LABOR MANAGEMENT COOPERATION INITIATIVE. 1. The Employer agrees to make payments to The Painters and Allied Trades Labor- Management Cooperation Initiative ("LMCI") for each employee covered by this Agreement, as follows:
(a) For each hour or portion thereof, for which an employee receives pay, the Employer shall make a contribution of five cents ($0.05) to the LMCI.
(b) For the purpose of this Article, each hour worked and/or paid for, including hours attributable to show up time, and other hours for which pay is received by the employee in accordance with this Agreement, shall be counted as hours for which contributions are payable.
(c) Contributions shall be paid on behalf of any employee starting with the employee's first day of employment in a job classification covered by this Agreement. This includes, but is not limited to, apprentices, trainees, and probationary employees.
(d) The Employer and Union signatory to this Agreement agree to be bound by and to the Agreement and Declaration of Trust, as amended from time to time, establishing the LMCI.
2. The Employer hereby irrevocably designates as its representatives on the Board of Trustees such Trustees as are now serving, or who will in the future serve, as Employer Trustees, together with their successors.
3. All contributions shall be made at such time and in such manner as the Trustees require; and the Trustees may at any time conduct an audit in accordance with the Agreement and Declaration of Trust.
4. If an Employer fails to make contributions to the LMCI within twenty (20) days after the date required by the Trustees, the Union shall have the right to take whatever steps are necessary to secure compliance with this Agreement, any other provision hereof to the contrary notwithstanding, and the Employer shall be liable for all costs of collection of the payments due together with attorney fees and such penalties as may be assessed by the Trustees. The Employer's liability for payment under this Article shall not be subject to or covered by any grievance or arbitration procedure or any "no-strike" clause which may be provided or set forth elsewhere in this Agreement.
LABOR MANAGEMENT COOPERATION INITIATIVE. The Employer and the Union hereby agree to the continuation of the Labor Management Cooperation Initiative (“LMCI”) and further provide a minimum contribution of five cents ($.05) per hour for each employee covered under this Agreement.
LABOR MANAGEMENT COOPERATION INITIATIVE. 1. There has been established a Labor Management Cooperation Initiative for the purpose of improving relationships within the floor covering and related industries. Effective, on the date of this Agreement, a minimum Employer contribution of five cents ($0.05) per hour for all hours worked has been adopted by the Floor Covering Association of the Central Coast Counties on behalf of those of their regular members who have authorized their inclusion in the coverage of this Agreement and Employers whose primary place of business is located within the jurisdiction of the Union and will be binding upon all Employers signatory to or bound by this Agreement.
2. The contribution rate shall be set forth in Wage Schedule A and shall be paid on all hours worked.
LABOR MANAGEMENT COOPERATION INITIATIVE. Commencing with the 1st day of June, 2021, and for the duration of this Agreement, and any renewals or extension thereof, the Employer agrees to make payments to the Painters and Allied Trades Labor-Management Cooperation Initiative (“Initiative”) for each employee covered by this Agreement, as follows:
(a) For the period June 1, 2021 through May 31, 2022, Employer shall make a contribution of ten cents (10¢) per hour or a portion thereof for which an employee covered by this agreement receives pay. The amount may be increased in each contract year from the Union’s total economic adjustment package. For the purpose of this Article, each hour paid for, including hours attributable to show up time, and other hours for which pay is received by the employee in accordance with the Agreement, shall be counted as hours for which contributions are payable.
(b) Contributions shall be paid on behalf of any employee starting with the employee's first day of employment in a job classification covered by this Agreement. This includes, but is not limited to, apprentices, helpers, and probationary employees.
(c) The Employer and Union signatory to this Agreement agree to be bound by and to the Agreement and Declaration of Trust, as amended from time to time, establishing the Fund.
LABOR MANAGEMENT COOPERATION INITIATIVE. We hereby establish a contribution to the Labor Management Cooperation Initiative (LMCI) effective the date of this working agreement and any renewals or extensions thereof.
