Building Expenses. With reference to Tenant's appropriate proportionate share of property tax, insurance expenses and common area service expenses as defined in the Lease Agreement, Tenant hereby agrees to pay, as additional monthly rental, Two Thousand Three Hundred Fifty Six and no cents ($2,356.00) to be paid monthly, in advance, along with the monthly rental previously stated in Lease Article
Building Expenses means the total cost and expenses paid or incurred by Landlord in connection with the management, operation, maintenance and repair of the Buildings, including without limitation: (i) the cost of air conditioning, electricity, steam, water, heating, mechanical, telephone, utilities (ii) the cost of repairs, replacements and all labor and material costs related thereto, and the cost of general maintenance, cleaning and service contracts and the cost of all supplies, tools and equipment required in connection therewith, (iii) wages, salaries, payroll taxes and other labor costs and employee benefits, (iv) management fees, (v) fees, charges and other costs of all independent contractors engaged by Landlord working in the building, (vi) accounting and legal expenses, (vii) security protection, (viii) depreciation on personal property, including, without limitation, carpeting in public corridor and common areas and window coverings provided by Landlord, (ix) the fair market rental value of all offices in the Building for the property manager and related management and operations personnel, (x) the cost of any capital improvements made in the building after completion of its construction as a labor saving or energy saving device or to effect other economics in the operation or maintenance of the Building, or made to the Building after the date of this Lease that are required under any governmental law or regulations that was not applicable to the Building at the time that permits for the construction thereof were obtained such cost to be amortized over such reasonable period as Landlord shall determine, together with interest on the unamortized balance at the rate of ten percent (10%) per annum or such higher rate as may have been paid by Landlord on funds borrowed for the purpose of construction such capital improvements, (xi) the cost of contesting the validity or applicability of any governmental enactments which may affect operating expenses, (xii) maintenance and repair of the roof of the building and the structural parts of the Building, (xiii) fees for licenses and permits required for the operation of the Building and Common Area and (xiv) any other expenses of any kind whatsoever reasonably incurred in connection with the management, operation, maintenance and repair of the Building (other than Real Estate Taxes, Insurance expenses and any services for which Landlord is separately and directly reimbursed by tenant or other tenants in the Building). Examples of Building Expenses in a sentence

  • Sublandlord will prorate the Building Expenses for the calendar year in which the Sublease commences or terminates, as applicable, on a per diem basis based on the number of days of the Term within such calendar year.

  • Promptly following the Rent Commencement Date and in December of each calendar year during the Term, or as soon after that date as practicable, Sublandlord shall give Subtenant written notice of its estimate of Building Expenses and Real Estate Taxes for the following calendar year.

  • During the Term but only commencing as of the Rent Commencement Date, Subtenant shall pay the Building Expenses paid or incurred by Sublandlord in each calendar year of the Term.

