Each employee shall indicate not later than the last day of February their preference. The lists shall be reviewed by the Company and approved by the department. The employee will choose his first and second week of earned vacation from the available dates. An employee who fails to choose dates at this time will forfeit his rights and will be scheduled in available dates. This vacation list will be finalized and posted on February 15th along with a notice of remaining weeks of earned vacation. Five days following the posting of the notice in above, the Supervisor will approach each eligible individual in order of seniority. Employees will choose their remaining weeks of earned vacation from the available dates. Employees who fail to choose their dates at this time will forfeit their rights and will be scheduled in available dates. This vacation list will be finalized and posted by March 5th. The Company will advise the employees by February 1st of the planned dates of any scheduled shutdown. Replies to "Leave of Absence" requests conjunction with vacation will be forthcoming by March 15th. Employees who are absent due to illness or who are on layoff will be contacted by their Supervisor according to the above schedule. Prime time will be a 16-week period beginning from the last Sunday in May. APPENDIX COST OF LIVING ALLOWANCE (1st Year of the Agreement) FOR THIS PURPOSE:
Vacation Scheduling Procedure. Each employee who has qualified under the Vacation Entitlement requirements of the Collective Labour Agreement will be entitled to two (2) consecutive weeks vacation commencing Monday, July Third, fourth, fifth and sixth weeks of vacation will be scheduled throughout the balance of the year on a seniority basis so as to maintain normal production requirements. Employees who so desire, may apply to take their entire vacation at one time. Vacation scheduling lists will be posted each year from March 1st to April 1st during which time the employees will indicate the time desired. The Company will approve the vacation schedule by April 15thfor the next month after which time, it will be considered to be in effect. Those employees who fail to indicate the period desired for vacation shall have their vacation assigned at the Company’s discretion. In the Maintenance Department, two (2) employees per week will be allowed vacation time during the Plant Vacation Shutdown with the balance of the employees required to work. The remaining employees will be entitled to a two (2) week consecutive vacation period between June 15th and September 15th. Where feasible, three employees may be scheduled on vacation at any one time. The two (2) week Plant Vacation Shutdown will not apply to the Shipping Department which will be required for shipping requirements. These employees will be scheduled vacation as per past practice. In January the Company will endeavour to determine (based on ability and seniority) and based upon requirements (special projects), etc. the number of employees (skeleton crew) required for the two (2) week shutdown. Thisprogram is not applicableto employees (Office). Employees with two (2) weeks entitlementmay be granted, under special two (2) weeks leave of absence, i.e. wedding. Agreed Negotiations: February 26, 2009 Letter of Understanding Weekend Worker Language as Outlined in Management Proposal Since the existing weekend shift structure will be discontinued on or about January 2, 2011 it is agreed between the parties that all contract language governing weekend workers, including changes agreed to during these negotiations, will be maintained in a Letter of Understanding outside of the Collective Agreement. When the weekend shift structure discontinuance has been finalized this Letter of Understanding will become null and void. The parties agree that weekend workers will be discontinued on the following basis: up to 50% on or about January 3, 2010: the balance on or about January 2, 2011. The Company shall have the sole discretion to post any job vacated through attrition.
