transportation as AIRLINE or its nominee may provide solely for the benefit of its employees) regularly transporting persons to and from Airport shall first secure and thereafter hold a valid lease, license, or other agreement with AUTHORITY for the right to carry persons to and from Airport and shall pay AUTHORITY such rentals, fees and/or percentages of the fares of such ground transportation commercial carrier for such right as AUTHORITY may set by ordinance or resolution. USES AND PRIVILEGES. Lessee shall have the right to use the Premises for operation of an airline including: training, aircraft modifications, and other related airline functions and for no other purpose. Lessee may use the common use areas for the purposes for which they are designated; such common use areas include, but are not limited to roadways, walkways, water, and restroom facilities. Lessee shall also have the general use, in common with others authorized so to do, of all public Airport facilities and improvements which are now or may hereafter be connected with or appurtenant to said Airport, including, but not limited to, City owned approach areas, runways, taxiways, public aprons, aircraft and automobile parking areas, roadways, sidewalks, navigational and aviation aids, terminal facilities as may be constructed, or other City owned facilities appurtenant to said Airport. Lessee shall have the right of ingress and egress from the Premises over and across City owned roadways serving the Airport for its employees, representatives, agents, patrons, guests and suppliers, subject to such laws, ordinances, rules, and regulations as now or may hereafter have application at the Airport. City hereby retains the right of ingress and egress over, through and across the Premises at any time and the right to provide substitute ingress or egress if such becomes necessary.
USES AND PRIVILEGES. (A) Tenant agrees that this Lease is granted and limited to the Tenant for the purpose of housing a fixed base operator business on the airport for the purpose of providing services to the public, including but not limited to the sale of aviation fuel and petroleum products, aircraft rental, air taxi service, flight training, aircraft and aircraft parts, sales and service and similar aviation-oriented services. Tenant agrees that it will not use the Premises for any other purpose. Tenant agrees to operate the Premises leases for any other purpose. Tenant agrees to operate the Premises leases for the use and benefit of the public and to furnish said service on a fair, equal and not unjustly discriminatory basis to all users thereof, and to charge fair, reasonable, and not unjustly discriminatory prices for each unit or service. Tenant may be allowed to make reasonable and nondiscriminatory discounts, rebates, or other similar types of price reductions to volume purchasers. (B) The general use, in common with others authorized so to do, of all public airport facilities and improvements which are now or may hereafter be connected with or appurtenant to said Airport, except as hereinafter provided. As used herein, the term "Public Airport Facilities" shall include, but not necessarily be limited to, approach areas, runways, taxiways, public aprons, aircraft and automobile parking areas, roadways, sidewalks, navigational and navigational aids, terminal facilities, or other public facilities appurtenant to said Airport. (C) The right to ingress to and egress from the Premises over and across public roadways serving the Airport for Tenant, its employees, representatives, agents, patrons, guests and suppliers, subject to such nondiscriminatory and lawful ordinances, rules and regulations as now or may hereafter have application at the Airport. It is understood and agreed that City hereby retains the right of ingress and egress over, through and across the Premises to provide access to the property at any time.
