Legal Assistance and Indemnification. In the event any employee covered by this Agreement is sued in any civil proceeding as a result of actions performed by said employee in the performance of his duties as an employee of the Tiverton Fire Department, the Town of Tiverton agrees to provide said employee with all necessary legal assistance and further agrees to pay any judgment rendered against said employee.
Legal Assistance and Indemnification. In the event any employee covered by this Agreement is sued in any civil proceeding as the result of actions performed by said employee in the performance of his/her duties as an employee of the Town, the Town of South Kingstown agrees to provide such employee with all necessary legal assistance, and further agrees to pay any judgment rendered against such employee, provided such actions are not wanton, reckless, malicious, or grossly negligent. The provision of this Article shall be deemed to have been complied with as long as the Town has in effect the existing (or their equivalent) insurance policies for Comprehensive General Liability Insurance with coverage up to One Million Dollars ($1,000,000) and including the employees as named insured while acting within the scope of their duties. The Town shall within thirty (30) days of this Agreement post in the Day Room a copy of any such insurance policies as information for bargaining unit members.

In the event any employee covered by this Agreement is sued in any civil proceeding as a result of actions performed by said employee in the performance of his/her duties as an employee of the Smithfield Fire Department, the Town agrees to provide such employee with all necessary legal assistance and further agrees to pay any judgment rendered against such employee in any such proceeding. This Section shall not apply to conduct of an employee which is willful, deliberate, or beyond the scope of this employment.

In the event any employee is sued in any civil proceeding as the result of actions performed by said employee in the performance of his duties as an employee of the Department, the Town agrees to provide such employees with all necessary legal assistance, and further agrees to pay any judgment rendered against such employee, within the limits of the insurance coverage presently in effect, which limit is presently five million dollars ($5,000,000.00).

In the event any employee covered by this Agreement is sued in any civil proceeding as a result of actions performed by said employee in the performance of his duties as an employee of the Barrington Fire Department, the Town of Barrington agrees to provide such employee with all necessary legal assistance and further agrees to pay any judgment rendered against such employee in any such proceeding. This Section shall not apply to tortuous conduct of an employee which is willful, deliberate or beyond the scope of his employment.
Legal Assistance and Indemnification. If an action is brought against Business Administrator for damages on account of an injury to a person or property, and it is alleged that the act of Business Administrator which gave rise to the claim was within the scope of the office or her duties, District shall, upon the written request of Business Administrator, defend the action, unless or until there is a judicial determination that such act was not within the scope of the office or duties of Business Administrator. Additionally, if an action is brought against Business Administrator for damages on account of an injury to a person or property, and Business Administrator has given timely prior written notice to the District, and it is judicially determined that an act of Business Administrator caused the injury and such act was, or that Business Administrator in good faith reasonably believed that such act was, within the scope of her office or duties, the District shall indemnify Business Administrator for the payment of any judgment of the suit. This obligation to defend and indemnify Business Administrator is consistent with the provisions set forth in the Political Subdivision Tort Claims Act. The District’s obligation to defend and/or indemnify Business Administrator is limited to and shall not in any way exceed the terms set forth herein. This section shall survive the term of this Agreement.

In the event any police officer covered by this Agreement is sued in any civil proceeding as the result of actions performed by said police officer in the performance of his/her duty as a police officer of the Portsmouth Police Department, the Town of Portsmouth agrees to provide such police officer with all necessary legal assistance, and further agrees to pay any judgment rendered against such police officer, within the limits of the insurance coverage presently in effect.
Legal Assistance and Indemnification. In the event any employee covered by this Agreement is sued in any civil proceeding as a result of actions performed by said employee in the performance of his duties as an employee of the Cranston Fire Department, the City agrees to provide such employee with all necessary legal assistance and further agrees to pay any judgment rendered against such employee in any such proceeding; provided, however, that the City shall have the right to deny all or a portion of the benefits under this Section if it determines that the employee acted outside the scope of his employment, or engaged in intentional, willful or malicious, tortuous or criminal conduct.
