HOURS OF WORK AND SCHEDULING. 15.01 The normal hours of work for an employee are not a guarantee of work per day or per week, or a guarantee of days of work per week. The normal hours of work shall be seven and one-half (7-1/2) hours per day, and seventy-five (75) hours in any bi-weekly period. 15.02 The normal daily shift shall consist of seven and one-half (7 ½) consecutive hours, exclusive of a one-half (1/2) hour unpaid meal period. For employees working the night shift, this one-half (1/2) hour will be paid. Employees shall be entitled to a fifteen (15) minute paid break during each half of the normal daily shift, at a time designated by the Employer. An employee may combine her rest periods in order to have one (1) thirty (30) minute break, providing she has prior approval from the Director of Nursing. When a meal period is interrupted requiring an employee to attend to a work related problem, then the balance of the unused meal period will be taken within two (2) hours of the interruption. If the employee is unable to reschedule such time, she shall be paid time and one-half (1½) her regular straight time hourly rate for all time worked in excess of her normal daily hours, in accordance with Article 16.01. 15.03 Employees required for reporting purposes shall remain at work for a period of up to fifteen (15) minutes which shall be unpaid. Should the reporting time extend beyond fifteen (15) minutes however, the entire period shall be considered overtime for the purposes of payment. 15.04 Requests for change in posted work schedules must be submitted in writing and co-signed by the employee willing to exchange days off or shifts and are subject to the discretion of the Administrator or her designate. In any event, it is understood that such a change initiated by the employee and approved by the Employer shall not result in overtime compensation or payment or any other claims on the Employer by any employee under the terms of this Agreement. 15.05 Where there is a change to Daylight Savings from Standard Time or vice-versa, an employee who is scheduled and works a full shift shall be paid for the actual hours worked at her regular straight time hourly rate. 15.06 There shall be no split shifts. (a) There shall be a minimum of sixteen (16) hours off between changes of shift unless mutually agreed otherwise. HOURS OF WORK AND SCHEDULING. 10.01 The hours of work shall be as set out in the Collective Agreement with 40 hours being the regular work week. In order that there should be consistency on the site between various affiliates of the Council, the following hours of work and scheduling prerogatives shall apply: (a) The following Articles are intended to identify regular hours of work, shift hours, and overtime hours and are not to be construed as a guarantee of hours of work per day, per week, or with respect to days of work in any week. (b) The regular work week shall consist of forty (40) hours of work. The start time for a regular working day or a compressed work week day will be between 6:00 and 8:00 a.m. (c) Recognizing that it may be necessary to establish schedules that accommodate flights to and from the Project for workers from Alberta, workers from other Canadian Provinces, or for Temporary Foreign Workers that may be employed on the Project, the Owner, the Managing Contractor, or all or some of the contractors affected by this Agreement may institute the work schedules under Schedules attached to this Agreement. Certain of these Schedules will be referred to as “Fly-in Fly-out Schedules” and will apply to all workers who utilize flights arranged for the purposes of transporting workers to and from the Project. Workers on fly-in fly- out schedules will not be entitled to initial or terminal travel provisions or turn-around provisions under their respective Provincial Collective Agreement. Alternative Fly-in Fly-out work schedules may be developed by the Parties provided such are ratified by the Coordinating Committee and by the Council, through whatever ratification process the Coordinating Committee and the Council shall each determine. (d) In addition to the Hours of Work above, the Owner, Managing Contractor, or the Employer may utilize the Ten & Four (10&4) or Fourteen & Seven (14&7) work cycle as described in Schedules 1 and 2. (e) When the final day of the work cycle reduced due to the timing of flights, overtime at time-and-one-half shall apply to the last one- and-one-half hours worked on that day. (f) The Employer may also schedule shifts for which the start times are between 12:00 noon and 4:00 a.m. To be classified as shift work rather than as overtime, such shifts must be scheduled for at least one regular work week. HOURS OF WORK AND SCHEDULING. (a) Employees are paid based on a 40-hour work week but normally work fourteen 12-hour shifts over a 4-week period; employees are normally scheduled for either three 12-hour shifts or four 12-hour shifts in a week. At least 2 employees are normally scheduled on 8- hour maintenance shifts. The employee schedule on their second week of Maintenance would be available for vacation coverage within the USW Group. (b) The Salary Grid referenced in the Collective Agreement represents full-time equivalent salaries for a regular 35-hour work week. Employees’ full-time equivalent salary will be adjusted proportionately to reflect a regular work week of 40 hours. (c) Effective the date of ratification by both parties the normal work schedule is a 6-week rotation of: • Seven 12-hour night shifts over 2 weeks; • Seven 12-hour day shifts over 2 weeks; and • Ten 8-hour day shifts on maintenance over 2 weeks (d) It is understood that the normal work schedule above is based on 6 employees normally working in the rotation. (e) Employees who work fourteen 12-hour shifts over a 4-week period earn 8 hours of lieu time (“Earned Day Off”) in that period, which will be taken during the employee’s next scheduled maintenance week, normally on the first day of that week. (f) When operational requirements deem it necessary to designate a temporary shift change that will last 1 month or less, the employee whose shift schedule is to be changed shall be given 5 days’ notice of the change in shift. Failure to give the required 5 days’ notice of the change in shift shall result in payment to the employee at 1.5 times their regular hourly rate for the first full shift so affected. (g) Due to the requirements of the job, it is understood that the eating period for employees shall be a paid period of time. During all break times employees are required to remain in the control room and be available for emergency work. Break times cannot be accumulated and taken as time off. (h) It is understood and agreed that the work of employees is not operationally suitable for Flexible Hours of Work arrangements, as set out in Article 20.08 of the Collective Agreement.

Should a Nurse be recalled to duty during mealtime, additional time shall be provided later in the tour. There will be two (2) rest periods of fifteen (15) minutes in each tour exceeding 6.5 hours and one (1) rest period for each tour exceeding 3.25 hours but not exceeding 6.5 hours. 13.03 In the event that an employee is required to remain at work, for reporting purposes only, for a period of up to fifteen (15) minutes past their regularly scheduled end of their tour, this period shall remain unpaid. Should the time extend beyond fifteen (15) minutes, the entire period shall be considered overtime for the purposes of payment. 13.04 A scheduled tour is defined as the tour that is posted on the schedule of work. Schedules shall be posted at least two (2) weeks in advance of the week to which they apply and shall cover a four (4) week period. Should it be necessary for the Employer to make changes in the posted time with less than twenty-four (24) hours notice, employees affected by such change shall be paid time and one-half for all hours worked on the first shift of the new schedule. A shift is defined as a day, evening or night tour. The schedules of work, once posted, shall not be changed without the direct knowledge of the employee. 13.05 Requests by both full-time and part-time employees for specific days off (excluding vacation days) shall be submitted in writing to the Director of Care or designate one (1) week prior to the posting of the schedule and will not be unreasonably denied. The Director of Care or designate will consider late requests on a case-by-case basis. 13.06 Requests for exchange in posted work schedules must be submitted in writing at least one (1) week in advance of the date requested and co-signed by the employee willing to exchange days off or tours and are subject to the discretion of the Manager or her/his designate.
