EROSION AND SEDIMENTATION CONTROL. 27.1 The Developer agrees to implement the approved erosion and sedimentation and control plans and lot grading and drainage plans to the satisfaction of the Town, Niagara Region, and Niagara Peninsula Conservation Authority.
27.2 The Developer agrees to re-vegetate or otherwise restore all disturbed areas immediately upon the completion of on-site grading to the satisfaction of the Town and the Niagara Peninsula Conservation Authority.
EROSION AND SEDIMENTATION CONTROL. The Subdivider agrees, during and after construction, to monitor the erosion and sedimentation control facilities on a weekly basis, or forthwith following rainfall events of 13 millimetres or greater, and immediately rectify any deficiencies within 24 hours to the satisfaction of the City Engineer. Where overland drainage occurs to the open space areas, the Subdivider agrees that all of the erosion and sediment control works shall be inspected and maintained to ensure their structural integrity. The Subdivider shall provide the name and phone number of the Contractor for maintenance of the erosion and sedimentation control facilities. Where in the sole opinion of the City Engineer an emergency exists with respect to erosion and sedimentation control, the City may enter on the subdivision without notice and, at the expense of the Subdivider, do such work and provide such materials as are necessary to answer the emergency.
EROSION AND SEDIMENTATION CONTROL. (a) The subdivider shall prepare an erosion and sedimentation control plan addressing the installation and maintenance of soil erosion and sedimentation control measures. Such plans shall meet the requirements set forth in the Village Erosion Control Ordinance Section 7.21.
(b) The subdivider shall plant those grasses, trees, and groundcover of species and size specified by the Plan Commission, upon recommendation of the Village Engineer, necessary to prevent soil erosion and sedimentation, in accordance with the approved erosion and sedimentation control plan.
(c) The subdivider shall install those protection and rehabilitation measures, such as fencing, sloping, seeding, riprap, revetments, jetties, clearing, dredging, snagging, drop structures, brush mats, willow poles, and grade stabilization structures, set forth in the approved erosion and sedimentation control plan.
EROSION AND SEDIMENTATION CONTROL. Developer shall implement all erosion control measures detailed in the Storm Water Pollution Prevention Plan (“SWPPP”) and on the Grading and Drainage plan (including construction of all temporary and permanent ponds) in the order required by the Town Engineer. Developer shall also implement any additional erosion control measures required by the Town Engineer, and shall abide by all erosion control requirements contained in the Watab Subdivision ordinance and as required by the NPDES Construction Stormwater Permit for the project. The parties recognize that time is of the essence in controlling erosion. If the Developer does not comply with the erosion control plan and/or the requirements of the NPDES Construction Stormwater Permit, the Town may take such action as it deems appropriate to control erosion, and the landowner hereby grants the Town permission to enter upon the land and take such necessary erosion control actions. The Town will endeavor to notify the Developer in advance of any proposed action, but failure of the Town to do so will not affect the Developer's and Town's rights or obligations hereunder. If the Developer does not reimburse the Town for any cost the Town incurred for such work within thirty (30) days, the Town may draw down the letter of credit to pay any costs or may specially assess Developer’s land for the costs not covered by the letter of credit. No development will be allowed and no building permits will be issued unless the development is in full compliance with the erosion control requirements.

EROSION AND SEDIMENTATION CONTROL. .1 Provide control measures to prevent discharge of sediments or deleterious materials into the reservoir during construction activities according to requirements of authorities having jurisdiction.
.2 Provide temporary erosion and sedimentation control measures to prevent soil erosion and discharge of soil-bearing water runoff or airborne dust to adjacent properties and walkways, according to requirements of authorities having jurisdiction.
EROSION AND SEDIMENTATION CONTROL. Concurrent with demolition, grading and drainage, and building permit submittal for the undercrossing improvements, the Applicant shall submit a plan for construction of safety fences around the periphery of the construction area and a demolition Erosion and Sedimentation Control Plan. The fences and erosion and sedimentation control measures shall be installed according to the plan prior to commencing construction. The plans shall be reviewed and approved by the Building Official prior to issuance of a demolition permit.
EROSION AND SEDIMENTATION CONTROL. The contractor shall protect streams, lakes and wetlands from sediment discharges caused by the contractor's activities. The contractor shall also provide (where applicable) an erosion and sedimentation control plan in compliance with state and local laws and regulations, to the COR for approval prior to executing any soil-disturbing activities. The contractor must submit a National Pollutant Discharge Elimination System Permit to the Pennsylvania Department of Environmental Protection (PADEP) prior to any construction activity that encompasses more than one acre. All permits must be reviewed and approved by the EB prior to being sent to any regulatory authority. The contractor shall not disturb any wetlands. Contractor will remove all silt fencing and other temporary control measures once the site is stabilized. Contractor will remove all spoils from TYAD unless a previously approved disposal site has been established. The contract COR will be responsible for management and control of the spoils disposal site.

Payment under this item shall be for all furnishing of labor, services, tools, equipment, materials, appurtenances and incidentals required to perform erosion control measures, included but not limited to, prevention of adjacent streets, storm drains and property from accumulations of soil, sediment, and dust within the project limit areas and all surrounding project limit areas in accordance with the specifications, plans and these technical provisions. The Contractor is responsible for monitoring downstream conditions throughout the construction period and clearing any debris, sediment, and dust caused by the progress of the work, per the plans. The Contractor shall inspect, maintain, and clear erosion and sediment control devices, per the plans. This bid item will be paid as a Lump Sum, based on percentage of contract work completed. • Bid Item No. 3F – Storm Water Pollution Prevention Plan Preparation and Implementation: Payment under this item shall be for all furnishing of labor, services, tools, equipment, materials, appurtenances and incidentals required for doing all the work involved in “Storm Water Pollution Prevention,” complete in place, per the plans.