(a) For each hour or portion thereof, for each employee covered under this Collective Agreement, the Employer shall pay five cents ($0.05) payable to the District Council 16 Northern California Health & Welfare Trust Fund. Such contributions shall be forwarded to the LMCI Trust Fund.
(b) For the purpose of this Article, each hour paid for, including hours attributed to show up time, and other hours for which pay is received by the employee in accordance with this Agreement, shall be counted as hours for which contributions are payable.
(c) Contributions shall be paid on behalf of any employee starting with the first (1st) day of employment in a job classification covered by this Agreement.
LABOR MANAGEMENT COOPERATION INITIATIVE. The Employer, as defined in the National Trust Indenture executed by and between the International Union of Painters & Allied Trades and employer associations in the industry agrees to make payment to the Industry Betterment Fund "for each Employee covered by this Agreement. From the funds collected in the above manner, the Trustees of the Industry Betterment Fund shall hold in trust the sum of ten cents ($.10) per hour, for each hour or portion thereof on all hours worked and remit said sum to the Painters & Allied Trades Labor Management Cooperation Initiative at such regular periods of time and in the manner and form as shall be determined by the Trustees of the National Fund from time to time.
LABOR MANAGEMENT COOPERATION INITIATIVE. 31.1 The Labor Management Cooperation Initiative will be used to advance our Painting and Allied Trades Industry and will not be used, directly or indirectly, to the detriment of either party. The Fund shall be administered by the Painters District Council No. 58 Labor Management Cooperation Initiative Board of Trustees, said Trustees will establish a Declaration of Trust, the terms of which are hereby accepted by the Employers signatory to this Agreement.
31.2 For every hour that an Employee receives pay, the Employer will contribute the rate specified in the appropriate addendum, however, upon receipt of notice, in writing, to the Employers from the Union, the Employer shall contribute an amount, as designated in such notice, to the Labor Management Cooperation Initiative, in lieu of wages, and shall be effective the first (1st) day of the calendar month following notification.
31.3 Of the hourly amount contributed by the Employer to the Labor Management Cooperation Initiative, a specified contribution for each hour worked will be contributed to the I.U.P.A.T. Labor Management Cooperation Initiative. Contribution rates for each geographic area are listed in the wage addendum section.
LABOR MANAGEMENT COOPERATION INITIATIVE. (LMCI)
Section 1. Employer’s Obligation to Contribute. The Employer agrees to make payments to the Painters and Allied Trades Labor Management Cooperation Initiative (LMCI) for each Employee covered by this Agreement as follows:
A. For each hour or portion thereof for which an Employee (as defined in paragraph (c) below) receives pay, the Employer shall make a contribution of ten cents ($.10) per hour to the LMCI.
B. For purposes of the Employer’s obligation under paragraph (a) of this Article, an Employee shall be considered to receive pay for each hour actually paid in accordance with this Agreement, including payment for show up time and other hours for which the Employee receives pay.
C. The Employer shall contribute to the LMCI on behalf of each Employee employed in a job classification covered by this Agreement, beginning with the Employee’s first hour of employment within such covered job classification. Covered Employees shall include but are not limited to apprentices, helpers, trainees, and probationary Employees.
D. The Employer and Union signatory to this Agreement agree to be bound by and to the Agreement and Declaration of Trust establishing the LMCI (the “Trust Agreement”), as amended from time to time, the terms of which are hereby incorporated by reference.
LABOR MANAGEMENT COOPERATION INITIATIVE. (a) For the duration of this Agreement, and any renewals or extensions thereof, the Signatory Employers and any Employer as defined in the Agreement and Declaration of Trust establishing the Labor Management Cooperation Initiative ("LMCI"), agree to make payments to LMCI for the JOURNEYPERSONS and apprentices covered by this Agreement, and to be bound by and to said Agreement and Declaration of Trust. The .Employers agree to submit ten cents ($0 .10) per hour to the LMCI.
