FOP BUSINESS. The parties agree that certain employees will have time off in accordance with the following provisions:
FOP BUSINESS. Section 1. The Employer agrees to provide space on bulletin boards to the FOP for the announcement of meetings, election of officers of the FOP and any other material related to FOP business. Furthermore, the FOP shall not post material detrimental to the labor-management relationship nor of a political or controversial nature. The FOP may send mail related to FOP business to local official FOP representatives at appropriate facilities to which mail is delivered.
Section 2. No FOP member or representative shall solicit members, engage in organizational work, or participate in other FOP activities during working hours on the Employer's premises except as provided for in the processing of grievances.
FOP BUSINESS. Section 12.1: FOP Negotiations
FOP BUSINESS. SECTION 1. Elected officials of the FOP will be granted time off without loss of pay to attend monthly FOP meetings. Such leave will be subject to the following conditions:
A) Leave to attend a monthly FOP meeting will be limited to a maximum of two (2) persons in any one instance not to exceed eleven and one-half (11.5) hours per person; and
B) A written request shall be submitted to the Chief of Police (or a designee) at least seventy-two (72) hours in advance of the requested time off; and
C) Sufficient staffing is available to cover existing scheduled assignments and no overtime cost would result if the leave were approved. The determination of whether sufficient staffing is available as well as whether overtime would result will be made by the Chief of Police (or a designee) in his or her sole and exclusive discretion.
SECTION 2. The Department retains the right to restrict time off for FOP business when in the opinion of the Department, an unusual and/or emergency condition exists or is imminent and that such time off from work assignments would create a danger to public safety.
SECTION 3. Employees covered by this Agreement, who are members of the FOP, shall be granted up to a total of 330 hours of leave per fiscal year at no loss of pay in order to attend state and local FOP meetings, and/or the annual Police Memorial services held in Washington D.C. and Tallahassee. These 330 hours are the total number of hours available per fiscal year to the entire bargaining unit regardless of which bargaining unit members utilize said leave. However, in order to assure proper coverage of assignments, the Chief of Police, no later than thirty (30) days prior to the aforementioned events, shall be notified in writing of the names of the employees (who must also be FOP members) designated by the FOP to attend the above-listed functions.
FOP BUSINESS. A. Officers elected to FOP officer positions shall be allowed time off to perform their fraternal functions, including attendance at conferences, training, seminars, and meetings, if manpower permits.
B. This contract shall grant FOP officers and designated FOP members a bank of 200 hours paid time off (The “bank” for this article and section of this contract shall mean the 200 hour bank of paid time off for FOP business) per calendar year for FOP business to include:
1. FOP training/seminars
2. FOP meetings
3. Indiana legislative “open session”
4. Contract negotiation preparation and meetings
5. Allowing up to 3 officers elected/selected by the FOP as delegates to attend the annual FOP State conference.
6. Allowing up to 3 officers elected/selected by the FOP as delegates to attend the annual FOP National conference.
C. The bank of two hundred hours is to be tracked/monitored by an LPD employee of the Chief’s choosing.
D. Paid time off for FOP business shall be granted if manpower permits. This is to be determined by the Officer’s immediate supervisor, or shift/division supervisor.
E. The FOP president, or an LPD officer on the executive board of the FOP shall determine who receives hours and the amount of hours from the bank.
FOP BUSINESS. A. F.O.P. leave for duly elected or authorized representatives of the F.O.P. shall be as follows:
(1) Four (4) covered members will be allowed time off from their normal duty schedule with pay to participate in negotiations with the Employer.
(2) Two (2) members may be allowed time off, five (5) duty days each with pay, to attend the National Fraternal Order of Police convention, and based upon staffing considerations, up to six (6) members will be allowed time off, five (5) duty days each with pay, when approved by the Police Chief.
(3) Two (2) members will be allowed time off, three (3) duty days each with pay, to attend the annual Fraternal Order of Police State convention. Up to four (4) members may be allowed time off based on staffing considerations.
