Jury Duty/Crown Witness Leave. A seniority employee who is summoned and reports for jury duty, shall be paid by the Company an amount equal to the difference between the daily jury fee paid by the Court (not including travel allowance or reimbursement of expenses), for each day on which he/she reports for, or performs, jury duty, on which he/she otherwise would have been scheduled to work for the Company and, the wages that would have been earned by the employee from the Company by working during straight-time hours on such days. This clause will also apply in the case of an employee who was working afternoon or night shift, who has to report for jury duty or as a crown witness during non-scheduled working hours. Such employee will be granted his shift off with pay, the shift following or shift prior to the day he reports for jury duty or as a crown witness.

Jury Duty/Crown Witness Leave. 28.01 An employee who is selected for service as a juror or summoned as a Crown witness will be compensated for loss of pay from his regularly scheduled shift due to such jury or Crown witness service up to a maximum of two (2) weeks per contract year. Such compensation will be based on his regular hourly rate less the fee received for his services as a juror or Crown witness. However, should the employee present himself for selection as a juror and not be selected, then he is required, where circumstances reasonably allow, to return to the plant to complete his remaining normally scheduled work day. 28.02 In order for an employee to qualify for payment under this section, he must: (a) inform his supervisor of his selection or subpoena and provide the Employer with a copy of the Summons to Witness or Jury Duty; (b) if released from service as a juror or Crown witness and half a shift or more remains in the employee’s regularly scheduled shift, he must, where circumstances reasonably allow, return to the plant, to complete his remaining normally scheduled work day; (c) provide a written statement (should the Court be willing to provide such statement) to the Employer indicating the date of his service as a juror or Crown witness and the time so spent and the fee received for such service; and (d) have successfully completed his probationary period.

The Company will provide compensation for full- time employees for the difference between what you would have earned for your regularly scheduled shift times straight time earnings and the jury pay you receive. You are expected to report back to work if excused early or excused for an entire day. Proof of attendance will be necessary.

Jury Duty/Crown Witness Leave. When an associate is required to serve on a Jury or as a subpoenaed Crown Witness, he shall be relieved of his duties for such time as it may require, and he shall be paid the difference between his fee as a Juror or Witness, and his earnings for the time lost, providing the associate furnishes the Company with a certificate of service signed by the clerk of the Court showing the amount of any fee received. It is the associate’s responsibility to come to work at anytime during the week that he is not actually required for Jury duty or to be present in Court.

The employee will provide evidence that s/he reported for jury duty or attended as a subpoenaed witness. It is the employee’s responsibility to come to work at anytime during the week that they are not actually required for Jury Duty or to be present in Court. Seniority and vacation accrual and benefits shall be maintained during Jury Duty/ Crown Witness/ work related Leave.

(b) In order for an employee to qualify for payment under this section, he must: (i) inform his Supervisor of his selection or subpoena and provide the Employer with a copy of the Summons to Witness or Jury Duty; (ii) if released from service as a juror or Crown witness and six
Jury Duty/Crown Witness Leave. If an employee (including a probationary employee) is required to serve as a juror in any court of law, or is required to attend as a witness in a court proceeding in which the Crown is a party the employee shall not lose regular pay because of such attendance, provided that the employee: (a) notifies the Employer immediately on the employees notification that they will be required to attend at court. (b) presents proof of service requiring the employee’s attendance; and (c) deposits with the Employer the full amount of compensation received, excluding mileage, travelling and meal allowance, and an official receipt thereof. For further clarity this clause does not apply to Grievance arbitration, labour Board proceeding, or any court proceeding in which the Union is a party.
