LABOR, MATERIALS AND EQUIPMENT. Contractor shall furnish all tools, equipment, apparatus, facilities, transportation, labor, and material necessary to furnish the services herein described, the services to be performed at such times and places as directed by and subject to the approval of the authorized District representative indicated in the Work specifications attached hereto. Unless otherwise specified, all materials shall be new and previously unused, and of the manufacturer’s latest model or the best of their respective kinds and grades as noted or specified, and workmanship shall be of good quality.
LABOR, MATERIALS AND EQUIPMENT. A. DESIGN/BUILDER shall provide competent, suitably qualified personnel to survey and lay out the Construction and perform Construction as required by the Contract Documents. DESIGN/BUILDER shall at all times maintain good discipline and order at the Site.
B. Unless otherwise specified in the Contract Documents, DESIGN/BUILDER shall furnish or cause to be furnished and assume full responsibility for materials, equipment, labor, transportation, construction equipment and machinery, tools, appliances, fuel, heat, telephone, sanitary facilities, and all other facilities and incidentals necessary for the furnishing, performance, testing, start-up and completion of the Work, excluding, specifically, power, light, water, temporary facilities and all other items designated as OWNER’s responsibility. DESIGN/BUILDER will direct the checkout of utilities and operations of systems and equipment.
C. All materials and equipment incorporated into the Work shall be of good quality and new. All warranties and guarantees specifically called for by the Contract Documents shall expressly run to the benefit of OWNER. If reasonably required by OWNER, DESIGN/BUILDER shall furnish satisfactory evidence (including reports of required tests) as to the kind and quality of materials and equipment. All materials and equipment shall be applied, installed, connected, erected, used, cleaned and conditioned in accordance with instructions of the applicable Supplier.
LABOR, MATERIALS AND EQUIPMENT. Awarded Bidder shall furnish all labor, materials, and equipment necessary for satisfactory Contract performance. When not specifically identified in the Technical Specifications, such materials and equipment shall be of a suitable type and grade for the purpose of the Work and Contract. All materials, workmanship, and equipment shall be subject to inspection and approval by the County prior to commencement of the Work, unless otherwise specified in the Solicitation.
LABOR, MATERIALS AND EQUIPMENT. 6.4.1 The Contractor shall provide competent, qualified personnel to lay out its Work from base lines and bench marks established and to perform construction as required by the Contract Documents. It shall at all times maintain good discipline and order at the site.
6.4.2 Contractor shall furnish all material, equipment, transportation, labor, construction equipment and machinery, tools, appliances, fuel, power, light, heat, telephone, water and sanitary facilities and all other facilities and incidentals necessary for the execution, testing, initial operation and completion of the Work, unless otherwise provided in the Contract Documents.
6.4.3 All materials and equipment incorporated into the Project shall be new except as otherwise provided in the Contract Documents. If required by County, Contractor shall furnish satisfactory evidence as to the kind and quality of materials and equipment.
6.4.4 All materials and equipment shall be applied, installed, connected, erected, used, cleaned and conditioned in accordance with the instructions of the applicable manufacturer, fabricator, supplier or distributor, except as otherwise provided in the Contract Documents.
6.4.5 The Contractor shall be responsible for providing a complete and operable installation of all equipment it furnishes. Any changes or Modifications required to the Contract Documents as a result of the equipment manufacturer’s requirements, and all adjustments to all other Work affected thereby, including but not limited to, added engineering costs due to redesign (to be paid to a design professional), structural, mechanical, electrical, heating, ventilation and air conditioning changes shall be borne by the Contractor at no additional cost to the County.

