ARTICLE JOB SECURITY. The Employer shall not contract out work usually performed by members of this bargaining unit, if as a result of such contracting out a layoff of any employees, other than Part Time employees covered by Article of this Appendix "A" follows. The contracting out to an Employer who is organized and who will employ the employees of the bargaining unit who would otherwise be laid off, is not a breach of this provision. The Employer undertakes to notify the Union in advance so far as practical, of any technological changes which the Employer has decided to which will significantly change status of within the bargaining unit. The Employer agrees to discuss with the Union the effect of such technological changes on the employment status of the employees and to consider practical ways and means of minimizing the adverse effects if any upon employees concerned. Employees with one or more years of continuous service who are subject to layoffs under conditions referred to above, shall be given notice of the impending change in employment status at the earliest reasonable time in keeping with the notification to the Union as above set forth and the requirements of the applicable law.

ARTICLE JOB SECURITY. With respect to the development of any operating or re-structuring plan which may affect the bargaining unit, the Union shall be involved in the planning process as soon as practicable and, in any event, in advance of such plans or proposals being finalized and notices of layoff being issued or other actions taken that would adversely affect the bargaining unit and through to the final phases of the process. In addition to that, and to any other planning committee in the Hospital of a more broadly representational make-up, there shall be immediately established a Labour Adjustment Committee for the bargaining unit, which shall meet during the term of this agreement every three months, unless otherwise mutually agreed by the parties. It shall be the function of the Labour Adjustment Committee to consider possible ways and means of avoiding or minimizing potential adverse effects upon employees in the bargaining unit, including: identifying and proposing possible alternatives to any action that the hospital may propose taking; identifying and seeking ways to address the retraining needs of employees; identifying vacant positions within the Hospital for which surplus members of the bargaining unit might qualify, or such positions which are currently filled but which are expected to become vacant within a twelve (12) month period.

ARTICLE JOB SECURITY. In order to provide job security for members of the Union, the Employer agrees that work or services presently performed or hereafter assigned to the Union shall not be subcontracted, leased, assigned or conveyed, in whole or in part, to any other plant, person, company, or non-Union employees. An exception may be made to this Clause, provided management can prove to the Union that a retail operation is no longer viable or that by a of the University of Alberta the retail operation cannot continue. Should it become necessary to sell a retail department to another employer, every effort will be made to find the affected Employees alternate employment within the Union or the relevant provisions of Articles and shall apply.
ARTICLE JOB SECURITY. In order to provide job security for the members of this unit, no permanent employee will be laid off or remain on lay-off as a result of contracting out, provided the employee has the necessary qualifications and ability to perform the job. The Board may continue to use volunteers and to participate in co-operative education and work experience programs. No member of the bargaining unit will be replaced or have their hours reduced by any person outside the bargaining unit. In the event that the Victoria County Board of Education is amalgamated with any other of Education, the Victoria County Board of Education will make every reasonable effort to secure continued employment for members of the bargaining unit who were in its employ at the of amalgamation on terms and conditions of employment which are as similar as possible to those existing prior to amalgamation.
ARTICLE JOB SECURITY. It is agreed that no employee in the bargaining unit will be laid off as a result of any contracting out during the lifetime of this Agreement. The Employer agrees to notify the Union and the Union Stewardsin advanceof any technological changes which would decrease the size of bargaining unit or which might otherwise substantially affect employees in the bargaining unit. The Employer agrees to discuss such changes with the Union and the Union Stewards and will attempt to find practical ways and of minimizing the effect, if any, upon the employees concerned. The parties agree that Management will not perform bargaining unit work which results in the lay-off of an employee.
ARTICLE JOB SECURITY. Seniority for full time nurses shall be defined as the length of service with the Employer since the date of last hire including part-time service on the basis of hours paid equals one full time year. Effective April seniority for part-time nurses shall accumulate on the basis of hours equating to one full time year. Newly hired full-time nurses shall be considered to be on probation for a period of sixty (60) tours worked from date of last hire. A seniority list shall be maintained for all nurses covered by this Agreement, A copy of the seniority list shall be filed with the President of the Local Association, or her designate, following ratification of this Agreement and annually in the month of April. Such seniority list shall show the name of each full-time nurse, her date of hire and her seniority date outlining any adjustments made the previous twelve month period.
