Cashing Out Personal Leave. The Employer and the Employee may agree in writing to cash out an amount of paid personal/carer's leave in September each year provided that: (a) The Employee must, after the leave has been cashed out have any entitlement of at least 15 days; and (b) each cashing out of a particular amount of paid personal/carer's leave must be by a separate agreement in writing between the Employer and the Employee; and (c) the Employee must be paid at least the full amount that would have been payable to the Employee had the Employee taken the leave that the Employee has forgone; and (d) the maximum that an Employee can cash our will be eighty (80) hours per year.

Cashing Out Personal Leave. An employee covered by this Agreement, may at the employee’s election but on not more than one occasion in each 12-month period, make a written request to the Company to be able to cash out (or receive pay in lieu of taking) an amount of personal leave up to a maximum of 2 weeks personal leave. Such payment shall be made at the ordinary rate applicable to the Employee at that time. Upon any approved cash out of personal leave, the employee must retain a minimum of 15 days personal leave as stipulated in the Fair Work Act 2009. The Company may authorise the employee’s request and the Company has the right to reject any request for payment. If the request is authorised, the employee is entitled to an equivalent amount of pay to the leave foregone and the employee’s leave balance will be reduced by that amount.
Cashing Out Personal Leave. 41.7.1 Employees may request to cash out up to two weeks (76 hours) of their personal leave entitlement every 12 months (or the pro‐rata equivalent for part time employees) if the following conditions are met: a) A request to cash out personal leave must be given in writing from the employee, providing a minimum of one month's written notice, and b) The employee must retain a minimum of 15 days accrued personal leave. 41.7.2 The employer reserves the right to refuse such a request for reasons which may include occupational health and safety or operational grounds. 41.7.3 Sick leave will not be paid out on termination of employment.
Cashing Out Personal Leave. 1 In the event that an employee has personal/carer’s leave accruals in excess of 210 hours, they may, by written agreement with the Company on each occasion, and where permitted by legislation, have accumulations in excess of 210 hours paid out through payroll or into an approved superannuation fund in accordance with any statutory requirements and Company policies and forego a future entitlement to that leave.

Cashing Out Personal Leave. An Employee who has accrued at least 4 weeks of personal leave may request in writing to cash out leave in excess of the 4 weeks. The personal leave balance must remain as at least 4 weeks after any cash out.

Cashing Out Personal Leave. (a) A full-time or part-time Employee may apply to cash out an amount of paid personal leave subject to this Agreement. (b) With the exception of Former EBA Employees, Employees may cash out paid personal leave provided: i. it occurs on one occasion for each 12-month period of service (anniversary date); ii. the amount of paid personal leave to be cashed out must not exceed five (5) days; and iii. a balance of 15 days accrued but untaken paid personal leave remains. (c) Former EBA Employees may cash out any amount of paid personal leave at any time, provided a balance of 15 days accrued but untaken paid personal leave remains. (d) The Club and the Employee must agree in writing to the cashing out of any paid personal leave requested by the Employee and on each occasion be subject to a separate written agreement signed by both parties. A written agreement must state: i. the amount of paid personal leave to be cashed out and the payment to the made to the Employee; and ii. the date on which the payment is to be made. (e) The Club must keep a copy of all cashing out agreements in accordance with subclause 34.4(d) as an employee record. (f) Any paid personal leave that is authorised by the Club to be cashed out will be deducted from the Employee’s accrued but untaken paid personal leave entitlement. (g) Where the Club authorises an Employee’s request to cash out paid personal leave, the payment will: i. be calculated using the Employee’s ordinary hourly rate of pay at the time the election is made; and ii. be made in the next pay period following the Club’s authorisation for the leave to be cashed out.
Cashing Out Personal Leave. On your written request, you may cash out up to 37.5 hours per year of your personal leave if: • You have had at least 5 years continuous service and the balance of your personal leave does not fall below 187.5 hours, and • You are not dismissed. You will be paid at normal time for the hours cashed out. You may also take the corresponding time you have cashed out as unpaid leave. You can take this leave at a time agreed between you and your manager.

  • Extended Personal Leave Leave without pay for up to one (1) year may be granted to a teacher provided said teacher has been actively employed for five (5) continuous contract years preceding the granting of this leave and has not been granted an extended part-time leave within that period. (b) Where circumstances permit, an employee must endeavour to arrange leave to minimise the impact on operational needs. (c) The provision of appropriate documentary evidence. 1. For sick leave, a medical certificate or if not reasonably practicable to provide a medical certificate- a statutory declaration made by the employee. 2. For xxxxx's leave, a medical certificate in respect to the family or household member, or a statutory declaration by the employee. 3. For compassionate leave, any evidence that the employer reasonably requires. 7.3.5 The employee is not entitled to take more than 10 days of paid xxxxx’s leave (1/26th of the nominal hours worked by the employee) per year, regardless of the amount of personal leave the employee has accumulated over time. 7.3.6 An employee may request to cash out any amount of paid personal/carer’s leave that they have accrued that is excess of 3/52 of the number of nominal hours worked over the past 12 months. For example, an employee working 38 hours per week over 12 months must retain 15 days of paid personal/carer’s leave and may cash out any further personal/carer’s leave that has been accumulated. 7.3.7 In addition to the above, a request to cash out personal/carer’s leave will only be granted where: (a) the employee elects to cash out their leave in writing; and (b) the employer agrees. 7.3.8 Casual Employees engaged in continuous service shall be entitled to personal leave limited to the provision of sub clause 7.3.