2. Any Work, materials or equipment which does not conform to these requirements or the standards set forth in the Contract Documents may be disapproved and rejected by the Architect or Commission, in which case it will be removed and replaced by the Design-Builder as provided hereinafter in Section 13.08, “Correction of Work Before Final Payment” or Section 13.09 “Correction of Work After Final Payment.”
3. The Design-Builder will keep proper inventories, provide adequate protection against the weather, and maintain security measures against theft and vandalism with respect to all stored materials, fixtures, and equipment for items stored on- Site and not yet incorporated into the Work.
4. The Site will not be utilized for the storage of vehicles, materials, equipment, or fixtures not intended for this Project.
5. The Design-Builder will review any specified construction or installation procedures (including those recommended by any product manufacturer). The Design-Builder will advise the Architect and Commission Representative in writing 7 Days prior to commencing Work, on items affected:
a. if any specified procedure deviates from good construction practice;
b. if following any specified procedure will affect any warranties; or
c. if there are any objections which the Design-Builder may have to any specified procedure.

Except as otherwise required for the safety or protection of persons or the Work or property at the Site or adjacent thereto, and except as otherwise indicated in the Contract Documents, all Construction at the Site shall be performed during regular working hours, and DESIGN/BUILDER will not permit overtime work or the performance of Construction on Saturday, Sunday or any legal holiday without OWNER's written consent, which will not be unreasonably withheld.

Contractor shall furnish and transport all labor, materials, tools, implements, appliances and equipment required to perform and completely finish in a workmanlike manner to the satisfaction and approval of the District, free of any and all liens and claims of laborers, artisans, material men, suppliers, and subcontractors, and in conformity in all respects with all applicable federal, state, county, and municipal laws, ordinances, rules, regulations, the work described in the plans and/or specifications, if any, or as described in this contract.

E. The contractor shall be responsible for providing a complete and operable installation of all equipment it furnishes. Any changes or modifications required to the contract documents as a result of the equipment manufacturer’s requirements, and all adjustments to all other work affected thereby, including but not limited to, added engineering costs due to redesign (to be paid to the architect/engineer), structural, mechanical, electrical, heating, ventilation and air conditioning changes shall be borne by the contractor at no additional cost to the County.
F. All materials and equipment purchased by the County under a Owner Direct Purchase (Sales Tax Recovery) shall be F.O.B. destination to the location of the project or the specified site on a purchase order. Delivery shall not be complete until the Contractor has accepted each item. Delivery to a common carrier shall not constitute delivery to the County.
LABOR, MATERIALS AND EQUIPMENT. 5.7.3.1 Design-Builder shall provide competent, suitably qualified personnel to survey and lay out the construction and perform construction as required by the Contract Documents and Applicable Law. Design-Builder shall at all times maintain good discipline and order at the Sites. Except as otherwise required for the safety or protection of persons or the Work or property at the Sites or adjacent thereto, and except as otherwise indicated in the Contract Documents, all construction at the Sites shall be performed during regular working hours, and Design-Builder will not permit overtime work or the performance of construction on Saturday, Sunday or any legal holiday without City’s prior written consent. Within the Sites, the regular working hours shall be Monday to Friday, 8:00 am to 5:00 pm. For areas adjacent to the Sites, the regular work hours shall be Monday to Friday, 8:30 am to 3:00 pm.
5.7.3.2 The Design-Builder is prohibited from working on Saturdays, Sundays, holidays, or after normal business hours, except as limited by written approval from the Engineer before doing so, and must demonstrate the Work requested to be performed is on the critical path. When Work is performed on Saturdays, Sundays, holidays or after normal business hours at the request of Design-Builder, any extra costs incurred will be born solely by the Design- Builder. Further, any additional costs incurred by the City arising from Work performed on Saturdays, Sundays, holidays or after normal business hours at the request of Design-Builder, including, but not limited to, costs of inspections and tests, shall be reimbursed to City by Design- Builder.
5.7.3.3 Unless otherwise specified in the Contract Documents, Design- Builder shall furnish or cause to be furnished and assume full responsibility for materials, equipment, labor, transportation, construction equipment and machinery, tools, appliances, fuel, power, light, heat, telephone, water, sanitary facilities, parking, storage, onsite safety and services, construction site offices and supplies, temporary facilities and all other facilities and incidentals necessary for the furnishing, performance, testing, start-up and completion of the Work. Design- Builder, in the presence of City’s personnel, will direct the checkout of utilities and operations of systems and equipment.
