DSHS may require Contractor to provide additional information as deemed necessary by DSHS in connection with DSHS’s review of a deliverable. C. DSHS may reimburse Contractor up to the total award amount indicated in the Final Workplan for approved activities based on Contractor’s demonstrated successful achievement of deliverables.

DSHS Responsibilities. 3.1 Create, review and update policies and procedures to ensure compliance of Program; 3.2 Purchase medications for the treatment of sexually transmitted diseases (STDs) and tuberculosis (TB) with state and federal funds allocated for specific public health purposes that are administered and dispensed in compliance with Program regulations, as authorized by the Texas Health and Safety Code, Chapters 81, 85 and 1001; 3.3 Review, approve and monitor Clinic’s registration in Office of Pharmacy Affairs Information System (OPAIS); 3.4 May review and approve the eligibility for each Clinic location to participate in Program; 3.5 Ensure TB medications provided are through local, pre-authorized health department and entities; 3.6 Provide education concerning Program compliance to Clinic through initial and ongoing trainings by submitting information on how to sign-up for the Apexus PVP Program, a Health Resources and Services Administration (HRSA) contractor for further education; 3.7 Monitor and support Clinic on all compliance elements of the Program addressed in the policies outlined by the DSHS HIV/STD Program, which can be accessed at: xxxxx://xxx.xxxx.xxxxx.xxx/hivstd/policy/; and 3.8 Monitor and support Clinic on all compliance elements of the Program addressed in the policies outlined by the DSHS Tuberculosis and Xxxxxx’x Disease Branch in the Texas Tuberculosis Work Plan, which can be accessed at: xxxxx://xxx.xxxx.xxxxx.xxx/idcu/disease/tb/policies/ .

DSHS Responsibilities. A. DSHS, through TCID, is authorized to separately contract with individual providers, associates, or groups to perform either part-time or specialized roles in the provision of services at TCID. Such individuals shall be subject to the rules, regulations, and policies for practice at TCID and will be subject to the supervision of UTHealth’s TCID Medical Director regarding clinical standards and practices for clinical care and services. Any medical provider who is granted clinical privileges at TCID under contract shall be deemed to have accepted those privileges. Any such medical provider shall be deemed to have relinquished all clinical privileges at TCID upon termination of such contractual relationship for any reason. B. TCID will supply facilities, office space and furnishings, and such equipment as is required for the proper conduct of clinical practice and services for TCID patients, subject to proper and adequate documentation and to DSHS’ financial and programmatic circumstances. TCID will maintain said equipment in good order and repair, and shall furnish utilities, environmental services, maintenance, and other services as may be required by the Medical Staff, subject to DSHS’ financial and programmatic circumstances. UTHealth shall notify DSHS immediately and in writing of facts related to any unsafe premises, unsafe conditions, unsatisfactory facility service, or equipment malfunctions that need to be repaired or remedied. UTHealth agrees to notify DSHS of any such condition and allow a reasonable time for the repair or remedy prior to pursuing a complaint with an outside oversight authority unless law requires such notice. C. All non-physician personnel required for proper operation of TCID will be employed or assigned by TCID. The Parties further agree that any conflict that may arise in matters related to institutional or hospital policy and administration will be resolved in favor of policies established by Health & Human Services Commission (HHSC), DSHS, or TCID. However, UTHealth may notify the designated DSHS or TCID representative of quality, competence, efficiency, or behavior issues related to TCID personnel. DSHS Responsibilities. 2.1 DSHS shall ensure that the Title V designated programs are responsible for five-year and ongoing statewide needs assessment, program planning, development, implementation and evaluation of maternal and child health services in the State. DSHS shall evaluate progress and performance continuously and take actions to improve outcomes. 2.2 DSHS shall continue improving the health of pregnant women and children by supporting systems to provide and assure access to quality prenatal and child health services to women and children of low income or limited availability of services in a timely and appropriate manner. 2.3 DSHS shall continue ensuring access to medically appropriate services for pregnant women infants, children, adolescents and youth with special health care needs and children. DSHS maintains that direct clinical services are provided through Title V only when no other coverage is available. Title V funded programs that include direct clinical care benefits to clients provide information on available local, state, and federal resources that can help meet health care needs. Title V is the payer of last resort, by legislation, and the services listed by the state reflect services that were not covered or reimbursed through another provider. Eligible individuals for Children with Special Health Care Needs (CSHCN) Program Services include those who live in Texas, are under 21 years old (or any age with cystic fibrosis), and meet certain income and medical criteria. Because the CSHCN Services Program is the payer of last resort, all applicants must also apply for the Children’s Health Insurance Program (CHIP) and Medicaid. 2.4 DSHS shall continue to make statewide population-based health services available that meet the requirements of the Title V Maternal and Child Health Block Grant.

You will provide NCR Voyix access to your network, system, data, and relevant information as reasonably required to perform the Service. You acknowledge that NCR Voyix personnel may require, and you will provide, the ability to access and correct transaction or input data while the Service is being provided to you. NCR Voyix is not responsible for any damage caused by errors or omissions in any information, instructions, data, or scripts you or a third party provides on your behalf in connection with the Service, or any actions NCR Voyix takes at your direction. 7.2 To use the Service, you must maintain internet access at your own expense. NCR VOYIX IS NOT RESPONSIBLE FOR AND DOES NOT WARRANT THE PERFORMANCE OF ANY INTERNET SERVICE OR OTHER PROVIDER OR ITS SERVICES, AND YOU AGREE THAT NCR VOYIX HAS NO LIABILITY TO YOU FOR SUCH PERFORMANCE OR SERVICES. 7.3 Title to hardware, software, systems, documentation, and other intellectual property NCR Voyix uses to provide the Service will remain with NCR Voyix or its licensors, unless otherwise agreed in writing. You will take reasonable actions to protect NCR Voyix’s intellectual property rights. 7.4 You are responsible for complying with all rules, bylaws, programs, and regulations of the payment card networks in connection with your use of the Service, Software and Hardware, as applicable. You will defend and indemnify NCR Voyix against any claim or loss resulting from your failure to fulfill your responsibilities under this Section. 7.5 Certain Services may perform analysis of transaction records designed to identify transaction patterns and activity that may be indicative of fraud. You acknowledge that the indicia reported by such Services may not necessarily be the result of fraudulent activity. You are responsible for performing its own evaluation of any results. NCR Voyix does not guarantee the detection of fraudulent transactions. 7.6 You are responsible for all data, information, materials and instructions (“Customer Instructions”) provided to NCR Voyix by you or on your behalf. NCR Voyix is entitled to rely upon Customer Instructions. In no event will NCR Voyix be liable with respect to any loss, liability, cost, damage, or expense arising out of a claim by you or any third party to the extent that claim arises as a result of NCR Voyix’s compliance with Customer Instructions.
