Holidays and Sick Leave. If a holiday occurs on a workday during the time an employee is absent on such sick leave with pay, he/she shall receive pay for the holiday and it shall not be counted as a day of sick leave. If an employee receives insurance benefits for that holiday, holiday pay shall be reduced by the amount of insurance benefits received, if any.

The Employee shall be entitled to six (6) days paid sick leave per year (pro rated if the Employee serves for less than the full calendar year). The Superintendent may take, at the Superintendent’s choice, the same number of days of vacation authorized by policies adopted by the Board for administrative employees on 12-month contracts, the days to be in a single period or at different times. The vacation days taken by the Superintendent will be taken at such time or times as will least interfere with the performance of the Superintendent’s duties as set forth in this Agreement. The Superintendent shall observe the same legal holidays as provided by Board policies for administrative employees on 12-month contracts. At the time of separation, Superintendent shall be reimbursed for each day of unused local leave, to a maximum of 30 days, at the superintendent’s annual per diem pay rate as established by this contract.

The Union agrees to waive the sick leave benefits set forth in Labor Code sections 245-249 as well as the San Francisco, Oakland and Emeryville paid sick leave ordinances and any paid sick leave ordinances enacted in the future that may be waived through collective bargaining.
