HOURS OF WORK, SCHEDULING AND STAFFING. A. Hours of Work 1. The basic workday shall consist of eight (8) hours, exclusive of a one-half (1/2) hour meal period. Alternative workdays may include, ten (10), or twelve (12) hour shifts, exclusive of a one-half (1/2) hour meal period. Alternative workdays, e.g., other than ten (10) or twelve (12) hour shifts may occur upon mutual agreement of the Medical Center, ONA, and the affected nurse. 2. The basic work period shall be eighty (80) hours each two (2) week period, beginning at 0001 Monday, except for those nurses on a ten (10) or twelve (12) hour shift, whose basic work period shall be forty (40) hours each week beginning at 0001 Monday. The basic workday shall be twenty-four (24) hours beginning at 0001. 3. The hospital and the nurses shall be responsible for working together to arrange suitable breaks and meal periods. Two (2)-rest periods of fifteen (15) minutes shall be allowed for every eight 16 (8) hour shiftshift. One lunch period of 30 minutes shall be allowed for 17 every shiftshift of eight (8) hours or greater.

Two (2) rest 28 periods of fifteen (15) minutes, shall be allowed for every eight (8) hour 29 shift. Three (3) rest periods of fifteen (15) minutes, shall be allowed for 30 each ten (10) or twelve (12) hour shift. For eight (8) hour nurses, the meal 31 period must be started by the end of the fifth (5th) hour of work. For ten 32 (10) or twelve (12) hour nurses, the meal period must be started by the 33 end of the sixth (6th) hour of work. Nurses agree to communicate to the 34 Charge Nurse, Clinical Coordinator or House Supervisor in a timely 1 manner if they anticipate not being able to take a meal period. Nurses 2 may combine rest breaks, if staffing permits, on longer shifts. If no meal 3 period is provided by the Medical Center the nurse will complete the 4 appropriate payroll notification process and will be paid for the missed 5 meal period. 7 4. Nurses are expected to obtain proper advance authorization for all work in 8 excess of the basic shift. 10 5. No pyramiding of premium and straight pay shall result in an hourly rate 11 being paid at greater than time and one half (1 ½). 13 6. Nurses who are required to wear Medical Center supplied scrubs will clock 14 in seven (7) minutes before the start of the scheduled shift to change into 15 the scrubs. Nurses will be permitted to leave the floor (if other duties are 16 completed) seven (7) minutes before the end of the scheduled shift, to 17 change out of the scrubs, before clocking out.

The basic workday shall be twenty-four (24) hours 18 beginning at 0001. 19 2. Two (2)-rest periods of fifteen (15) minutes shall be allowed for every eight 20 (8) hour shift. One lunch period of 30 minutes shall be allowed for every 21 shift of eight (8) hours or greater. 23 B. Overtime: A nurse shall be paid time and one-half (1-1/2) the nurse's regular 24 straight time hourly rate for all hours worked in any category listed below. No 25 hours worked shall qualify for the time and one-half (1-1/2) rate in more than one 26 category. 28 1. Hours worked in excess of forty (40) hours per one (1) week period, 29 beginning at 0100 Monday. 31 2. Hours worked by nurses while on call back. In such circumstances, nurses 32 shall receive a minimum of three (3) hours work or equivalent pay at the 33 overtime rate. 1 C. Weekends: 3 1. The Medical Center shall have as an objective the provision of at least 5 Diem RN status. 6 2. A nurse working on a regularly scheduled weekend will be paid his or 7 her regular straight-time hourly rate (plus any applicable differential). 8 D. Holidays: Hours worked by nurses on New Year's Day, Easter, Memorial Day, 9 July 4th, Labor Day, Thanksgiving Day, Christmas Eve Day, and Christmas Day 10 will be paid at the rate of one and one-half the nurse's regular hourly rate. 12 E. Scheduling: 14 1. All work schedules, (excluding specialty subgroups), shall be posted at 15 least 2 weeks in advance, and shall set forth the schedule for 28 calendar 16 days of employment. Once the schedule is posted, the schedule may not 17 be changed without the nurse's consent. Nurses shall be permitted to 18 make trades in their schedules when such trades will not result in premium 19 pay obligations, which would not otherwise have existed. For purposes of 20 this paragraph, “specialty subgroups” includes lactation/maternal-child. 22 2. Nurses who are scheduled to report to work, and who are permitted to 23 come to work without receiving prior notice that no work is available in 24 their regular assignment, shall perform any nursing work to which they 25 may be assigned. When the Medical Center is unable to utilize such 26 nurse, the nurse shall be paid an amount equivalent to four (4) hours at 27 his/her straight time hourly rate plus applicable shift differential.   • – HOURS OF WORK & SCHEDULING 15.01 The normal hours of work for an employee are not a guarantee of work per day or per week, or a guarantee of days of work per week. The normal hours of work shall be seven and one-half (7½) hours per day, and seventy-five (75) hours in any bi-weekly period. 15.02 The normal daily shift shall consist of seven and one-half (7½) consecutive hours, exclusive of a one-half (½) hour unpaid meal period. Employees shall be entitled to a fifteen (15) minute paid break during each half of the normal daily shift, at a time designated by the Employer. 15.03 Employees required for reporting purposes shall remain at work for a period of up to fifteen (15) minutes which shall be unpaid. Should the reporting time extend beyond fifteen (15) minutes however, the entire period shall be considered overtime for the purposes of payment. 15.04 Requests for change in posted work schedules must be submitted in writing and co-signed by the employee willing to exchange days off or shifts and are subject to the discretion of the Administrator or her designate. In any event, it is understood that such a change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment or any other claims on the Employer by any employee under the terms of this Agreement. 15.05 Where there is a change to Daylight Savings from Standard Time or vice-versa, an employee who is scheduled and works a full shift shall be paid for a seven and one-half (7½) hour shift rather than the actual hours worked. 15.06 In the event that a meal period is interrupted requiring an employee to attend to a work related problem, then the balance of the unused meal period will be taken within two (2) hours of the interruption. If the employee is unable to reschedule such time, she shall be paid time and one-half (1½) her regular straight time hourly rate for all time worked in excess of her normal daily hours, in accordance with Article 16.01.

