Creation of New Positions. When a new job is created, the District and the Association will meet to determine the job description, classification and rate structure for the new position. If the parties are unable to resolve the pay rate then the District shall establish a rate and post the position and fill the position according to contract. The Association may within ten (10) working days following the meeting file a grievance at Step Three of the grievance procedure.
Creation of New Positions. 3.14.1 The Board shall reserve the right to establish new positions. A new position shall be defined as a position which:
(a) is presently not included in this agreement;
(b) has responsibilities greater than those of a regular teaching position;
(c) has a distinct job description and title;
(d) has specific qualifications other than those required for a teaching position.
3.14.2 The salary for a new position shall be negotiated between the duly appointed representatives of the Elementary Local Bargaining Unit and the Board. If the parties are unable to reach agreement either party may refer the matter to a single arbiter in accordance with Article 12.
3.14.3 Such negotiations shall not constitute the re-opening of the collective agreement. When the salary for a new position is determined it shall be deemed to form part of the current collective agreement.
Creation of New Positions. In the case of a vacant position, before proceeding with a de-classification, abolishment, modification of functions or any other modifications that could lead to the creation of a position, the NFB must provide the local union president the justification and consult the local union president. Within ten (10) working days of the consultation, the union will provide its observations. The NFB may modify the job description after having given reasonable attention to the union’s observations.
Creation of New Positions. (a) In the event that a new position (title) of responsibility not already covered in the Agreement is required within the system for Teachers subject to this Agreement, the creation of the new position and an appropriate allowance shall first be discussed with the Joint Relations Committee established under Article 6.1. Such committee shall report its recommendation(s) to the Employer and the Union within fourteen (14) days. The Employer and the Union shall consider the recommendation with respect to the creation of the new position and allowance.
(b) If no agreement is reached through negotiations, the dispute may be determined by mediation as per Article 9.9 and/or arbitration as per Articles 9.8 or 9.11.
Creation of New Positions. DCSAA recognizes the authority of the School Board and/or the Superintendent to create, and where appropriate, designate new positions as managerial or confidential. If such a designation is made, the position shall be excluded from the DCSAA unit until such time as the designation of the School Board or the Superintendent is reversed by PERC. DCSAA further recognizes the authority of the School Board and/or Superintendent to designate persons in an acting capacity for a maximum of one year to fill managerial or confidential positions.
Creation of New Positions. Prior to creation of any new unit position(s) it is agreed that the District and the Union shall consult in the areas of wages, hours, and working conditions as defined by the E.E.R.A. (Educational Employees Relations Act).
Creation of New Positions. (a) If the Employer creates a new position not included in Article 51.02 (Pay Grade/Job Classifications) it shall develop a job description in consultation with the Union and establish a pay grade and wage schedule, where applicable, and give written notice of same to the Union no later than fourteen (14) calendar days prior to posting the position.
(b) If the Union fails to object in writing within twenty-eight (28) calendar days of receipt of the notice from the Employer the job description, pay grade and wage schedule, where applicable, shall be considered established.
(c) If the Union objects to the pay grade and wage schedule the Employer and the Union shall meet for discussion. If the pay grade and wage schedule, where applicable, are revised through negotiations with the Employer, the appropriate pay grade within the wage schedule, shall be retroactive to the employee's date of employment in the new position.
Creation of New Positions. 23.1 When additional positions are created coming within the scope of this Schedule, compensation will be fixed in conformity with that for positions of the same class as shown herein.
23.2 Positions (not employees) shall be rated. Before rates and duties for new positions are fixed, the management shall confer with duly accredited representatives of the employees.
23.3 Established positions shall not be discontinued and new ones created under a different title covering the same class of work for the purpose of reducing the rate of pay, or evading the application of these rules.
23.4 Changes shall be made in agreed basic rates of pay for individual positions only when warranted by changed conditions. When changes in basic rates of pay are proposed, the positions affected will be reviewed and compared with the duties and responsibilities of comparable positions by the proper officer of the Company and the UNIFOR Unit Chairperson. Reduction in the basic rate of pay for any position will be made only when a permanent vacancy occurs in such position.
23.5 An employee who considers that his/her position should be reclassified due to a significant change in job content shall have the right of to submit an appeal in the approved format to the Classification Review Committee for review. The appeal will be reviewed within 30 days and the employee will be provided with a written reply to their appeal. Should the employee not be satisfied with their appeal, the matter may be forwarded to Step 2 of the grievance procedure pursuant to the Collective Agreement.
Creation of New Positions.
