Delay Time. It is the intent of the parties to make the driver whole for all justified delay time, such as waiting for late loads, unscheduled on property work, accident delay or on road equipment breakdown. Any disputes will be referred to the Joint Premium Service Review Committee.
Delay Time. (a) All time that the owner-operator is delayed beyond the time allotted by the terminal additive, whether such delay is caused by loading or delayed xxxxxxxx or receiving of vehicles, etc., shall be paid at the appropriate rate per hour for all hours in the service of the Employer over and above the time allotted for loading. Any such compensation paid to an owner-operator is not to be deducted from his truck earnings.
Delay Time. All uniformed employees on scheduled or special crews shall be paid volunteer time (one and one-half times the basic rate) for any extra time caused by being late when relieved or running vehicles into surface carhouses or garages when such delay is ten minutes or over. The overtime premium will apply on subway crews and S.R.T. crews when relieved or running trains in after five minutes because of delays in the system beyond the control of the operator. Such delays would include accumulated time on swing runs.
Delay Time. The Rates set out in Paragraph 1 are based upon voyages to be completed within the times specified below. If a voyage is not completed within the specified time, XXXXX shall be compensated for all additional time used at the rate of $967.00 per Tug per hour or pro-rated for part of an hour.
Delay Time. The Company will pay delay time for mechanical breakdowns to the trucks or trailers, adverse weather conditions including unsafe driving conditions, road closures from accidents or other incidents where driver is unable to detour. Delay time will be paid if the driver is instructed to be at work at a specific hour and no equipment is available at the start of the shift. It is recognized by the parties that certain customers may have additional security procedures or product testing protocols that extend delivery time anticipated and compensated under ‘variable pay’. In the event there are regular delays caused by the above noted circumstances, the drivers can either wait and continue with the Variable Pay compensation or can opt to be paid on an hourly basis for all time spent at that customer. When paid hourly, the driver will not be eligible to charge Customer Time or volume rates.

Delay Time. Delay Pay is paid for hours that the driver would have been on the clock less any unpaid delay time as described below, which will be paid at the regular hourly base rate. Tier 1 Delays • Incidents on the road. On the road defined as being not at a Labatt facility (brewery or warehouse). Incidents being defined as accidents involving the Company vehicle operated by the driver and/or mechanical breakdown of tractor and/or trailer. • Delay time at a Labatt facility resulting from the load not being completed at scheduled time. Delay time begins at scheduled appointment time and ends when load is available (e.g., bills printed). A signed delay slip must be obtained from the facility where the delay occurs, properly completed and submitted with a trip sheet. • Delay at TBS stores when the dock is inaccessible. Driver must arrive within 30 minutes of scheduled appointment time. Delay time begins at the later of driver arrival time and appointment time. Driver must obtain a signature from an employee at the store on a delay slip. • Official or Unofficial Road Closure which results in more than a 60 minute delay. The first 60 minutes of delay due to road closures are unpaid however in computing unpaid delay time due to road closure, all time delayed on that day for this reason is counted (i.e. time is cumulative). • Time spent while a full vehicle inspection is conducted by the MTO at highway weigh stations. Tier 2 Delays • Delays not specified as Tier 1 Delays will be paid at the Tier 2 rate. These are delays for maintenance at a Labatt facility, waiting for a tractor at a Labatt facility, and delays at highway weigh scales. • TBS delays such as late or slow staff, product spills, congested space, etc. TBS delays will only be considered as counting when the driver is on-site. The standard off-loading/reloading rate at TBS is 30 pallets per hour. Delay time will not accumulate for stops where off-loading or reloading is performed at, or in excess of, the rate of 30 pallets per hour. • Delays at highway weigh stations to rectify matters arising out of a full vehicle inspection at that weigh station. • The first 30 minutes of Tier 2 delays are not paid. This 30 minutes for such delays is cumulative for the work day.
