Illness in Line of Duty Leave. Illness in the line of duty is granted up to a maximum of ten (10) days per year when any teacher is absent from his/her duties because of personal injury received in the discharge of his/her duty, or because of illness from any contagious or infectious diseases contracted in school work. Any personal injury received while on duty will be considered as a qualifying injury under this policy, provided the injury is reported to the immediate supervisor within twenty-four hours or by the end of the next workday. Any employee who has claim for compensation while absent because of illness/injury incurred on the job shall file a claim within five (5) working days following his/her return from such absence. Contagious or infectious diseases refer to those normally related to children such as measles, chicken pox, and mumps. Additional emergency sick leave may be granted out of local funds for such terms and under such conditions as the Board shall deem proper.

Illness in Line of Duty Leave. All employees shall be entitled to illness-in-line-of-duty leave when they are absent from their duties because of illness from any contagious or infectious disease contracted in the course of their employment. The following requirements shall be observed:

Illness- in-the-line-of-duty leave for a teacher shall be authorized for a total of, but not to exceed, ten (10) school days during any school year. If a teacher has used the ten (10) days allowed, he/she shall be granted additional leave by the Board with the only requirements being those listed below:
Illness in Line of Duty Leave. Full-time faculty members shall receive leave with pay, in addition to sick leave, not to exceed twelve (12) days per event, including paid holidays, in one calendar year, when absent for illness or injury contracted due to the performance of duty. Notification and claim for compensation and payment shall be as in Section 1012.865, Florida Statutes, and shall be filed by the end of the pay period in which such absence occurred, or within seven (7) days or as soon as practicable in the case of incapacity, with exceptions to be determined by Human Resources. Total compensation paid, including paid leave under this section and workers' compensation under Chapter 440, Florida Statutes, shall not exceed the faculty member's normal rate of compensation.
Illness in Line of Duty Leave. An employee shall be entitled to illness-in-line-of duty leave when said employee needs to be absent from duty because of a personal injury received in the discharge of duty or because of illness from any contagious or infectious disease contracted in school work, excluding common colds, flu and other sickness of this nature. A physician's statement verifying the nature of the injury or illness must be provided by the employee before illness-in-line-of duty leave pay is granted. Furthermore, it is incumbent upon the employee to provide evidence that such injury was incurred during his line of duty. Such leave may be authorized for a total not to exceed ten (10) duty days during any fiscal year for illness contracted, or injury incurred, from such causes as prescribed above, such leave not to be deducted from the employee's sick leave. In the case of sickness or injury occurring under such circumstances, additional sick leave may be granted for such term and under such conditions as the School Board shall deem proper.

Illness in Line of Duty Leave. Any full-time employee shall be entitled to illness-in-line-of-duty leave when she/he has to be absent from her/his duties because of illness from any contagious or infectious disease contracted therein. Any employee requesting such leave shall provide proof, when so requested, that illness was contracted while discharging her/his duties as such employee. Such leave may be authorized for a total of not over ten (10) days during any fiscal year, subject to the provisions of Section 1012.63, F.S. Where the amount of compensation payable hereunder for injuries, accidents or other disabilities which would entitle the employee to compensation under the provisions of the Florida Worker's Compensation Law, exceeds the amounts payable under said compensation law, payments hereunder shall be made for the difference between the amount paid under said Florida Workers' Compensation Law and the amount otherwise due under the provisions of this section.
Illness in Line of Duty Leave. In conjunction with the Family and Medical Leave Section of this Agreement, an employee shall be entitled to a maximum of ten (10) days of illness-in-line-of-duty leave each school fiscal year when unable to perform his/her duties because of personal injury in discharge of his/her duties or because of illness from a contagious or infectious disease contracted in his/her work. Such leave shall be non- cumulative from year to year and when approved by the School Board shall be used before charging any absence to regular accrued sick leave; provided the following conditions are met:

Such leave may be authorized for a total of not over ten (10) days during any school year, subject to the provisions of 1012.63 (1) Where the amount of compensation payable under the provisions of the education code, for injuries, accidents or other disabilities which would entitle the employee to compensation under the provisions of the Florida Workers' Compensation Law, exceeds the amounts payable under the compensation law, payments shall be made, as provided in the education code, for the difference between the amount paid under the Workers’ Compensation Law and the amount due under the provisions of the education code.
