Declaration of Emergency. The declaration of an emergency shall be limited to natural disasters and/or events over which the District has no control. In no event shall the District declare an emergency for purposes of evading the provisions of this Agreement.
Declaration of Emergency. In cases of emergency declared by the Mayor or Chief, such as acts of God or civil disorder, the following conditions of this Contract may be temporarily suspended by the City:
Declaration of Emergency. The District management retains its right to amend or modify provisions of this Agreement in cases of emergency for the duration of the emergency. Emergency shall include but not be limited to a sudden occurrence or set of circumstances demanding immediate action by the District related to a local, state, or national matter. The District management shall notify the USTU of an emergency as soon as possible and agrees to meet and discuss with the USTU, upon written request, the reasons for declaring the emergency and the contract provision affected.
Declaration of Emergency. A state of emergency declared by the College’s Board of Trustees or its President, pursuant to 3345.26, when there is a clear and present danger of disruption of the orderly conduct of lawful activities at such college or university through riot, mob action, or other substantial disorder.
Declaration of Emergency. It is hereby acknowledged by the parties that the Rodeo and Fairgrounds are a Broadwater County emergency facility and used as an incident command center. The County makes the determination to utilize the Rodeo and Fairgrounds as an emergency facility or incident command center. Whenever possible, the County will include a Rodeo Association representative as a courtesy if/when the County is considering making the determination to utilize the Rodeo and Fairgrounds as an emergency facility or incident command center. Should a Federal, State, or County emergency requiring the use of the Rodeo and Fairgrounds be declared, the Rodeo Association will relinquish the facility to such entity requiring its use. In the event such an emergency use is required, every reasonable effort will be made to inform all parties as soon as possible. The Rodeo Association is responsible for providing a representative to all negotiations for rent and use of the Rodeo and Fairgrounds during the emergency. All expenses for damage to the grounds or structures incurred at the Rodeo and Fairgrounds, and not listed in Exhibit “B”, will be paid to the County by the party requiring the use thereof. All expenses for damage to the grounds or structures listed in Exhibit “B” incurred at the Rodeo and Fairgrounds will be paid to the Rodeo Association by the party requiring the use thereof. This includes but is not limited to, wear and tear of the grounds, structures, and electric and water bills. If there is a scheduled event at the time of the emergency, that needs to be canceled or curtailed, adjustments may be made to cover lost income. Adjustments will be determined by the consulting between all parties involved.
Declaration of Emergency. For a state of emergency in Nigeria: The President or the Acting President in the event of the incapacity or unavailability of the President upon the declaration of a state of national emergency shall direct the Director General NEMA to seek mutual assistance under this agreement. The declaration of emergency shall specify:
5.2.1 Nature of the emergency and area of impact (i.e. Earthquake and location, crop failure due to drought);
5.2.2 Anticipated duration of the state of emergency to the degree predictable.
5.2.3 Type of emergency relief goods needed in general terms. (i.e. Medicines, food, temporary shelter.) Recognition of a state of emergency in another country: The President or the Acting President in the event of the incapacity or unavailability of the President upon the declaration of a state of national emergency shall direct the Director General NEMA to provide assistance to the nation or the UN seeking assistance.
Declaration of Emergency. In cases of circumstances beyond the control of the Employer such as an act of God, riot, flood, civil disorder and other similar acts, but excluding strikes and other similar work stoppage acts on the part of other employees of the Employer, the following conditions of this Agreement shall be automatically suspended without recourse from the Union, upon declaration of said emergency by the Mayor:
A. Time limits for Employer replies on grievances;
B. Limitations on distribution of work assignments; and/or,
C. Limitations to distribution of overtime. In addition, and notwithstanding other Articles of this Agreement, the Employer reserves the right, during any such emergency to assign employees to work without regard to their employment classification. When there is a bona-fide immediate threat to the health, safety and welfare of the citizens of the City of Barberton, the Mayor, or the Department Head at the directions of the Mayor, shall require an employee to work until such time as the threat is reduced or eliminated. The determination of who shall work and the number of hours which shall be worked during a threat to the health, welfare and safety of the citizens of Barberton, is within the discretion of the Employer. Failure of an employee to report for work during an emergency may be cause for disciplinary action.
Declaration of Emergency. Upon a declaration by the Governor that an emergency situation exists in the delivery of behavioral or other health service delivery system that without intervention by government agencies, threatens the health, safety or welfare of the public, ADHS may operate as the Contractor or undertake actions to negotiate and award, with or without bid, a Contract to an entity to operate as the Contractor. Contracts awarded under this section are exempt from the requirements of A.R.S. Title 41, Chapter 23. ADHS shall immediately notify the affected Contractor(s) of its intention.
Declaration of Emergency. In a collaborative and joint effort to save employment for the bargaining unit, the parties agree as follows: The Board of County Commissioners shall have the right to declare a budgetary emergency. Such emergency shall usually be declared when in the judgment of the Board of Commissioners the provisions of this Article can be invoked to save employment and continue services in the County in lieu of lay off and removal of services. If the Board of Commissioners declares such an emergency, the County shall have the right to establish a shortened work week for employees according to the following:
A) The County shall notify the Union of the Emergency Declaration two weeks in advance of the date of such Emergency Declaration.
B) The County and the Union shall meet to bargain alternative means of resolving the Budgetary Emergency. Such meetings shall occur not more than 10 days after the declaration by the Board of County Commissioners. The bargaining meetings between the County and the Union shall conclude not later than 30 days following the declaration by the Board of County Commissioners. The parties may mutually agree to an alternate schedule for this paragraph. Such bargaining shall not include the steps of mediation and fact finding as set forth in the Public Employee Collective Bargaining Act (PECBA).
Declaration of Emergency. In the event that a state of emergency is declared by the Governor of any state which impacts the services which are being provided under this Agreement, the protocol and delegation of duties provided for herein shall be superseded by the provisions of SDCL Chap. 34-48A.