(4) Members may be allowed time off, with pay, to attend seminars.
B. The Employer shall be notified, in writing, as early as possible, but not less than thirty (30) days prior to absence for items set forth in (2), (3), and (4) above. Written notification shall specify the dates and length of absence.

FOP BUSINESS. Section 1. FOP Officials, not exceeding two (2) in number, shall be granted leave from duty, without pay, for the purpose of attending FOP meetings, conventions, educational conferences, or conducting FOP business, if the Sheriff re- ceives a written request from the FOP not less than one (1) week in advance of the requested leave date. Such employee(s) may use accrued leave in conjunction with provisions of this Section. The type of leave to be used shall be up to the discretion of the FOP Officer. Notwithstanding the above, this Section does not eliminate the Sheriff's discretion to allow more than two (2) FOP Officials to attend one of the aforementioned business meet- ings, conferences, or conventions.
Section 2. Members of the bargaining unit may contribute vacation or compensatory time to a FOP Time Bank for the use of members of the FOP to attend conferences, seminars or other meetings or training for members. Mem- bers may contribute 16 hours a year to the FOP Time Bank with a maximum accumulation of four hundred (400) hours. The FOP Time Bank will be ad- ministered by the executive board of FOP #26, all time off must be approved in the same manner as other leave time granted to employees by the em- ployer. Notwithstanding the above, for the member to donate to the FOP Time Bank said member must have at least forty-eight (48) hours of xxxx- tion/compensatory time remaining after donating time to the FOP Time Bank.
FOP BUSINESS. Section 1. Neither party shall have any control over the selection of the negotiating or bargaining representatives of the other party. The parties further agree that each shall recognize the designated representative of the other for all matters relating to the negotiation of this Agreement or any subsequent Agreement.
Section 2. The FOP representative may have a total of up to sixteen (16) hours off annually with pay during the term of this Agreement to engage in direct representational activity. The time off shall not be taken in increments of less than one (1) hour. These days off must be with the Chief’s approval and must not create a minimum xxxxxxx problem, require overtime or create any other problem which would impede the efficiency and smooth operation of the Department. A minimum of seven (7) days advance notice in writing is required for requested time off. The decision of the Chief as to whether to grant time off shall be final, but shall not be rendered in an arbitrary and capricious fashion. Any time not used at the expiration of any calendar year may be carried over up to a maximum accumulation of a total of 24 hours, including the sixteen (16) hours granted by the Town.
Section 3. Time off under Section 2 shall not be considered on duty for purposes of computing overtime nor is the employee eligible for Worker’s Compensation benefits in the event of injury.
Section 4. Neither the FOP representative nor any bargaining unit employees shall leave their posts or workstations during work hours for the purposes of investigating, presenting, handling or settling grievances. The FOP representative or his or her designee shall not contact any employee or other person concerning grievance matters or FOP business during either the working hours of any employee sought to be contacted. However, at the sole discretion of the Chief, the FOP Representative may be given reasonable opportunities on duty to confer with the Chief on potential grievances. The Chief may also at his sole discretion, allow the FOP representative to contact an employee concerning grievance matters during working hours at the request of the FOP representative. Neither the refusal of the Chief to meet with the FOP representative nor the refusal to allow grievance discussions on work time shall be subject to arbitration.
FOP BUSINESS. Section 12.1 : FOP Negotiations - No more than five (5) FOP representatives shall be granted leave with pay to attend negotiation sessions which are scheduled with the LaborCommissioner during the representatives' work hours, and FOP representatives shall be responsible for informing their supervisors, in a timely fashion, of expected absence from work.
Section 12.2: FOP Leave - Twelve Hundred and sixty (1260) hours with pay, per year, shall be granted to representatives for FOP Business. FOP representatives shall beresponsible for giving their individual supervisors advance notice of the representative's absence from work for FOP business.