(a) There shall be a minimum of sixteen (16) hours off between changes of shift unless mutually agreed otherwise. (b) An employee shall not be required to work more than seven (7) consecutive days without days off, unless mutually agreed to by the employee and the Employer. (a) Any employee who is working a permanent shift as of December 31, 1996 shall not be transferred to another shift without their consent. (b) Where possible, the employee will not be scheduled to work more than two

  • HOURS OF WORK i) Where employees are now working a longer daily tour, the provisions set out in this Article governing the regular hours of work on a daily tour shall be adjusted accordingly. ii) The normal daily extended tour shall be 11.25 consecutive hours in any 24-hour period, exclusive of a total of forty-five (45) minutes of unpaid meal time. For hybrid schedules, there will be scheduled normal daily tours of seven and one-half (7½) hours and 11.25 consecutive hours per day. iii) Employees working an extended tour shall be entitled, subject to the exigencies of resident care, to paid relief periods during the tour of a total of forty-five (45) minutes. For hybrid schedules, there will also be shifts that provide for relief periods in accordance with Article 15.02. iv) Scheduling issues will be resolved at the local level. v) Where the union and the employer have agreed to or agree to an extended daily tour or hybrid schedule that differs from the normal daily extended tour, the proportion of unpaid time to hours of work shall maintain the same ratio as set out in paragraph ii) and iii) of this Article.

  • ARTICLE HOURS OF WORK The following provision designating regular hours on a daily tour and regular daily tours over the nursing schedule determined by the Hospital shall not be construed to be a guarantee of the hours of work to be performed on each tour or during each tour schedule. Subject to Article below:

  • HOURS OF WORK & OVERTIME Section 15.1 This Article is intended to define the normal hours of work per day or per week in effect at the time of execution of this Agreement. Nothing contained herein shall be construed as preventing the Employer from restructuring the normal workday or workweek as necessary to promote efficiency or improve services, or from establishing the work schedules of employees. However, nothing in this Section shall relieve the Employer of its duty to bargain the affects of such decisions on employee wages, hours, terms and other conditions of employment. This Article shall be used as the basis for computing overtime for employees who are not exempt from the overtime provisions of the Fair Labor Standards Act and shall not be construed as a guarantee of hours of work per day or per week. Section 15.2 Employees may take one paid fifteen (15) minute break for every four (4) hour block worked. Employees may combine breaks to take up to one (1) sixty (60) minute paid break. Employees may not leave campus on their paid breaks. Section 15.3 Bargaining unit employees who are not exempt from the provisions of the Fair Labor Standards Act will be paid one and one-half times their normal hourly rate for all hours actually worked in excess of forty (40) hours per work week. All overtime shall have prior supervisory approval, except when it is necessary for a nurse to remain on duty to protect patient safety. Only hours actually worked are counted for the purpose of computing an employee's eligibility for overtime pay. There shall be no pyramiding of hours or pay. Section 15.4 The Board serves individuals 24 hours per day, 7 days per week. To meet this need for service to our individuals evening and weekend hours may be required of any bargaining unit employee. The Employer will establish the standard work day as beginning at 6:00 a.m. and ending at 5:59 a.m. and starting and ending times for each shift in each department. Supervisors will establish daily workschedules. Section 15.5 Absent an emergency situation, management will notify the Union in the event management intends to institute a long-term change in the present shift times for nurses. Following notification and upon request by the Union, management will meet with the Union to discuss the reason for the change and possible alternatives.

  • HOURS OF WORK AND OVERTIME 16.01 Employees will be scheduled to work not more than twenty-four (24) hours in any one pay week, excluding summer months (May, June, July, August). It is understood the scheduling of employees is the responsibility of the Employer. 16.02 Employees who receive less than twenty-four (24) hours’ notice of the cancellation of their regularly scheduled shift, or who show up for a scheduled shift and no work is available, will receive a minimum of three (3) hours pay, except for those 16.03 Employees covered by this collective agreement shall be paid in accordance with the applicable Employment Standards legislation for public holidays. 16.04 For the purposes of this agreement, the public holidays will be: 16.05 The night shift shall be defined as the shift where the majority of hours fall between the hours of 2:00 a.m. and 6:00 a.m. Employees working the night shift will be paid an additional fifty cents ($0.50) per hour for the duration of the shift. 16.06 All employees covered by this agreement will be allocated one shift based on availability and seniority. Further shifts, including regularly scheduled shifts which are posted after the schedule has been established, will be allocated by seniority, it being understood that an employee may drop another regularly scheduled shift for this purpose. (a) Summer employment will be granted to such employees who have notified, in writing, the Operations Manager, by April 1 of their availability for summer (May, June, July, August) employment. (b) Employment starting the following September and January will be granted to such employees who have notified, in writing, the Operations Manager, by August 1 and December 1 respectively of their availability for employment in that semester. (c) Employees shall be allowed to remove a regularly scheduled shift from their schedule if they notify their respective supervisor/ manager, in writing, at least five (5) calendar days in advance of the start of the shift in question.