More Definitions of Building Expenses

Building Expenses means (subject to the last sentence of this subsection (v) the total of all the costs and expenses incurred or borne by Landlord with respect to the operation and maintenance of the Building (or, as provided in Section 6.1(c), of the Other Building) and the services provided tenants therein including, but not limited to, the costs and expenses incurred for and with respect to: protection and security; landscaping and landscape maintenance; repair, maintenance, lighting and striping of parking areas and removal of snow therefrom; road maintenance and repairs, outdoor lighting; repairs, replacements and improvements which are appropriate for the continued operation of the Building as a first-class building; maintenance; by contract or otherwise; window washing; painting of non-tenant areas; fire, extended coverage, boiler and machinery, sprinkler, apparatus, public liability and property damage, rental and plate glass insurance and any insurance required by a mortgagee or actually carried by Landlord; supplies; wages, salaries, disability benefits, pensions, hospitalization, retirement plans and group insurance respecting employees of the Landlord up to and including the building manager (including a pro rata share only of such wages and benefits of employees, including Landlord's engineer, who are employed at more than one building; such pro rata share shall be determined by Landlord and shall be based upon Landlord's estimate of the percentage of time spent by such employees at the Building); uniforms and working clothes for such employees and the cleaning thereof; expenses imposed on the Landlord pursuant to law or to any collective bargaining agreement with respect to such employees; workmen's compensation insurance, payroll, social security, unemployment and other similar taxes with respect to such employees; property management; administrative, accounting, professional and consulting fees. Notwithstanding the foregoing, the Building Expenses shall not include costs and expenses pertaining to the operation and maintenance of the interior of the Building, or to the extent applicable, the Other Building, debt service, roof replacement and other capital expenditures, and, in the event that the Landlord employs any companies owned and controlled by Landlord, such employment may only be compensated at market rate.
Building Expenses shall be all those expenses paid or incurred by Landlord in connection with the owning, maintaining, operating and repairing of the Property or any part thereof, in a manner deemed reasonable and appropriate by Landlord and shall include, without limitation, the following: 6.2.2.1 All costs and expenses of operating, repairing, lighting, cleaning, and insuring (including liability for personal injury, death and property damage and workers’ compensation insurance covering personnel) the Property or any part thereof, as well as all costs incurred in removing snow, ice and debris therefrom and of policing and regulating traffic with respect thereto, and depreciation of all machinery and equipment used therein or thereon, replacing or repairing of pavement, parking areas, curbs, walkways, drainage, lighting facilities, landscaping (including replanting and replacing flowers and other planting); 6.2.2.2 Electricity, steam and fuel used in lighting, heating, ventilating and air conditioning and all costs, charges, and expenses incurred by Landlord in connection with any change of any company providing electricity service, including, without limitation, maintenance, repair, installation and service costs associated therewith; 6.2.2.3 Maintenance and repair of mechanical and electrical equipment including heating, ventilating and air conditioning equipment; 6.2.2.4 Window cleaning and janitor service, including equipment, uniforms, and supplies and sundries; 6.2.2.5 Maintenance of elevators, stairways, rest rooms, lobbies, hallways and other Common Areas; 6.2.2.6 Repainting and redecoration of all Common Areas; 6.2.2.7 Repair and maintenance of the parking areas, including without limitation, the resurfacing and striping of said areas; 6.2.2.8 Sales or use taxes on supplies or services; 6.2.2.9 Management fees, wages, salaries and compensation of all persons engaged in the maintenance, operation or repair of the Property and the provision of amenities to all tenants in the Property (including Landlord’s share of all payroll taxes and the cost of an on-site or near-site office and segregated storage area for Landlord’s parts, tools and supplies); 6.2.2.10 Legal, accounting and engineering fees and expenses, except for those related to disputes with tenants or which are a result of and/or are based on Landlord’s negligence or other tortious conduct; 6.2.2.11 Costs and expenses that may result from compliance with any governmental laws or regulations that were not ap...
Building Expenses. Insurance Expenses" and "Common Area Expenses" are defined in Exhibit B to this Lease. Exclusions from Definition of "Expenses", including Real Estate Taxes, Building Expenses, Insurance Expenses and Common Area Expenses (collectively "Expenses") as defined in Exhibit B to this Lease.
Building Expenses means all costs and expenses incurred by Landlord, directly or indirectly, in the maintenance, ownership, operation, repair, and replacement of land and the Building including the Common Areas, and including, without limitation: property taxes and assessments, real, personal, general and special; insurance; water, sewer, electricity, gas and other sources of power for heating, lighting, ventilating or air conditioning (except when separately billed to a specific tenant of the Building); management fees, wages, salaries, fringe benefits, and applicable taxes on the employer for services related to the Building performed by Landlord's employees; supplies consumed in connection with cleaning and general maintenance; cost incurred in connection with snow removal and exterior grounds care; and depreciation for repairs. Building Expenses shall not include janitorial expenses for the Leased Premises or other leased premises within the Building.
Building Expenses means the total amount of all costs and expenses incurred or paid by Landlord with respect to and in connection with the operation, maintenance, replacement and/or normal operating repair of the Building, including, without limitation, the cost incurred for (i) air conditioning; (ii) mechanical ventilation; (iii) heating; (iv) cleaning comparable to the Cleaning Specifications annexed as EXHIBIT F; (i) rubbish removal; (ii) window washing (interior and exterior, including inside partitions); (iii) elevators; (iv) escalators; (v) portxx xxx matron service;
Building Expenses means:- (a) the aggregate of all costs, expenses and outgoings whatsoever (including any part of such costs, expenses and outgoings which represents VAT) incurred by the Landlord in providing the Services and the Superior Landlord’s Services (to the extent that such services are being provided by the Landlord) which for the avoidance of doubt shall be calculated on the basis of a full cost recovery without any profit element or xxxx up; (b) the total of all costs, fees and expenses incurred by the Superior Landlord in providing the Superior Landlord’s Services and payable by the Landlord to the Superior Landlord; and (c) such sums or provisions as the Landlord may, in its discretion, consider desirable to set aside from time to time for the purpose of providing for periodically recurring items of expenditure, whether recurring at regular or irregular intervals or for anticipated expenditure in respect of any of the Services;
Building Expenses means all of Landlord's costs and expenses of operation and maintenance of the Conference Center (excluding any Project Expenses) as determined in accordance with generally accepted accounting principles or other recognized accounting practices, consistently applied, including, without limitation, all costs and expenses incurred by Landlord in performing its obligations under Sections 7(a) and 10(b) below; costs incurred in providing card-key access to the Conference Center; and costs of security services for common areas of the Conference Center. Notwithstanding the preceding to the contrary, Building Expenses shall not include any costs incurred by Landlord in connection with the construction of any alterations, additions or improvements for the sole benefit of Landlord or other occupants of the Building or Project; financing and refinancing costs, including interest on debts relating to mortgage loans and rental fees under any ground or underlying leases; business or income taxes; depreciation or amortization expense (except as provided below); costs in excess of the insurance deductible (which deductible shall in no event exceed $50,000.00) incurred by Landlord in connection with repairs and restorations following the occurrence of a casualty loss; leasing commissions and other costs of leasing incurred by Landlord; costs of restoring any Building or other improvements following a taking or transfer in lieu thereof; costs incurred by Landlord as a result of any improvements required to cause the Conference Center to comply with applicable laws, ordinances, building codes, rules or regulations; costs incurred as a result of the negligent or intentional acts of Landlord, other occupants of the Project or their respective employees, agents or contractors; and any costs which would be capitalized under generally accepted accounting principles (except as provided below). Except as otherwise provided above, and subject to Section 11 below, Building Expenses shall include the cost of necessary capital repairs and replacements to the Conference Center, which shall be amortized monthly over the useful life of the capital item on a straight-line basis during the Term.
