Disclosure and Barring. 24.1 The Service Provider warrants that he is a fit and proper person to undertake the Services. 24.2 The Service Provider warrants that where the Services require the Service Provider to come into regular contact with children or vulnerable adults, he and his staff and sub-contractors will comply with the requirements of the Disclosure and Barring Service and will have undertaken appropriate criminal records etc checks and that the results of those checks were satisfactory. 24.3 The Service Provider shall provide copies of any of its staff’s criminal records etc check to the Authorised Officer on request, albeit with any Personal Data redacted.

The Provider shall procure that, in respect of all potential employees or persons performing any of the Services which for the avoidance of doubt shall include all committee members of the Provider (each a “Named Employee”) or before a Named Employee begins to perform any of the Services: 12.1.1. each Named Employee is questioned as to whether he or she has any convictions; 12.1.2. the results are obtained of a check of the most extensive available kind made with the Disclosure and Barring Service in respect of each Named Employee. 12.1.3. to the extent permitted by Law a copy of the results of such checks as are referred to in clause 12.1.2 are notified to the Local Authority, upon request. 12.2. The Provider shall procure that no person who appears on a Barred List following the results of a Disclosure and Barring Service check shall be employed or engaged in the performance of the Service; 12.3. The Provider shall procure that no person who discloses any convictions or CBOs or who is found to have any convictions or CBOs following the results of a Disclosure and Barring Service check, is employed or engaged without the Local Authority’s prior written consent (such consent not to be unreasonably withheld or delayed). 12.4. In so far as permitted by law, the Provider shall procure that the Local Authority (Local Authority Designated Officer – LADO) is kept advised at all times of any Provider Personnel who, subsequent to his/her commencement of engagement pursuant to this Agreement: 12.4.1. receives a conviction or CBO which become known to the Provider or whose previous Convictions or CBO become known to the Provider; or 12.4.2. in respect of whom information is referred to the Disclosure and Barring Service pursuant to the Disclosure and Barring Scheme; or 12.4.3. who is placed on a Barred List pursuant to the Disclosure and Barring Scheme. 12.5. In the event that any Provider Personnel is added to a Barred List, the Provider shall procure that such person is immediately removed from the Local Authority Premises and/or shall cease to be engaged in the performance of the Services. 12.6. The Provider shall ensure that all checks undertaken in accordance with clause 12.1 shall comply with all relevant policies and procedures of the Derbyshire Local Safeguarding Board.

Disclosure and Barring. Service (DBS) checks (formerly known as Criminal Records Bureau) 10.1. The Guidance on Direct Payments 2009 issued by the Department of Health advised that Local Authorities have a power and in some cases a duty to undertake Disclosure and Barring Service checks on the Personal Assistants that Citizens may employ with their Direct Payments, which in Manchester are now called Cash Personal Budgets. Disclosure and Barring Service checks are undertaken to safeguard and inform the recruitment and employment of staff working with children and adults that require care support. They are important as a potential employee may have criminal convictions, cautions, or the Police may have information relating to previous criminal activity. However the use of DBS checks should not replace other pre-employment checks such as obtaining and checking references which are equally important. The Council strongly recommends that Citizens, Nominees or Authorised Person should ensure that any Personal Assistants they employ have a background check completed by the Disclosure and Barring Service. In certain circumstances, Disclosure and Barring Service checks will be mandatory before Personal Assistants can be paid from the Cash PB. This can include any Council agreement for you to employ close relatives that live in the same house. Regardless of whether or not the citizen decides to have their Personal Assistant checked they should ask their Personal Assistant to disclose any convictions, cautions, or warnings prior to starting work. Disclosure and Barring Service checks are mandatory for: Personal Assistants of Citizens where safeguarding concerns have arisen and a Disclosure and Barring Service check is considered necessary by the Council; A Nominee or Authorised Person who will be responsible for managing the cash element of the Cash IB who is not a close family member, or friend involved in the planning and delivery of the Citizens care; Personal Assistants directly employed by a Nominee or Authorised Person who is not a close family member or friend involved in the planning and delivery of the Customer’s care. The Council will pay for and organise initial mandatory Disclosure and Barring Service checks via the Council’s brokerage team if required. This is subject to all Personal Assistants registering with the Disclosure and Barring Services “Update Service”. Disclosure and Barring. 10.1 The Commissioners recognise that performance of the Agreement will require some Staff to work on duties involving access to vulnerable people or other members of the public towards whom the Commissioners owe a special duty of care (hereinafter referred to “Access Duties”). Access Duties shall include for the purpose of this Agreement all duties involving direct and indirect contact with vulnerable people including administrative tasks involving access to confidential Information. 10.2 The Provider shall ensure that no Staff shall carry out Access Duties under the Agreement unless and until:  The Provider has checked with the Disclosure and Barring Service that the person is not barred from working with Vulnerable People;  The person has applied for and obtained a new Enhanced certificate from the Disclosure and Barring (“DBS”) Service prior to the person commencing the performance of Access Duties;  The Provider has considered the Enhanced Disclosure certificate and deemed that the person is suitable for performing such duties (undertaking any risk assessment as required as a result of material information being disclosed); and  The person has given the Provider their written consent to complying with the terms of this sub-Condition;  The Provider will ensure that it obtains at least two written references pertaining to the persons’ suitability for undertaking access duties, one of which must be from the immediate previous employer;  The Provider has checked any gaps in the person’s employment history which must be obtained during the job application process. 10.3 The Provider shall:  Ensure that any person awaiting the results of a DBS disclosure shall not have any unsupervised direct or indirect contact with children and young people or any access to confidential Information (or any contact whatsoever if this is a requirement of relevant Regulations including but not limited to appropriate regulations as they would apply to Wales.  Ensure that prospective and existing Staff are aware that their post in the care sector is exempt from the provisions of the Rehabilitation of Offenders Xxx 0000 and they have a duty to disclose any offences committed prior to or during the lifetime of the DBS disclosure certificate;  Inform the Authorised Officer of any material information revealed on a certificate obtained;  On request, supply to the Authorised Officer a copy of any certificate so obtained and/or risk assessment recorded.  Unless indicated o...

You will be required to consent to subsequent DBS check from time to time during your employment as deemed appropriate by us.
